Spearfish City Council Regular Session Minutes November 7, 2022 5:30 p.m. The Spearfish City Council met at 5:30 p.m. on Monday, November 7, 2022. Mayor Senden presided and called the meeting to order. Roll call was taken with the following members present: Clark, Hodgs, Hourigan, Jacobs, Klarenbeek and Rath. Absent: none. Also present: City Administrator McFarland, City Attorney McDonald, Finance Officer DeNeui, Public Works Director Broyles, City Planner Kapsa, Parks and Recreation Director Ehnes, and Assistant Public Works Direct McMahon. All stood and recited the pledge of allegiance. Klarenbeek moved, Jacobs seconded and all voted to amend the agenda to reorder items under 11A to be item 3, 4, 1 and end with 2. Hourigan moved, Rath seconded and all voted to approve the agenda as amended. No potential conflicts of interest were noted. Public Comment – At 5:32 p.m. a time for public comment was opened. With comments regarding the Rocket Ship Park structure being received from residents Rodney Ross, Lynn Ensor, and Lou Bell. No further comments were received and the time for public comment was closed at 5:44 p.m. Consent Agenda – Clark moved, Rath seconded and with Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath voting aye, motion passed to approve the consent agenda as follows: A. Approve the minutes of the City Council regular session dated October 17, 2022. B. Approve the minutes of the City Council special session dated October 28, 2022. C. Approve the application from Matthews Opera House for a special malt beverage license for the Spearfish Festival in the Park on July 14, 2023, from 4:00 p.m. to 10:00 p.m., July 15, 2023, from 9:00 a.m. to 7:00 p.m., and July 16, 2023, from 10:00 a.m. to 4:00 p.m. at Spearfish City Park. D. Add Louis Antos and Zachary Wachsmuth to the volunteer firefighter list. Other Items Deed – Hodgs moved, Rath seconded and all voted to authorize the mayor to sign a Deed of Revocation for restrictive covenants affecting the properties by the City at Sky Ridge. Resolution 2022-31 – Rath moved, Jacobs seconded and all voted to approve Resolution 2022-31 as follows: RESOLUTION NO. 2022-31 A RESOLUTION APPROVING THE REVOCATION OF COVENANTS ON CERTAIN PROPERTY PURSUANT TO SDCL 11-5-6. WHEREAS, the owners of the properties generally located in the Sky Ridge development in Spearfish desire to revoke the restrictive covenants on their properties; and WHEREAS, these properties are legally described as: Lots 1-17 of Block 1, Lots 1-31 of Block 2, Lots 1 and 16-22 of Block 3, Lots 1 and 22 of Block 4, Lots 1 and 22 of Block 5, Lots 1 and 22 of Block 6 and Dedicated Street Right-of- Ways of Sky Ridge Subdivision, being a part of Tract V-1 of Sky Ridge Subdivision, which is a part of Tract V of Elkhorn Ridge Addition, City of Spearfish, Lawrence County, South Dakota, according to plat recorded as Document No. 2021-09417. Tract V-1 of Sky Ridge Subdivision, a part of Tract V of Elkhorn Ridge Addition, City of Spearfish, Lawrence County, South Dakota, according to plat recorded as Document No. 2020-04714, LESS and EXCEPT platted lots of Sky Ridge Subdivision. Tract V of Elkhorn Ridge Addition, City of Spearfish, in NW1/4 of Section 22, T6N, R3E, BHM, Lawrence County, South Dakota, according to plat recorded in Document No. 2013- 04050, LESS and EXCEPT Tract V-1 of Sky Ridge Subdivision and LESS and EXCEPT platted lots of Sky Ridge Subdivision. WHEREAS, the restrictive covenants in question were placed on the property in 2016 by Vieland, LLC; and WHEREAS, the restrictive covenants that the property owners seek to have removed regulate the uses and types of structures allowed on the property; and WHEREAS, now that these properties are no longer owned by Vieland, LLC, the development plans have changed; and WHEREAS, under SDCL 11-5-6 the City needs to approve the revocation of the restrictive covenants; and WHEREAS, City staff supports the requested revocation. NOW THEREFORE, BE IT RESOLVED, by the Common Council of the City of Spearfish, that the City hereby approves the Deed of Revocation removing the restrictive covenants which were filed on March 3, 2016, for the above described properties. Contract – Clark moved, Rath seconded and with Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath voting aye, motion passed to approve the contract with Ainsworth-Benning Construction for the construction of the Sky Ridge Sportsplex Phase 2 project in the amount of $716,826.92. Amended Proposal – Rath moved, Hourigan seconded and with Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath voting aye, motion passed to approve the amended proposal from the American Ramp Company for an additional $4,000 bringing the total skate park concept design to $13,000. Land Exchange – A public hearing was opened at 5:58 p.m. to consider Resolution 2022-33 – A Resolution Approving the Land Exchange Between the City of Spearfish and Robert D. Miller. Comments were received from 420 Meier Avenue owner Robert Miller and resident Cory Diede. No further comments were received and the hearing was closed. Clark moved, Hourigan seconded and all voted to approve Resolution 2022-33 as follows: RESOLUTION 2022-33 A RESOLUTION APPROVING THE LAND EXCHANGE BETWEEN THE CITY OF SPEARFISH AND ROBERT D. MILLER BE IT RESOLVED by the Common Council of the City of Spearfish that the 50-foot portion of Meier Avenue Right-of-Way shown in Exhibit A be exchanged from the City of Spearfish to Robert D, Miller and Lot 9A, Block 48 of Original Townsite, City of Spearfish, Lawrence County, South Dakota as shown in Exhibit A be exchanged from Robert D. Miller to the City of Spearfish at no cost to the City of Spearfish as illustrated and described by the map attached hereto as Exhibit A, is hereby EXCHANGED. Adopted this 7th day of November, 2022. Clark moved, Rath seconded and all voted to approve Resolution 2022-18 as follows: RESOLUTION 2022-18 A RESOLUTION TO VACATE MEIER AVENUE RIGHT-OF-WAY WHEREAS, Robert Miller, owner of the herein-referenced property has petitioned to request that the Common Council of the City of Spearfish vacate the following: Meier Avenue Right of Way abutting Lots 8 and 9 of Block 48 of Original Townsite, City of Spearfish, Lawrence County, South Dakota, as further described on Exhibit A. NOW THEREFORE BE IT RESOLVED by the Common Council of the City of Spearfish, Lawrence County, South Dakota to hereby approve the request to vacate the Meier Avenue right-of-way described herein. BE IT RESOLVED by the Common Council of the City of Spearfish, Lawrence County, South Dakota, as follows: 1. Section 31-12A-5.1, South Dakota Codified Laws, provides that where a petition for the organization of a county road district encompasses territory which is within the subdivision jurisdiction of a City that said petition must be submitted to the governing body of the City for approval. 2. The City of Spearfish has been presented with a Petition for Formation of a Road District stating that there is a need for road work in the territory described, and it has been determined that said territory lies within the subdivision jurisdiction of the City  of Spearfish. 3. That the Petition and Application for Incorporation of the Mathis Homeowner’s Road District so presented has been favorably considered and shall be and the same is hereby approved, subject to the following condition: if the territory of the road district is annexed by the City of Spearfish, the road district shall be dissolved according to state statute, unless the road district has bonded or other indebtedness outstanding. In that event, the City may elect to assume the outstanding indebtedness, if allowed by law, and the road district shall then be dissolved. If the City does not assume the debt, the road district shall be dissolved immediately upon the repayment of the indebtedness. 4. The creation of a road district does not regulate who of the traveling public may use the road within the Mathis Homeowner’s Road District.
