COMMITTEE
MINUTES March 29, 2016
The Legal, Finance and Public Safety Committee met in the Council Chambers of the Municipal
Services Centre at 4:15 PM on Tuesday, March 29, 2016 with the following committee members
present: Jacobs and Schmit. Geppert was absent. Also present were: City Administrator Neeb,
Finance Officer Dutton, City Attorney Davis, Police Chief Rotert, Fire Chief Heser, Police
Lieutenant Dean and Human Resource Director Friedel.
Items from Visitors – On Monday, Mayor Boke will proclaim April 21st as Northern Hills Area
CASA Day in Spearfish, April 5th as National Service Recognition Day in Spearfish and April
10-16, 2016 as Public-Safety Telecommunicator Week in Spearfish.
Ordinances and Resolutions
Ordinance 1236 – On Monday, there will be a Public Hearing to consider Second Reading
Ordinance 1236 - to rezone from Parks Recreation and Open Space to Development Review
District for lots 1, 2, and 3 of the Fairway Addition (Canyon Gate Village) and approve the
preliminary plat/final plan. Committee forwarded to Full Council with no recommendation.
Ordinance 1238 – Committee recommended approval to Full Council for Second Reading
Ordinance 1238 – Employee Policy Manual Revisions.
Ordinance 1239 – On Monday, there will be a Public Hearing to Consider Second Reading
Ordinance 1239 – Amend R2 and R3 text. Committee recommended approval to Full Council.
Ordinance 1240 – There will be a Public Hearing to Consider Second Reading Ordinance 1240
– Rezone Lot 18H-1 and 18J-2 Sandstone on Monday. This is the final step for the Ellingson
Land Trade. Committee recommended approval to Full Council.
Ordinance 1241 – There will be a Public Hearing to Consider Second Reading Ordinance 1241
– Rezone Lot 1, 2 and 3 of Block 1 and Block 2 False Bottom Addition on Monday. This is a
cleanup for the zoning map. Committee recommended approval to Full Council.
Human Resources
Step Increase – Committee recommended approval to Full Council, Consent Agenda to move
Eric Davis, City Attorney, to a grade 26, step 2, $45.40 per hour, effective April 24, 2016. Step
increase is due to successful completion of 6-month in training period.
Hire – Committee recommended approval to Full Council to hire B. Scott Deaver as the
Property Code Enforcement Officer (benefit-eligible), grade 14, step 6, $19.39 per hour,
effective April 18, 2016. This is a replacement position.
Finance Office
Insurance Proposal – Assistant Finance Officer DeNeui reviewed a proposal to increase the
City’s general liability, auto liability and law enforcement liability coverage from $1 million to
$2 million coverage per occurrence. Increase in cost will be $14,691.04 for full-year of
coverage. She stated SDPAA evaluated 17 other entities in the area and 8 of the 17 have the $1
million per occurrence coverage as we do and the other 9 have $2million or more. Our
insurance carrier recommends this increase and it is budgeted in 2016. Committee forwarded
without recommendation to Full Council.
Airport Reserve Fund – Committee recommended approval to Full Council to waive Reserve
requirement for Fund 606 – Airport until such time the sponsorship transfer to the City is
finalized. At that time, a fund balance transfer from Second Penny will be required.
Policy – Committee recommended approval to Full Council to approve the City Loan Policy.
Finance Officer Dutton stated this is a short term loan policy to assist residents with unforeseen
repairs/expenses in a cost-share.
License – Committee recommended approval to Full Council, Consent Agenda to approve a
special on-sale liquor license for the Zbar for a wedding on May 28, 2016 from 6 PM to 11 PM
at Elkhorn Ridge RV Resort.
Police Department
Kennel Contract – Committee recommended approval to Full Council to approve and authorize
Mayor Boke to sign Kennel Contract with Western Hills Humane Society.
City Attorney
Agreement – Committee recommended approval to Full Council to approve and authorize the
Mayor to sign “Easement and Water Service Agreement” between the City; Crow Peak Place,
LLC; and Crow Peak Pocket Neighborhood Association.
City Administration
FYI – There will be an Executive Session on Monday for Contractual Matters. Decision items
are expected.
HPWHC Parking Lot – Committee member Schmit and HPWHC Executive Director Ables
began a dialogue regarding whether the City would provide some matching assistance to the
Western Heritage Center for the paving of their parking lot. This is an unbudgeted item and
Ables stated they’ve talked about it for years. The project is in the pre-design stage and actual
numbers and plans are not available at this time – she will speak to the HPWHC Board soon.
City Administrator Neeb stated that the request would likely be similar to what we have done in
the past with DC Booth as well as the Opera House and may need to be presented during the
2017 budget sessions, depending on how the potential project develops.
SRAC Cost Recovery – Committee forwarded to Full Council without recommendation the
request for City Council to consider the Spearfish Recreation Center cost recovery policy. This
policy is to meet the City Council’s expectations of a cost recovery of 70% for the overall
community programs provided by the Rec Center.

• 8-29-2016 – 5PM – 8PM
• 8-31-2016 – Combined Committees at 4:15 Final Budget workshop follows at 5 PM
or as soon thereafter.
Raffle – Committee recommended approval to Full Council, Consent Agenda for a raffle.
Spearfish Cooperative Preschool plans to raffle a Woman’s Basket (beauty items etc…), Man’s
Basket (fishing items, tools), Night-Out Basket (dining gift certificates) and a Kids Fun Basket
(toys, games, books). Tickets are $2.00 each with ticket sales from April 5th to the drawing on
April 21st. Proceeds to benefit Spearfish Cooperative Preschool for education items and school
supplies.
Special Events – Committee recommended approval to Full Council, Consent Agenda to
approve the following Special Event Permits:
1) Front Porch Coalition’s Black Hills Area Suicide Awareness Walk/Run Saturday,
May 7, 2016 Rec Path from City Park to Winterville 8:00am to Noon.
2) Queen City VFW Post 5860’s 5k Fundraiser for Artemis House Sunday, May 1, 2016
Evans Park rec path south to Lions Park and back 9:00 AM to 1:00 PM.
3) Northern Hills CASA Spearfish Canyon 30th Annual Half Marathon & 5k Run/Walk

B. Doug Schmit - Request to provide a matching grant to the Western Heritage Center for
the paving of their parking lot. This is an unbudgeted item and would be a 50/50
matching capital fund grant from the city – up to $223,443.00. Funding would come
from 2nd penny.
C. Request City Council to consider the Spearfish Recreation Center cost recovery policy.
This policy is to meet the City Council’s expectations of a cost recovery of 70% for the
overall community programs provided by the Rec Center.
