City of Spearfish Legal, Finance, and Public Safety Committee Minutes September 11, 2019 The Legal, Finance and Public Safety Committee met in the Council Chambers of the C i t y H a l l at 4:15 p.m. on Wednesday, September 11, 2019 with the following committee members present: Jacobs and Klarenbeek. Absent: Eisenbraun. Also present were: City Administrator Harmon, City Planner Watson, Parks and Recreation Director Ehnes, City Attorney McDonald, Human Resource Director Mathis, Public Safety Director Rotert, Fire Chief Deaver, Public Works Director Lee, Finance Officer DeNeui, Wastewater Treatment Facility Superintendent Evridge, Parks, Recreation and Forestry Superintendent McDonald, and Police Sergeant Hofmann. Finance Ordinance 1302 – Committee recommended to full council the second reading of Ordinance 1302 – 2020 Appropriations Ordinance. FYI – Mayor Boke will proclaim September 17-23, 2019 as Constitution Week. Human Resources Promote – Committee recommended to full council the promotion of Curt Jacobs to Chief of Police, grade 24, step 13, $47.78 (salaried/exempt $99,382.40 annual salary), and effective 09/17/2019. Replacement position. Authorize and approve exception from current wage policy. Referee Volunteers – Committee recommended to full council to authorize Christian Sweeden, Derek Vela, and Remington Wientjes to be added to the Recreation Volunteer List – Referees for worker’s compensation purposes. Recreation Volunteers – Committee recommended to full council to authorize Zachary Carter and James Porter to be added to the Recreation Volunteer List for worker’s compensation purposes. Hire – Committee recommended to full council to hire Drew Couch as part-time (not benefit eligible) recreation assistant, grade 7, step 1, $12.82 per hour, effective 9/22/2019. Replacement position. Hire – Committee recommended to full council to hire Samuel Tollison as full-time (benefit eligible) facility maintenance technician, grade 10, step 1, $14.86 per hour, effective 9/22/2019. Replacement position. Hire – Committee recommended to full council to hire Patrick Butler as part-time (partial benefit eligible) facility maintenance technician, grade 10, step 1, $14.86 per hour, effective 9/17/2019. Replacement position. Parks and Recreation Emerald Ash Borer Action Plan – Parks and Recreation Director Ehnes presented the proposed Emerald Ash Borer Action Plan to the committee. The Park, Recreation and Forestry Advisory Board recommended the preemptive plan, the post detection plan option 4 which is a combination treatment and removal of infested trees plan, and to maintain the current cost share program with an annual limit. Committee concurred with the advisory board’s recommendation. Planning and Zoning Encroachment Agreement – Committee recommended to full council to approve an Encroachment Agreement for 1930-1940 North Avenue for vehicle parking. City Planner Watson noted there is no annual fee for the agreement but the applicant is requesting a waiver of the $100 application fee. Police Department Building Entry Agreement – Committee recommended to full council to approve the Building Entry Agreement with Qwest Corporation d/b/a CenturyLink QC for installation of 911 services related phone lines and equipment at City Hall. Public Works Snow Plowing – Committee recommended to full council to set snow plowing bid opening for September 23, 2019 at 1:30 p.m. Snow Hauling – Committee recommended to full council to set snow hauling proposal opening for September 23, 2019 at 1:30 p.m. Resolution 2019-17 – Committee forwarded with no recommendation Resolution 2019-17 – A Resolution to Accept Dedication and Responsibility for Maintenance of a Certain Road (0.793 miles of Christensen Drive). Public Works Director Lee received a proposal from Sacrison Paving for $108,579.70 to mill and overlay the roadway. Lee indicated the current surface has about 1/3 life remaining so he would suggest 2/3 of the proposed cost be requested from Lawrence County during negotiations. Public Comment – Public comment section was opened at 4:44 p.m. and closed with no comments. There being no further discussion before the committee, the meeting was adjourned at 4:45 p.m.
