MINUTES REGULAR MEETING OF THE Spearfish Planning Commission Tuesday, February 16, 2016 - 3:00 PM The Spearfish Planning Commission met in regular session on Tuesday, February 16, 2016 at 3:00 p.m. in the council chambers of Spearfish City Hall. Members present: Toby Bordewyk, Dan Green, Ken Halsey (arrived during the course of the meeting); Greg Kruskamp, Bob Meyer and Larry Vavruska. Members Absent: None. Also present: City Planner Jayna Watson and City Attorney Eric Davis. Chairman Bordewyk called the meeting to order at 3:00 p.m. APPROVAL OF MINUTES Vavruska moved to approve the minutes of the Planning Commission meeting of February 2, 2016 as presented. The motion was seconded by Kruskamp and passed unanimously. DECLARATION OF CONFLICTS OF INTEREST: Bordewyk asked for any potential conflicts of interest to be identified. None were declared. 1. HOLD A PUBLIC HEARING AND MAKE RECOMMENDATION FOR A CHANGE OF ZONING FROM PARKS/RECREATION AND OPEN SPACE (PROS) TO DEVELOPMENT REVIEW DISTRICT (DRD), AND TO APPROVE A PRELIMINARYPLAT/FINAL PLAN. Applicant: Justin Feeser (authorized representative of the owner, Spearfish Canyon Country Club) Location: South end of Stone Gate Drive Green disclosed for the record that he is a resident of Fairway Addition living at 1412 Gateway Court. City Attorney Davis stated that merely living in the proximity to a rezoning request has never been identified as a conflict of interest; this is the same opinion he has provided to the city council on similar matters. Justin Feeser, the applicant, and authorized representative of the owner, Spearfish Canyon Country Club, appeared in person at today’s meeting. Pending the outcome of the rezoning request, Mr. Feeser hopes to purchase the property on which to construct three single family residential dwellings each on its own lot. Watson provided an overview of the information communicated in her staff report. This parcel is located in what is designated by the Comprehensive Plan as “contiguous city”. Staff finds the rezoning request and development of three parcels for single family dwellings consistent with the established development patterns in the area and recommends approval. Photocopies of public comments which were submitted in writing from three nearby property owners citing concerns with property valuation, traffic volumes and emergency vehicle access were distributed to the commission. Craig Cooper, a resident of 224 Stone Gate Drive, expressed concern with setting a precedence which might trigger development of several additional lots located south of the existing cul-de-sac at the end of Stone Gate Drive and the subsequent effect this might have on traffic in the area. Watson described the parameters the city considers when requiring secondary access. Rob Kortan, general manager of Spearfish Canyon Country Club, stated the country club currently has a plan in place that makes the property at the end of Stone Gate Drive unavailable for public development. Watson responded to several questions from Kruskamp concerning zoning of surrounding parcels, grading and fill requirements and storm water handling in the area. She also conveyed information pertaining to a development agreement that was signed in 1995 by Spearfish Canyon Country Club, the original developer, Page 1 of 2 2/26/2016 8:11 AM “Silverado”, and Bruce and Lola Miller which is binding to the current property owners in the Canyon Gate development. Hearing no further comments from the audience, Chairman Bordewyk closed the public hearing at approximately 3:22 p.m. Motion was made by Meyer and seconded by Vavruska to recommend approval of the request for change of zoning from Parks/Recreation and Open Space (PROS) to Development Review District (DRD), and to approve a preliminary plat/final plan for Lots 1 through 3 of Tract A of Lot 1 of Fairway Addition. Upon vote taken thereon, the motion carried unanimously. Watson stated city council will most likely set the public hearing for March 7. 2. DISCUSSION AND INPUT REGARDING FLEXIBLE USE ZONING DISTRICT. Watson stated that staff continues to meet regularly to discuss and criteria for various categories of development and to identify compatibility requirements attempting to deliver a Flexible Use Zoning District ordinance for consideration. Watson presented a detailed overview of a preliminary outline of such an ordinance. [Halsey entered the meeting at this time, approximately 3:30 p.m.]. Staff supports compiling a “Community Design Guidelines” manual which will be among the tools used to evaluate compatibility. There was a considerable amount of discussion on the matter and no action was necessary at this time. The first draft of the ordinance might be available for review at the next meeting. 3. CITY COUNCIL UPDATE There was nothing to report at this meeting. 4. OTHER Bordewyk noted seeing progress with the construction of new homes in the pocket community (Crow Peak Place) located on Canyon Street. He is of the opinion that alley access to the driveways at individual homes will be best suited for smaller vehicles. Watson extended an invitation to all present to attend an open house scheduled for Monday, February 22, 2016 at 5 p.m. at which time the 2015 Annual Departmental Operations Report will be presented. 4.
