PUBLIC HEARING
CHAPTER 150 OF THE VILLAGE CODE
SOLID WASTE
Call to order
o Deputy Mayor Weiss opened the public hearing at 8:00 PM on July 22, 2024, seconded by the
Trustee Feldman, 4 ayes regarding Chapter 150 – Solid Waste.
Discussion
o Al Fusco discussed Chapter 150 – Solid Waste and setting fees for solid waste (garbage).
Public Comment
o Chris Maderia asked who sets the fees, Al Fusco advised the Village Board. Mr. Maderia stated
right now the Town Board is in power to set the fees, Mr. Fusco advised now the Village Board will
be. Mr. Maderia advised we are in a townwide waste district and that is why he is confused. He
advised that he hasn’t been able see this proposed change, it wasn’t posted it is the first time he has
heard of it. He hasn’t seen or been able to read it because it wasn’t disseminated to the public.
Trustee Feldman and Attorney Ugell advised that we can leave the public hearing open for further
comment.
o Bonnie Rum stated that basically the village cannot create districts, that is what she has been told by
the County. Only cities, towns and counties. Al Fusco advised the village is a district in itself. You
have to find out if you actually can create a district. Al Fusco, the village by itself is a district. She
advised she has been told that the town takes care of the waste and you have that second thing that

has never really been finished or paid for and she doesn’t know if this is supposed to be a
continuation of that or what. They didn’t have access to what you are reading.
o Trustee Feldman advised that the public comment will be left open.
o Chris Maderia a couple of questions, we reside in a townwide waste district, one of his questions
probably mostly for Mr. Ugell would be considering the comptroller is still looking at that subject,
how can the board make any change without notifying the comptroller or getting the comptrollers
input, that would be one question that he has because he currently the comptroller is looking at the
original garbage contract between Marangi and the village, the second is we already belong to the
townwide waste district, for garbage purposes we do not live in a village we do not live in a town we
live in a townwide waste district in order for you to tax one of us you would have to tax everybody
in the district and 150 gives the village he believes its 6 months notice and don’t quote him, to go to
the town to remove itself from the district so the Village removes itself from the district and it wants
to create its own district so be it, but you can’t just create one district on top of another district for
the same purpose and he believes that is one of the issues the comptroller is looking at under the old
contract. This hearing should be left open and he believes the village should seek some guidance
from the comptroller’s office and he thinks the village should get an opinion on this considering
what is going on with the comptroller, the other issues we had, we are already in a townwide waste
district, you can’t tax me for the same purpose twice and that is another issue the comptroller is
looking at. The village doesn’t have the power for fees, only the town does. Attorney Ugell said
this is two separate things.
o Hewlitt violations should be discussed with the company picking up the trash as well.

Deputy Mayor Weiss opened the public hearing at 8:12 pm on July 22, 2024, seconded by Trustee
Feldman with regard to Chapter 70 – Building Code.

Discussion
o Al Fusco discussed that the village code is adopting 2020 NYS Fire Prevention Building Codes into
Chapter 70.
Public Comment
o Bonnie Rum is curious what the building code was but it’s just aligning the building code with the
state’s code. Al Fusco it is adopted by reference, look at Department of State online.

VILLAGE BOARD MEETING
Call to order
Deputy Mayor Weiss called to order the Village Board Meeting at 8:15 pm on July 22, 2024, for the
Village of South Blooming Grove located at 811 State Route 208, within the Village of South Blooming
Grove, and having a mailing address of Monroe, New York.
Adoption of Minutes: Trustee Rosner made a motion to adopt the July 8, 2024 meeting minutes, seconded
by Deputy Mayor Weiss. 3 Ayes, Deputy Mayor Weiss, Trustee Feldman, Trustee Rosner, 2 Absent – Mayor
Kalaj, Trustee Guttman.
Correspondence
o The Clerk offered the Orange County Resolution approved and adopted with regard to the expansion
of Harriman Wastewater Treatment Plant Sewer District #1.
Public Comment
o Bonnie Rum advised that 235 is on the agenda and asked what that was and if it could be explained.
o Chris Maderia saw that it is on the agenda under resolutions he asked what are the changes, what
are we looking at? 235 is a big code, what are we doing. Isaac Ekstein said he believes it was back
in December. Mr. Maderia advised if you are making a change to the code you have to show us
every change, you can’t, it has to be written out. Isaac Ekstein advised there was a public hearing
for this and the agenda is just to adopt it. There were a few public hearings back in January and
there was a lot of discussion on this already, it was sent to the county and discussed and this is just a

resolution to adopt it. He feels the board should table it to the next meeting and post it with the
resolution.
o Hewlitt back to the Fair Housing he is asking for the progress of it is the policy of the Village of
South Blooming Grove to implement programs to ensure equal opportunity and housing for all
citizens regardless of race, color, religion etc he was asking about the progress of the implementation
or the origination of that program for the fair housing. This was on the agenda back in June. Mr.
Ugell doesn’t believe that the board has created any since June. Isaac Ekstein advised that the
village has no housing at this time, we are not applying for it, it was saying that we agree with the
policy of Fair Housing. Mr. Hewlitt feels that when the village says it is going to implement it, he
feels that they are going to implement it. Mr. Ekstein agreed that if the village had any housing it
would. Mr. Fusco advise that it is equal opportunity meaning we have to allow all to participate in a
meeting, you should encourage minority and woman owned business with regard to the grants. Mr.
Hewlitt is looking to see what has been implemented. Should other signs be placed on stop signs,
such as flyers. They are in Yiddish, he saw it on Sears, Mr. Ekstein advised no.
Business
o Resolution No. (49) – Resolution of the Village Board of the Village of South Blooming Grove
authorizing the Mayor to execute agreements with Peak Power for Village. Motion to accept by
Trustee Rosner, seconded by Trustee Feldman. 3 Ayes, Deputy Mayor Weiss, Trustee Feldman,
Trustee Rosner. 2 Absent –Mayor Kalaj, Trustee Guttman.
o Resolution No. (50) Resolution of the Village Board of the Village of South Blooming Grove
Regarding Local Law #1 of 2024. Amended Article 11 Cross Connection of the Village Code.
Motion to accept by Deputy Mayor Weiss, seconded by Trustee Rosner. 3 Ayes, Deputy Mayor
Weiss, Trustee Feldman, Trustee Rosner. 2 Absent – Mayor Kalaj, Trustee Guttman.
o Resolution No. (51) - Resolution of the Village Board of the Village of South Blooming Grove
Regarding Local Law #2 of 2024 Code Enforcement. Motion to accept by Trustee Feldman,
seconded by Trustee Rosner. 3 Ayes, Deputy Mayor Weiss, Trustee Feldman., Trustee Rosner. 2
Absent – Mayor Kalaj, Trustee Guttman.
o Resolution No. (52) - Resolution of the Village Board of the Village of South Blooming Grove
authorizing the Mayor to enter into a contract with Cottage Carting Inc. (IWS) and the Town of
Blooming Grove. Motion to accept by Trustee Rosner, seconded by Trustee Feldman. 3 Ayes,
Deputy Mayor Weiss, Trustee Feldman., Trustee Rosner. 2 Absent – Mayor Kalaj, Trustee Guttman.
o Motion to table Resolution of the Village Board of the Village of South Blooming Grove Regarding
Local Law #__ 2024. Amending Chapter 235 of the Village Code. Motion to accept by Trustee
Rosner, seconded by Deputy Mayor Weiss. 3 Ayes, Deputy Mayor Weiss, Trustee Feldman, Trustee
Rosner. 2 Absent – Mayor Kalaj, Trustee Guttman.
