Spearfish City Council Regular Session Minutes February 7, 2022 5:30 p.m. The Spearfish City Council met at 5:30 p.m. on Monday, February 7, 2022. Mayor Boke presided and called the meeting to order. Roll call was taken with the following members present: Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath. Absent: None. Also present: City Administrator McFarland, City Attorney McDonald, Human Resource Director Mathis, Finance Officer DeNeui, Parks and Recreation Director Ehnes, City Planner Watson, Public Safety Director Rotert, and Assistant Public Works Director McMahon. Klarenbeek moved, Jacobs seconded and all voted to approve the agenda. No potential conflicts of interest were noted. Public Comment – At 5:30 p.m. a time for public comment was opened. Comments were received from Aaron Thompson regarding a natural assets accounting software. No further comments were received and the time for public comment was closed at 5:35 p.m. Consent Agenda – Clark moved, Jacobs seconded and with Clark, Hodgs, Hourigan, Jacobs, Klarenbeek and Rath voting aye, motion passed to approve the consent agenda as follows: A. Approve the minutes of the City Council regular session dated January 18, 2022. B. Approve the minutes of the City Council special session dated January 21, 2022. C. Approve the minutes of the City Council special session dated January 28, 2022. D. Accept the Spearfish Community Pantry 2021 Annual Report. E. Hire Matthew Hess as a full-time (benefit-eligible) police officer, grade 17, step 1, $25.31 per hour, effective 2/28/2022. Replacement position. F. Hire Taylor Caiati as a full-time (benefit-eligible) fitness & aquatics coordinator, grade 16, step 1, $24.09 per hour, effective 2/8/2022. Replacement position. G. Hire Peyton Bodemann as a seasonal parks laborer, $15.50 per hour, effective 2/14/2022. H. Add Katie Knutson and Macy Sneesby to the 2022 library volunteer list. I. Add Krista Kerutis to the 2022 firefighter volunteer list. J. Add Alex Greger to the 2022 referee list and Karrin Rolfstad to the 2022 Recreation Center volunteer list. K. Set the bid opening for the Sky Ridge Maintenance Building for on or after April 4, 2022, at 1:30 p.m. in the City Council Chambers. L. Set bid openings for the 2022 Annual Pavement Maintenance Project, the 2022 Crack Sealing Project, the Sky Ridge Irrigation Well, and the 2022 Annual Pavement Markings Project for on or after March 8, 2022 in the City Council Chambers. Other Items Resolution 2019-07 – Clark moved, Hodgs seconded and all voted to rescind Resolution 2019-07 - A Resolution to Accept or Transfer Dedication and Responsibility for Maintenance of Certain Roads. License – A public hearing to consider an application from Melissa Barth with the Spearfish Area Chamber of Commerce for a special malt beverage and an on-sale wine license for Taste of Spearfish on April 25, 2022 from 5:00 p.m. to 8:00 p.m. at the Pavilion was opened at 5:37 p.m. No oral or written comments were received and the hearing was closed. Hodgs move, Rath seconded and all voted to approve the license. Hire – Klarenbeek moved, Hodgs seconded and with Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath voting aye, motion passed to hire Kyle Hinton as a full-time salaried-exempt (benefit- eligible) public works director, grade 26, step 1, $53.08 per hour (annual salary $110,406.40) effective 3/14/2022 with the following modification to vacation: Immediately upon commencement of employment, employee shall be granted forty (40) hours of paid vacation time. Thereafter, employee shall be granted 4.62 hours of paid vacation per pay period, to begin accruing immediately upon commencement of employment with employer. Upon completion of six full and continuous years of service, 6.15 hours of paid vacation per pay period shall accrue. Upon completion of 25 full and continuous years of service, 40 additional hours of vacation shall be granted, and 7.70 hours of paid vacation per pay period shall be accrued. Replacement position. Purchase – Clark moved, Jacobs seconded and with Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath voting aye, motion passed to purchase materials for the Jorgensen Park Pedestrian Bridge Repair Project at approximate cost of $5,695.40. Resolution 2022-02 – Jacobs moved, Klarenbeek seconded and all voted to re-approve Resolution 2022-02 as follows: RESOLUTION 2022-02 A RESOLUTION TO VACATE A SEWER EASEMENT WHEREAS, David Czerny, RR Sawyer Ventures LLC, owner of the herein referenced property has petitioned to request that the Common Council of the City of Spearfish vacate the following: A twenty foot wide sewer easement located on Lot 6A Block 23, Original Town to the City of Spearfish, Lawrence County, South Dakota as shown on recorded plat document number 95-3625 in the office of the Lawrence County Register of Deeds. NOW THEREFORE BE IT RESOLVED by the Common Council of the City of Spearfish, Lawrence County, South Dakota to hereby approve the request to vacate the sewer easement described herein. Agreement – Klarenbeek moved, Hourigan seconded and all voted to approve a Roof Overhang and Deck Easement Agreement at 711 N. Canyon Street. Agreement – Jacobs moved, Rath seconded and all voted to approve a Development Lot Agreement for Lots 7 and 8 of the Woodlands. Resolution 2022-03 – Jacobs moved, Hodgs seconded and all voted to approve Resolution 2022-03 as follows: RESOLUTION NO. 2022-03 A RESOLUTION OF ANNEXATION TO EXTEND THE BOUNDARIES OF THE CITY OF SPEARFISH, SOUTH DAKOTA, BY ANNEXING LANDS MORE SPECIFICALLY DESCRIBED HEREIN: WHEREAS, The City of Spearfish has conducted an analysis of the territory where a petition for voluntary annexation has been submitted, and has determined the resources necessary to serve the annexed territory; and, WHEREAS, the territory described herein adjoins and is contiguous to the existing boundaries of the City of Spearfish and is not separated from the existing City by any significant physical barriers, and annexation is natural and reasonable and the municipal body hereby created constitutes a homogenous and unified entity; and, WHEREAS, the City of Spearfish has held public hearings and considered all testimony regarding said annexation; and, WHEREAS, the City of Spearfish has fully complied with all statutory requirements of SDCL Chapter 9-4 required and precedent to this Resolution. Staff will continue to evaluate the possibility of moving the existing structure to a new location. Rath stated support for moving the existing structure or construction of a new facility for the community. Boke noted a new facility is not included in the current capital improvement plan but can be considered with the 2023 budget. Ehnes noted an estimated cost for a new structure/facility would be between $300,000 and $500,000.
