REGULAR MEETING OF THE
Spearfish Planning Commission
Tuesday, March 15, 2016 - 3:00 PM
The Spearfish Planning Commission met in regular session on Tuesday, March 15, 2016 at 3:00 p.m. in the council
chambers at Spearfish City Hall. Members present: Toby Bordewyk, Dan Green, Ken Halsey, Greg Kruskamp, Bob
Meyer and Larry Vavruska. Members Absent: None. Also present: City Planner Jayna Watson and City Attorney
Eric Davis.
Chairman Bordewyk called the meeting to order at 3:01 p.m.
APPROVAL OF MINUTES
Kruskamp moved to approve the minutes of the Planning Commission meeting of March 1, 2016 as
presented. The motion was seconded by Vavruska and passed unanimously.
DECLARATION OF CONFLICTS OF INTEREST:
Bordewyk asked for any potential conflicts of interest to be identified. None were declared.
1. REQUEST: HOLD A PUBLIC HEARING TO ADJUST THE BOUNDARY BETWEEN C-2
(HIGHWAY SERVICE COMMERCIAL) AND AG (AGRICULTURAL) ZONING.
APPLICANT: City of Spearfish
LOCATION: 3525 E. Colorado Boulevard
City Planner Jayna Watson explained that staff recently completed its review of a preliminary plat of Lots 1, 2,
and 3 of Block 1 and Block 2 of False Bottom Addition to the City of Spearfish. It was noted that the city’s zoning
map will need to be adjusted to match the boundary between the C-2 and AG zoning districts as shown on the
plat.
Chairman Bordewyk opened the public hearing at approximately 3:04 p.m. Hearing no comments from the
audience and no objections from the Planning Commission, Bordewyk closed the public hearing at 3:04 p.m.
Vavruska moved, Kruskamp seconded and motion passed unanimously to recommend approval of the
request by the City of Spearfish to adjust the boundary between C-2 and AG zoning on property located
at 3625 E. Colorado Boulevard.
2. REQUEST: HOLD A PUBLIC HEARING FOR A CHANGE OF ZONING FOR TWO PARCELS:
1) CITY OWNED LOT 18H-1, BLOCK 14, SANDSTONE ADDITION FROM PUD TO
PARKS/REC AND OPEN SPACE (PROS).
2) ELLINGSEN LOT 18J-2, BLOCK 14, SANDSTONE ADDITION FROM
PARKS/REC AND OPEN SPACE (PROS) AND PUD TO R1 (SINGLE-FAMILY
RESIDENTIAL).
APPLICANT: John Ellingsen and City of Spearfish
LOCATION: Sandstone Addition
Watson briefly summarized the information conveyed in the staff report. A land trade agreement between John
Ellingsen and the City of Spearfish executed in December 2015 limits Mr. Ellingsen to the construction of one
single family dwelling unit on this parcel. This will be the only R1 zoned parcel in Sandstone Addition as
opposed to being zoned DRD. [City Attorney Eric Davis entered the meeting at this time].
Chairman Bordewyk opened the public hearing at approximately 3:07 p.m. Hearing no comments from the
audience and no objections from the Planning Commission, Bordewyk closed the public hearing at 3:08 p.m.

Motion was made by Halsey and seconded by Green to recommend approval of the request for a change
of zoning from Parks/Recreation and Open Space (PROS) to R1 (Single-Family Residential) for the
following two parcels: 1) a city owned lot legally described as Lot 18H-1, Block 14, Sandstone Addition;
and, 2) a lot owned by John Ellingsen, legally described as Lot 18J-2, Block 14, Sandstone Addition.
Upon vote taken thereon, the motion carried unanimously.
3. REQUEST: HOLD A PUBLIC HEARING DATE TO MAKE A MINOR AMENDMENT TO THE R-2
(ONE- AND TWO- FAMILY RESIDENTIAL) AND R-3 (MULTI-FAMILY
RESIDENTIAL) ZONING DISTRICT TEXT.
APPLICANT: City of Spearfish
LOCATION: City-wide
Watson explained that staff recently identified minor amendments in the R-2 and R-3 zoning district texts to
remedy minor omissions and corrections identified since its codification. She referred to specific details which
were described in the staff report. Halsey asked Watson for clarification on the authority that regulates elevators
in a multi-family facility. Watson noted that elevators are regulated as required by the building code.
Chairman Bordewyk opened the public hearing at approximately 3:11 p.m. Hearing no comments from the
audience and no objections from the Planning Commission, Bordewyk closed the public hearing at 3:12 p.m.
Vavruska moved, Halsey seconded and motion passed unanimously to recommend approval of minor
text amendments to the R-2 (one- and two- family residential) and R-3 (multi-family residential) zoning
ordinances to correct the following: 1) The minimum lot size for the R2 district is missing in the current
text; 2) Correct confusing language concerning building height in the R3 text; 3) Correct a typographic
error concerning off street parking in R3 text; and 4) Insert the effective date of the 2014 R3 update (7
July 2014) concerning the maximum density for lots less than 8,000 square feet.
4. REQUEST: DRD FINAL PLAN APPROVAL.
APPLICANT: Diversified Construction Services, LLC (Brad LaLonde)
LOCATION: Lot 2A-R, Block 14, The Reserve on Higgins Creek
ACTION: Make recommendation to City Council.
The applicant, Brad LaLonde, owner of Diversified Construction Services, LLC, appearing in person, presented a
request to expand services associated with his construction business by providing granite countertop fabrication
on site. LaLonde proposes to build a pole construction style of building to the north of the existing office building.
Watson further described many aspects of the proposal including exterior design and building features that might
“soften” the view from the west. Staff is requesting the landscape plan be revised to include live vegetation
instead of gravel at the base of the building. Other ordinance requirements to be addressed include an additional
three (3) parking spaces shall be provided where the existing customer parking is located; an ADA accessible
route shall be provided from the new parking spaces (or from within the building) to the granite shop, and 3) the
re-platting of this property to be combined with the lot where the existing buildings are located.
Meyer pointed out what he describes as a potential flaw in the current DRD zoning ordinance text. Using this
request as an example, he is of the opinion that this type of commercial expansion project fits under the category
of “building material sales”, a prohibited use in DRD zoning. However, Watson’s interpretation of the proposed
request finds the “light manufacturing” category most suitable. City Attorney Davis stated that there are aspects
of the zoning code that are up to interpretation and this is a perfect example of that, however, he does concur with
Watson’s interpretation of the proposed use.
Chairman Bordewyk opened the public hearing at approximately 3:28 p.m. Hearing no comments from the
audience and no objections from the Planning Commission, Bordewyk closed the public hearing at 3:28 p.m.
Meyer moved Green seconded and motion passed unanimously to recommend approval of the final plan
(site plan, building elevations and landscape plan) for construction of a granite countertop fabrication
shop on Lot 2A-R of Block 14 of Tract A of Higgins Creek Addition (The Reserve), as proposed by Brad
LaLonde, Diversified Construction Services, LLC.

5. OTHER:
City Council Update
Watson informed that commission that the city council voted to table the DRD text amendment last week. There
was a considerable amount of testimony during the public hearing. Watson will notify the commission of further
action on the matter.
Bordewyk informed the audience that the recommendations of the Planning Commission today will be heard at
the city council meeting on Monday, 21, 2016.
There being no further business, meeting adjourned at 3:30 p.m.
