1. Mayor Jimmy Francis called the special meeting of the City Council to order at
7:00 PM on May 22, 2023.

Agreement
ACTIONS TO BE CONSIDERED:
Authorize the Mayor and City Clerk to execute a Development Agreement and Stormwater
Maintenance Agreement with Danner Family Limited Partnership, with both documents subject
to final review and minor revisions by the City Attorney.
OVERVIEW:
Background
Danner Inc. is a trucking and road construction contractor currently located at 843 Hardman
Avenue South. The Applicant is planning to relocate the business to a property that they own on
Verderosa Avenue, the subject property. The Applicant obtained a Preliminary Plat approval and
a Conditional Use Permit for a Planned Unit Development (CUP/PUD) approval on February 6,
2023 to develop the subject property. The final plat was approved on April 17, 2023.
City Staff and the City Attorney have prepared a development agreement and a stormwater
maintenance agreement that enshrine the Developer’s short-term and long-term obligations.
Marlon Danner, President of Danner Family Limited Partnership, has signed both agreements.
Danner Inc. has paid all required fees for finalizing the final plat, development agreement, and
stormwater maintenance agreement. In accordance with the development agreement, they will
pay their final fees at time of building permit.
STAFF RECOMMENDATION:
Staff recommends that the City Council approve and authorize execution of the agreements.
