SOUTH ST. PAUL CITY COUNCIL MINUTES OF MAY 4, 2020 Mayor James Francis called the regular meeting of the City Council to order at 7:00 p.m. on Monday, May 4, 2020. Pursuant to Minn. Stat. 13D.021, under the current emergency declaration, some or all of the councilmembers may participate by remote locations using WebEx. ROLL CALL: Present: Mayor Francis Councilmembers Dewey, Flatley, Forester, Hansen, Kaliszewski and Seaberg Absent: None Also Present: City Administrator, Joel Hanson Attorney, Peter Mikhail City Clerk, Christy Wilcox City Planner, Michael Healy Engineer, Lee Elfering Economic Development Director, Ryan Garcia 5) Presentations • There were no presentations. 6) Citizens’ Comments • There were no citizens comments. 7) Agenda Moved by Seaberg/Flatley MOVED: To approve the agenda, as amended. Motion carried 7 ayes /0 nays 8) Consent Agenda Moved by Forester/Kaliszewski Resolved, that the South St. Paul City Council does hereby approve the following: A. City Council Meeting Minutes of April 20, 2020 B. Resolution No. 2020-57, approving accounts payable C. Renewal of the City’s Microsoft Enterprise Agreement City Council Minutes of May 4, 2020 1 D. Authorize the installation of Fiber Optic Cable on Grand Avenue E. Move the City Council meeting of July 6, 2020 to June 29, 2020 to minimize conflicts with the July 4th Holiday F. Business Licenses G. Resolution No. 2020-56, concurring with the issuance of a Lawful Gambling Premise Permit by the VFW Post #295 H. Reject the bids for Seidl’s Lake Lift Stations and 4th Street Reconstruction I. Approve Engineering Services Agreement with 3Dgeophysics for Geotechnical Investigation Services Motion carried 7 ayes/0 nays 10A) Declaration and Resolution Extending Local Emergency Moved by Seaberg/Hansen MOVED: To adopt Resolution No. 2020-60, Declaration and resolution extending Declaration of Local Emergency. Motion carried 7 ayes/0 nays 10B) Concord Improvement Project – Authorize Right of Way Acquisitions Moved by Seaberg/Forester MOVED: To adopt Resolution No. 2020-58, authorizing right of way acquisitions for 2016-11 Concord Street Improvement Project. Motion carried 7 ayes/0 nays 10C) 2nd Reading – Native Plant Landscaping Ordinance Moved by Kaliszewski/Dewey MOVED: To adopt Ordinance No. 1354, an ordinance amending Chapter 66, Article II to add definitions and performance standards for native plant landscape areas. Motion carried 7 ayes/0 nays City Council Minutes of May 4, 2020 2 10D) Agreement with WSB Relative to Kaposia Landing Phase 2 Moved by Hansen/Kaliszewski MOVED: To adopt Resolution No. 2020-59, approving agreement with WSB, Inc. for construction administration and staking, RAP administration, and material testing for Kaposia Landing Phase 2. Motion carried 7 ayes/0 nays 10E) First Reading – Amendment to Odor Ordinance Mayor Francis introduced the following proposed ordinance for its first reading: AN ORDINANCE AMENDING SOUTH ST. PAUL CITY CODE SECTION 38-104 REGARDING AUTHORITY TO ISSUE COMPLIANCE LETTERS AND ADMINISTRATIVE CITATIONS, SECTION 38-105(D) REGARDING COMPLIANCE LETTERS, SECTION 110-144 REGARDING DESIGNATION AS A SIGNIFICANT ODOR GENERATOR, SECTION 110-146 REGARDING ODOR MANAGEMENT PLAN, SECTION 110-148 REGARDING NON-COMPLIANCE AND SECTION 110-150 REGARDING PENALTIES 11) Adjournment Moved by Seaberg/Flatley MOVED: That the meeting of the City Council adjourn at 8:10 p.m. Motion carried 7 ayes /0 nays Approve: June 1, 2020 ___________________________ City Clerk City Council Minutes of May 4, 2020 3
