Village of South Blooming Grove Board of Trustees Regular Meeting Monday January 25, 2016 7:00 P.M.  Call to order o Deputy Mayor Hickey called to order the Village Board Meeting at 7:00 pm on January 25, 2016 at the South Blooming Grove Village Hall located at 811 State Route 208, within the Village of South Blooming Grove, and having a mailing address of Monroe, New York.  Roll call The following persons were present: o John Hickey - Deputy Mayor o James Mullany - Trustee o Dorine Sas – Trustee o James LoFranco – Trustee o Dennis Lynch, Esq. – Special Counsel Absent o Robert Jeroloman– Mayor  Public Comments o Kenneth Daubert, Monroe Woodbury, Assistant Director of Transportation, appeared before the Village Board to discuss his e-mail correspondence dated January 6, 2016. There have been many accidents along Route 208 where school buses need to stop and pick up/drop off children. He would like the village to allow New York State Department of Transportation to perform a traffic study on Route 208 from Duelk Avenue to where the village meets Monroe to support his request for a speed limit change on Route 208. Deputy Mayor Hickey advised that correspondence will be sent and the village will notify Kenneth Daubert regarding same. o Donna McGoldrick - is concerned with • Garbage in the neighborhood and lack of bulk pick-up during the winter months. • She will compile a list of her concerns and provide to the Village. • Water resources within the Village. • Un-permited improvements within the Village. o Debbie Bragado - is concerned with • Speeding on the Village roads. • She would like to see permits for construction work be displayed in windows. Adopted: February 8, 2016  Village of South Blooming Grove Board of Trustees Regular Meeting Monday January 25, 2016 7:00 P.M. • She advised that there is construction being performed in the evening. o Tommy Bayer- he feels that permits should be placed in the windows of houses which have secured permits. o Toni Picone - she is concerned about vehicles that are driving around the neighborhood and especially one vehicle which parks close to the children’s bus stop during the times the children get on/off of the bus. She has contacted the police on numerous occasions. She inquired about Washingtonville school buses picking up children and bringing them to a school other than Washingtonville School District. o Jeff Baum - he has witnessed an Emergency Medical Vehicle driving around and stopping at houses and taking pictures of homes. He is feeling harassed. He is concerned about the village’s water resources and water restrictions that have been in place for such a long time. o Carol Egan - stated that many of the neighborhood homes are owned by a Limited Liability Corporation (LLC) and many of the homes selling are not listed on real estate web sites. Special Counsel Lynch advised that there is no prohibition in taking title in an LLC, corporation or individual names. Buying a home as an LLC to his knowledge violates no known law. Renting out a house where the use is not permitted by law, should be brought to the board’s attention. Special Counsel Lynch stated that if someone believes that the existing laws are being violated they should document it and bring it to the village’s attention o Special Counsel Lynch advised that if residents believe the existing laws are violated, residents should document it and bring it to the village’s attention. Residents are asked to bring forward facts, information and documentation in the form of a complaint if you feel there is a violation. o Sara Howell - is concerned about property and school taxes and exemptions. o Mike Creen – expressed his concern regarding garbage along the side of the village roads. o Michelle Rivera - asked about the garbage on the side of the road especially along Route 208. o Beth Baum - concerned about additions on houses without permits. o Patricia Valentine - asked if there are limitations on occupancy of homes and/or rented homes. o Anthony Bernhardt - he is retiring and selling his home. He is sad that none of his children want the home. o Chris McConnell - state that he received a knock on his door and a gift at his home with a note that said it was from a personal home buyer. He also asked if the Worley Heights sign will be going back up. Adopted: February 8, 2016  Village of South Blooming Grove Board of Trustees Regular Meeting Monday January 25, 2016 7:00 P.M. o Tommy Bayer - inquired about permits being displayed/posted when work is being done. He inquired about fire codes in the Village. o Patricia Becker - is concerned about her neighbor’s dog defecating on her lawn. She advised that a good job was being done regarding snow removal. o Judy Bernard - stated that her water has been dirty and she has to continually clean her coil in her home. o Matthew Whelan - asked if the Village had a plan in order if there was a breakdown in structure. The board advised that there is an Emergency Management Plan in place. Trustee Hickey asked Resident Whelan if he could put his concerns on paper and provide to the Village.  Correspondence o Village of South Blooming Grove Planning Board Notice of Intent to be Lead Agency in the matter of the Clovewood Project. The Village Board feels they have more experience in being Lead Agency and are contesting and moving forward to become Lead Agency regarding this project. o CPC, LLC (Clovewood) Water Well Application dated January 12, 2016. The Village Board is awaiting expert review and comment regarding this application. o TAM proposal for patch liner regarding 6 Houston Avenue.  Executive Session o Motion into executive session to discuss terms in the irrevocable license agreement and litigation issues by Trustee Sas, seconded by Trustee Mullany at 8:20 pm. 4 Ayes, 1 Absent. o Motion to exit executive session by Trustee Mullany, seconded by Trustee LoFranco at 8:26 p.m. 4 Ayes, 1 Absent.  Abstract o Motion to adopt the abstract by Trustee Sas, seconded by Trustee Mullany; 4 Ayes, 1 Absent. Adopted: February 8, 2016  Village of South Blooming Grove Board of Trustees Regular Meeting Monday January 25, 2016 7:00 P.M.  Business o Resolution No. (3) – Appointing election inspectors for the Village General Election on March 15, 2016. Motion to accept by Trustee LoFranco, seconded by Trustee Sas. Resolution passed. 4 Ayes - Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco. 1 Absent - Mayor Jeroloman. o Resolution No. (4) – Authorizing concurrent representation for the law firm of Feerick Lynch MacCartney. Motion to accept by Trustee Mullany, seconded by Trustee Sas. Resolution passed. 4 Ayes - Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco. 1 Absent - Mayor Jeroloman. o Resolution No. (5) - The Village Board wishes to express its intention to jointly act with the Village Planning Board to serve as Lead Agency with regard to the Clovewood project and contests the Village Planning Board serving solely as Lead Agency with regard to the Clovewood project. Motion to accept by Trustee Sas, seconded by Trustee LoFranco. Resolution passed. 4 Ayes - Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco. 1 Absent - Mayor Jeroloman. o Resolution No. (6) - Authorizing the Mayor or his designee to negotiate an agreement with property owner at 6 Houston Avenue and execute acceptance of proposal. Motion to accept by Trustee Sas, seconded by Trustee Mullany. Resolution passed. 4 Ayes - Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco. 1 Absent - Mayor Jeroloman.  Adjournment o Motion to close the meeting by Trustee LoFranco, seconded by Trustee Sas at 8:37 pm. 4 Ayes, Absent.
