Authorization from the Board of Trustees to approve: AN ORDER DESIGNATING THE 100 BLOCK OF STANTON AVENUE AS AN “ALTERNATE PARKING” AREA IN THE VILLAGE AND ELIMINATING ALL OTHER PARKING REGULATIONS/SIGNAGE IN THAT AREA EXCEPT FOR SIGNS PROHIBITING PARKING NEAR INTERSECTIONS SECTION 1. LEGISLATIVE INTENT/SEQR By adoption of this Order, the Village Board of Trustees of the Village of Solvay pursuant to the authority of § 1640 of the Vehicle and Traffic Law of the State of New York, Section 20-2002 of the New York Village Law and Section 160-3.1 of the Municipal Code of the Village of Solvay, declares its intent to be, the designation of the 100 block of Stanton Avenue as an “alternate parking” zone in accordance with §160-74 of the Village Code and the elimination of all other parking restrictions, except those restrictions applied in accordance with Section 160-25 of the Village Code, titled “signs prohibiting parking from designated point to intersection” and §160- 63, titled “parking hear street crossing or intersection”. This is a Type II action for purposes of SEQR, thus concluding environmental review of this action. SECTION 2. REMOVAL OF “1-HOUR CHURCH PARKING AND HANDICAP PARKING SIGNS Existing signs in the 100 block of Stanton Ave. relating to “1-hour church parking” and “handicapped parking spaces” are hereby rescinded and all such signs shall be removed forthwith. SECTION 3. DESIGNATION OF THE 100 BLOCK OF STANTON AVENUE AS AN “ALTERNATE PARKING” ZONE: The 100 block of Stanton Avenue is hereby designated as an “alternate parking” (odd/even parking) zone in accordance with §160-74 of the Village Code. SECTION 4. WHEN EFFECTIVE This Order shall take effect immediately and all signs heretofore erected and installed designating handicap parking spaces and “1-hour church parking” at the aforesaid location shall be removed, and appropriate “alternate parking” (odd/even) shall be erected and installed along both sides of the 100 block of Stanton Avenue forthwith. Authorization from the Board of Trustees for the Solvay Public Library to hire a Part Time Library Clerk to work eleven hours per week, at a rate of $11.10 per hour. In addition to work at the front desk, this Clerk will assist craft and story time programs for children and young adults. MOTION: SECOND: AYES: NAYES: MOTION CARRIED 11. Authorization from the Board of Trustees to hold a public hearing to consider the 2018/19 budget for the Village of Solvay, to be held on April 10, 2018 in the Community Room of the Geddes Town Hall, 1000 Woods Road, at 5:30 in the afternoon of that day. Authorization from the Board of Trustees for the acceptance of a parcel of land adjacent to West Farm Road, at 104 West Farm Road, for road purposes, from Daniel and Annmarie Wilson and authorizing the Mayor to sign any and all documents required to record this transaction in the Onondaga County Clerk’s Office. Authorization from the Board of Trustees to write off York Metal, Account #400001 for $23,171.79 and Tops, Account #22283 for $12,400.44 as Uncollectible. Authorization from the Board of Trustees to approve the Memorandum of Agreement dated March 13, 2018, settling the Village’s contract with the Solvay PBA for the years 2011 through 2017. MOTION: SECOND: AYES: NAYES: MOTION CARRIED 17. Authorization from the Board of Trustees for a planned fund deficit not to exceed $350,000 to use General Fund Surplus to pay Police Retroactive Pay. Authorization from the Board of Trustees for the Solvay Electric Department to entertain BOCES electric students for shadowing at the Electric Department provided there is no cost to the Village and the Village is fully indemnified as to any claims made relating to the student shadowing arrangement. Authorization from the Board of Trustees to approve: WHEREAS, the Village of Solvay Board of Trustees (hereinafter referred to as the “Village Board”) received an application from O’Reilly Auto Enterprises, LLC (hereinafter referred to as the “Applicant”), dated December 8, 2017, accompanied by a Short Environmental Assessment Form (hereinafter referred to as the “Short EAF”) with supplemental materials, requesting approval to subdivide a portion of Lots 7 and 8.1 of Map 14, Block 6, Book of Deeds 4210, Page 240, as filed with the Onondaga County Clerk’s Office, so as to create a new parcel; and WHEREAS, pursuant to the Village of Solvay Subdivision Regulations, the scope of the Village of Solvay Planning Board’s authority is to review subdivision applications and render a recommendation to the Village Board for consideration; and WHEREAS, the Village of Solvay Planning Board has reviewed the “Subdivision Plan of Land, O’Reilly Auto Enterprises, LLC,” and recommended approving same; and WHEREAS, the requirements of 6 NYCRR Part 617 have heretofore been satisfied by a Resolution dated January 23, 2017, in which the Village Board, upon reviewing the Short EAF, and determined that the proposed subdivision action was an Unlisted Action; and WHEREAS, the Village Board has duly called and held a public hearing to consider Applicant’s subdivision application, which hearing was held on February 27, 2018; and WHEREAS, no one from the public appeared at the public hearing to voice their support or opposition for the application; and March 27, 2018 Regular Board Meeting WHEREAS, the application was referred to the Onondaga County Planning Board (OCPB), as required by General Municipal Law Section 239-m for their review and comments; and WHEREAS, the OCPB session having taking place, the OCPB determined in OCPB Case # S-18-22, by a Resolution dated March 21, 2018 that said referral will have no significant adverse inter- community or county-wide implications, but offered the following comment for consideration: “[p]er the New York State Department of Transportation, the municipality is advised to ensure appropriate easements or agreements are in place for any shared driveways or parking;” and WHEREAS, this Board has determined that the Final Plat as submitted is in substantial compliance with the Preliminary Plat and is hereby and herewith approved by this Board, and that pursuant to Section 7-728 of the Village Law and the Subdivision Regulations of the Village of Solvay, the requirements for a public hearing on the final application may be waived. NOW THEREFORE, BE IT RESOLVED, that the Village of Solvay Board of Trustees after careful review of the application and Environmental Assessment Form hereby determines the proposed action will not have a significant adverse effect on the environment, and this Resolution shall constitute a Negative Declaration for the purposes of Article 8 of the Environmental Conservation Law, Volume 6 of the NYCRR Section 617.3 for the following reasons: 1. The proposed subdivision, if granted, would not disturb the environment, and would permit development in a planned manner; 2. There are no unusual or unique land forms or environmentally sensitive areas on the site; 3. Although the proposed action results in the creation of a new lot, the proposed subdivision will not increase the intensity of the development of the property nor does it change the use of an existing commercial structure; and RESOLVED, that the Village of Solvay Board of Trustees does hereby approve the subdivision known as “Subdivision Plan of Land, O’Reilly Auto Enterprises, LLC,” based upon a Preliminary Plan prepared by Control Point Associates, Inc., dated December 11, 2017, most recently revised January 25, 2018, such approval is conditioned upon the property owner, Westvale Plaza, PLLC, retaining a cross easement, so as to provide access to the remainder of Lot 8.1, of Map 14, Block 6, Book of Deeds 4210, Page 240, from Charles Avenue, proof of such cross easement having been recorded with the Onondaga county clerk’s Office to be submitted to the Village of Solvay Code Enforcement Office within 60 days of this date; and it is further RESOLVED AND DETERMINED, that pursuant to Section 7-728 of the Village Law and the Subdivision Regulations of the Village of Solvay, the requirement for a public hearing on the Final Plat Plan is hereby waived; and it is further RESOLVED AND DETERMINED, that the Applicant shall present the Final Plan to the Mayor for his signature and shall file same with the County Clerk and the Village Clerk within sixty-two (62) days of this resolution or this subdivision will be deemed void in accordance with New York State Village Law §7-728. Authorization from the Board of Trustees to approve: THE PURCHASE OF A NEW 2019 FREIGHTLINER TRUCK WITH TEREX HIGH RANGER OPTIMA AERIAL DEVICE IN ACCORDANCE WITH ONONDAGA COUNTY BID NUMBER 7823, FOR THE USE OF THE ELECTRIC DEPARTMENT OF THE VILLAGE OF SOLVAY, ONONDAGA COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $230,000 AND AUTHORIZING THE ISSUANCE OF UP TO $230,000 SERIAL BONDS OF SAID VILLAGE TO PAY THE COST THEREOF. BE IT RESOLVED, BY THE AFFIRMATIVE VOTE OF NOT LESS THAN TWO THIRDS OF THE TOTAL VOTING STRENGTH OF THE BOARD OF TRUSTEES OF THE VILLAGE OF SOLVAY, ONONDAGA COUNTY, NEW YORK (THE “VILLAGE”), AS FOLLOWS: Section 1. The purchase of a new 2019 Freightliner truck, with a Terex High Ranger Optima Aerial device and accessory features, in accordance with specifications set forth in Onondaga County bid no. 7823, is hereby authorized. This truck and related equipment is authorized to be acquired through a piggyback purchase pursuant to Onondaga County bid number 7823 from Tracey Road Equipment. Section 2. The maximum estimated cost of such class of objects or purposes is $230,000 and the plan for the financing thereof is as follows: By issuance of $230,000 serial bonds of said Village, hereby authorized to be issued pursuant to the Local Finance Law. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid class of objects or purposes is five (5) years, pursuant to subdivision 29 of paragraph (a) of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will not exceed five (5) years. Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Acting Treasurer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Acting Treasurer, consistent with the provisions of the Local Finance Law. Section 5 The faith and credit of said Village of Solvay, Onondaga County, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such obligations as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year. Section 6 The validity of such bonds and bond anticipation notes may be contested only if: a) Such obligations are authorized for an object or purpose for which said Village is not authorized to expend money; or b) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty (20) days after the date of such publication; or c) Such obligations are authorized in violation of the provisions of the Constitution. Section 7 This resolution which takes effect immediately shall be published in full in the Post Standard, the official newspaper, together with a notice of the Village Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. Authorization from the Board of Trustee to introduce proposed Local Law No. C-2018 to amend the Code of the Village of Solvay to prohibit vehicle parking between street curbs and principal structures within the Village of Solvay and made the following Resolution. WHEREAS, no other agency has the legal authority or jurisdiction to approve or directly undertake the enactment of Local Laws in the Village of Solvay, such that there are no other involved agencies within the meaning of the New York State Environmental Quality Review Act (SEQR) with respect to the proposed enactment of said Local Law. NOW, THEREFORE, it is RESOLVED AND DETERMINED, that this Board shall act as lead agency, the enactment of proposed Local Law C-2018 is a Type II action and will have no adverse impact on the environment, in accordance with 6 NYCRR Part 617.5(C) (20) thereby concluding the SEQR process; and it is further RESOLVED AND DETERMINED, that the Village Board shall conduct a public hearing as to the enactment of proposed Local Law C-2018 at the Town of Geddes Town Hall, 1000 Woods Road, Solvay, New York on April 24, 2018 at 7:00 p.m., or as soon thereafter as the matter can be heard, at which time all persons interested in the subject shall be heard.
