City of Spearfish Legal, Finance, and Public Safety Committee Minutes December 2, 2020 The Legal, Finance and Public Safety Committee met at 4:15 p.m. via Zoom videoconference system on Wednesday, December 2, 2020 with the following committee members present: Jacobs and Klarenbeek. Absent: Eisenbraun. Also present were: City Administrator Harmon, City Attorney McDonald, Human Resource Director Mathis, City Planner Watson, Public Safety Director Rotert, Finance Officer DeNeui, and Fire Chief Ladson. Finance Fees – Committee recommended to full council, consent agenda, to authorize finance to make the fourth quarter budgeted administrative fees for personnel and information technology costs. Transfer – Committee recommended to full council, consent agenda, to transfer $184,000 from 293- Spearfish Creek Fund to 604-Sewer Fund for Jackson Blvd Project storm sewer improvement costs. Transfer – Committee recommended to full council, consent agenda, to transfer $10,000 from 202- Hospitality Tax Fund to 101-General Fund, budgeted for reimbursement of general fund staff time with community events. Transfer – Committee recommended to full council, consent agenda, to transfer $50,000 from 201- Second Penny Sales Tax Fund to 294-Fire Capital Fund, budgeted for future capital purchases for the fire department. Transfer – Committee recommended to full council, consent agenda, to transfer $590.84 from 305- TIF#5 Debt Service Fund to 101-General Fund, the residual balance of closed TIF fund. Abatement – Committee recommended to full council, consent agenda, to approve a property tax abatement for 2020 taxes payable in 2021 in the amount of $295 for a parcel sold to Lawrence County in July 2020. Abatement – Committee recommended to full council, consent agenda, to approve a property tax abatement for 2020 taxes payable in 2021 in the amount of $132,160 for three parcels sold to the City of Spearfish in April 2020, the Sky Ridge Development parcels. Abatement – Committee recommend to full council, consent agenda, to approve a property tax abatement for 2019 taxes payable in 2020 in the amount of $299.56 and 2020 taxes payable in 2021 in the amount of $327.94 for parcel eligible for exemption for disabled veteran. Ordinance 1338 – Committee recommended to full council to approve the first reading of Ordinance 1338 - An Ordinance Supplementing the 2020 Appropriations Ordinance No. 1302 of the Code of Ordinances, City of Spearfish, South Dakota. This ordinance will supplement the 2020 budget for a total of $5,195,091 in various funds. Agreement – Committee recommended to full council to approve the Managed IT Services Agreement with Northern Hills Technology to begin January 1, 2021. The agreement includes specific changes to security breach liability coverage limit of $5 million, 3-year term of the agreement and price increase of 4% for 2021. Council Member Klarenbeek questioned the ability to negotiate the 2021 rates. City staff will reach out to the vendor and provide an update during the council meeting. Human Resources Move – Committee recommended to full council, consent agenda, to move Daniel Van Holland to code enforcement/assistant city planner, grade 14, step 15, $24.89 per hour, effective 12/13/2020 (2021 grade/step scale). 2021 Scale – Committee recommended to full council to approve the 2021 Grade & Step Scale to be effective 12/13/2020 (paid out on 1/4/2021 with a 1.7% cost of living adjustment). Individual wages will be published in the first city council minutes of 2021. Proposal – Committee recommended to full council to accept Condrey & Associates proposal to review and update the city's compensation and classification system at a cost of $22,500. Planning & Zoning Agreement – Committee recommended to full council to approve a water service agreement for a property outside city limits at 1215 McGuigan Road. Ordinance 1337 – Committee recommended to full council to approve the first reading of Ordinance 1337 – An Ordinance Amending Appendix A – Zoning of the Revised Ordinances of the City of Spearfish by Zoning Certain Property, and a set public hearing for December 21, 2020 for the ordinance. This ordinance will change of zoning from AG to Rural Large Lot Single Family (RLS-1) on HMC Lot D of the Higgins Creek Addition. Public Safety Rates – Committee recommended to full council to approve firefighters Kody McCamly and Kelli Werner to be paid at the State AD-C rate of $19.52 for wildland assignments. Public Comment The public comment section was opened at 4:35 p.m. and closed with no comments. There being no further discussion before the committee, the meeting was adjourned at 4:36 p.m.
