Village of South Blooming Grove Board of Trustees Regular Meeting Monday August 22, 2016 7:00 P.M.  Call to order o Mayor Robert Jeroloman called to order the Village Board Meeting at 7:04 pm on August 22, 2016 at the South Blooming Grove Village Hall located at 811 State Route 208, within the Village of South Blooming Grove, and having a mailing address of Monroe, New York.  Roll call The following persons were present: o Robert Jeroloman- Mayor o John Hickey – Deputy Mayor o James Mullany - Trustee o Dorine Sas – Trustee o James LoFranco- Trustee o Dennis Lynch, Esq. o Chief Carl Schupp, Blooming Grove Police Chief Absent o None  Comments o Attorney Lynch discussed today’s Bankruptcy Court’s temporary restraining order prohibiting the Village Board from conducting a Public Hearing with regard to a proposed moratorium scheduled for tonight, August 22, 2016 at 7:01 pm. The Bankruptcy Court denied the village’s request to hold the public hearing and take no further action until the Bankruptcy Court had opportunity to hear argument regarding the proposed local law. There is a court hearing scheduled for August 30, 2016 at 11:00 am regarding the restraining order of the Village’s Public Hearing for a Moratorium. Attorney Lynch advised the Village Board not to accept or hear public comment in regards to the local law. o Mayor Jeroloman stated that the regular village board meeting was now open for public comment. All general public comment will be heard and the board will not take public comment in regard to the proposed local law.  Public Comments o Vicky Codner – She thanked the board for the installation of the electronic speed sign, she believes it is helping but that cars going up the street continue to speed. She asked if it is legal for people to take pictures of her home.  Village of South Blooming Grove Board of Trustees Regular Meeting Monday August 22, 2016 7:00 P.M. o Donna McGoldrick – She inquired about the status of the newsletter and the status of the minutes. She advised the board that a resident was kind enough to provide her with their minutes of the meetings. o Peter Piampiano – Inquired about the two speed traffic cones, it appears that one is missing. The board advised that they have searched the neighborhood for the sign. The sign has not been seen and that it was reported stolen. He also advised that this past weekend a vehicle was obstructing the road on Dallas Drive wherein he had to swerve to avoid an accident. Additionally, he continues to see children playing and walking in the road causing hazardous conditions. He inquired about the decibel meter and the mayor advised it was provided to the police department. Police Chief Schupp discussed how is department responds to noise control situations and use of the decibel meter. o Luis Romero – Advised that vehicles continue to make U-turns in Midland Court. The Mayor advised that Dead End Signs will be installed. o Gloria Guilamo – She wanted to thank the board for following up on her incident reports. She advised that there are garbage bags on the lawn of 8 Virginia Avenue and the residents failed to place them into the appropriate garbage containers. o Richard Gelardi – inquired about the code regarding fencing regulations, such as height and type of fencing to be utilized. She feels the Village should do more and the Mayor explained that a government cannot infringe on certain property rights. o Debbie Bragado – She wanted to thank the board for their help alleviating the dangerous conditions created by free standing refrigerators at 9 Dallas Drive. She advised that there is still work to be done at that property location as “it is still a mess”. A home on Green Road has had a dishwasher in shrink wrap on their driveway for months. o John Salka – announced that he feels most complaints are regarding enforcement issues. How do we effectively enforce village code? Deputy Mayor Hickey agreed that we are in need for enforcement. Also suggested we obtain traffic cameras that can issue summons/tickets. The Mayor advised that in order to obtain that type of enforcement device, the Village must first show that they have exhausted every effort available to deter speeding. o John Daley – If we were to enforce violations with fines how would this be established. o Steve Kearins – Inquired about the bankruptcy proceedings and how long they would hold the village back from proceeding with village matters, i.e. the cancelled public hearing regarding the moratorium. Attorney Lynch advised that the village would continue looking at the issues and he believes that Keen Equities has no vested right. o Kathy Aldinger –Inquired about the extra garbage cans in the neighborhood and how that affects our taxes.  Village of South Blooming Grove Board of Trustees Regular Meeting Monday August 22, 2016 7:00 P.M. o Arline Rodstrom – Asked about the rules for garbage bulk pick-up and that she witnessed the garbage company pick up construction material. The board advised that there is an information packet regarding garbage available on the Town of Blooming Grove website in addition to the flyer being mailed to all residents. o Supervisor Fromaget advised the board that the town has been in contact with the garbage company. The town advised the garbage company to uphold the rules especially regarding bulk pick-up, the number of garbage cans allotted and not to pick up items that are not to be picked up. Moving forward, the garbage company will only allow one garbage container and one recycling container. If a homeowner seeks additional containers they will have to individually pay for added services. Additionally, Supervisor Fromaget advised that the town is moving forward with bids for the renewal of the garbage contract. o Gerald Fiber – asked if the proposed moratorium would affect all future permits. Attorney Lynch read the proposed law and exemptions from moratorium. o Michele Santiago – is concerned with the recent increase in traffic. Vehicles are speeding, new school bus routes where the driving was going the wrong way in the traffic circle, vehicles are coming late at night around the traffic circle, she is concerned for the resident’s safety. The Mayor advised he will obtain a traffic sign for the traffic circle. o Albert Rosa – feels that the speed limit should be lowered to 20-25 mph on village streets. o Donna McGoldrick – she advised the village board and Chief Schupp that she witnesses many people driving through the neighborhood while talking on their cell phone. She feels this is very dangerous especially on the residential streets. She advised that it’s a “tragedy waiting to happen.” o Additionally, resident McGoldrick and Bragado further discussed with the board matters concerning garbage cans.  Correspondence o Troop 317 Bronze Award Project seeking to place a “Little Library”. The board will invite the Troop to their next Village Hall Meeting to discuss further.  Business o Resolution No. ( ) – Setting a date and hours of the Village’s September 11, 2016 Candlelight Vigil for September 11, 2016 at 7pm. Resolution passed. 5 Ayes – Mayor Jeroloman, Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco. o Resolution No. ( ) – Authorizing the Mayor to execute a stipulation settling litigation with the Town of Blooming Grove. Resolution passed. 5 Ayes – Mayor Jeroloman, Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco. o Resolution No. ( ) – Adding an additional work session to the Village Board Calendar for October 17, 2016. Motion to accept by Trustee LoFranco, seconded by Deputy Mayor Hickey. Motion to accept by Trustee Sas, seconded by Trustee LoFranco. Resolution passed. 5 Ayes – Mayor Jeroloman, Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco.  Trustee Comments o None  Abstract o Motion to accept the abstract by Deputy Mayor Hickey, seconded by Trustee Sas. 5 Ayes, Abstract Accepted.  Closed Session o Motion to enter into closed session by Deputy Mayor Hickey, seconded by Trustee Mullany to discuss pending litigation issues at 9:10 pm. 5 Ayes. o Motion to exit closed session by Trustee Sas, seconded by Deputy Mayor Hickey at 10:08 pm. 5 Ayes.  Adjournment o Motion to close the meeting by Trustee Sas, seconded by Deputy Mayor Hickey at 10:28pm 5 Ayes.
