REGULAR MEETING OF THE
Spearfish Planning Commission
Tuesday, May 3, 2016 - 3:00 PM
The Spearfish Planning Commission met in regular session on Tuesday, May 3, 2016 at 3:00 p.m. in the council
chambers at Spearfish City Hall. Members present: Toby Bordewyk, Dan Green, Ken Halsey, Greg Kruskamp, Bob
Meyer and Larry Vavruska. Members Absent: None. Also present: City Planner Jayna Watson and City Attorney
Eric Davis.
Chairman Bordewyk called the meeting to order at 3:00 p.m.
APPROVAL OF MINUTES
Vavruska moved to approve the minutes of the Planning Commission meeting of Tuesday, April 19, 2016 as
presented. The motion was seconded by Halsey and passed unanimously.
DECLARATION OF CONFLICTS OF INTEREST:
Bordewyk asked for any potential conflicts of interest to be identified. None were declared.
1. REQUEST: REQUEST FOR A DRD FINAL PLAN APPROVAL FOR A MULTI-FAMILY
PROPERTY LOCATED AT THE RESERVE.
APPLICANT: Dakota Custom Homes
LOCATION: Tract A, The Reserve at Higgins Creek
ACTION: Make recommendation to City Council.
Kevin Dailey, representing the applicant, Dakota Custom Homes, was present in the audience, however,
deferred to City Planner Jayna Watson who presented an overview of the proposal to building an 8-unit
apartment building in the un-platted portion of Tract A of The Reserve. Final plan approval will enable the
construction of a fourth phase of multi-family residential housing in an area of The Reserve approved for this type
of housing. Access to the property will be provided via a private, paved driveway and local homeowners will be
responsible for the property maintenance. Halsey moved to recommend approval of the final plan (site plan,
building elevations and landscape plan) for a multi-family housing complex as proposed by Dakota
Custom Homes on Development Review District (DRD) zoned property located in Tract A of The Reserve
at Higgins Creek with the following stipulations:
1. Applicant shall provide an ADA accessible route between parking spaces and the front of the
building (currently not depicted on site plan);
2. Handicapped parking space must have a striped access aisle.
3. Due to concerns regarding the Ash Borer pest, the applicant is advised to plant something other
than ash trees.
The motion was seconded by Vavruska and carried unanimously.
2. REQUEST: REQUEST FOR A CHANGE OF ZONING FROM AGRICULTURE (AG) TO
HIGHWAY SERVICE COMMERCIAL (C-2) AND SET A PUBLIC HEARING FOR
MAY 10, 2016.
APPLICANT: Don Lamb, Rocky Road Rentals
LOCATION: 1555 Maitland Road
ACTION: Set a public hearing for May 10, 2016.
City Planner Jayna Watson informed the commission that this particular site has been home to a local
commercial painting business for a number of years and has been noncompliant since the annexation of the
Voorhees addition in the 1990’s. There are a variety of land uses present in the area and the location has more
of a commercial feel than residential. The applicant, Don Lamb, has added a second building to the property and
wishes to lease space in that building to other commercial tenants. Adjacent property owners were notified of the
request. Watson was contacted by one individual who expressed concern about the long term maintenance of
Maitland Road but offered no comments on the land use. Paving of Maitland Road is on the city’s long range
plan but the timeframe for completion keeps getting pushed back.
Meyer expressed concern with C-2 zoning and other options were discussed. Responding to a question by
Halsey, Watson confirmed this property is currently on city water/sewer services. Kruskamp asked for
clarification on the party initiating the request, as there is a discrepancy on the agenda versus the staff report.
Vavuska moved to set a public hearing for Tuesday, May 10, 2016 to consider a request for a change of
zoning from Agriculture (AG) to Highway Service Commercial (C-2) for property legally described as
Tract A in the Voorhees Addition, and located at 1555 Maitland Road as requested by the applicant, Don
Lamb, Rocky Road Rentals. The motion was seconded by Halsey and carried unanimously.
3. REQUEST: REQUEST FOR A DRD CONCEPT/FINAL PLAN REVISION FOR PHASES
4-7 AND SET A PUBLIC HEARING FOR MAY 10, 2016.
APPLICANT: Ward Development
LOCATION: Tract A, The Reserve at Higgins Creek
ACTION: Set a public hearing for May 10, 2016.
The applicant, Jason Ward of Ward Development, came before the commission at this time and briefly explained
the proposed DRD final plan revisions.
Watson provided additional details about street widths, lot sizes, and setbacks. If approved, the amendment
aims at providing the same number of lots as was approved in the 2008 plan but with a shift in development
philosophy that results in larger lots versus smaller lots surrounded by common open space. Watson also stated
the proposed final plan revision was recently shared with the Parks Recreation and Forestry Advisory Board.
The Board agreed the real emphasis at this point will be on the trails and requested the following
recommendations be noted for the record:
1) Pocket parks shown on the plan should be privately maintained (connecting southeast of Shoshone to
Street D and at the east end of Reserve Street). Note that after the Board’s meeting, Ward Development
revised the plan to remove the pocket park at the southeast end of Shoshone.
2) There will be a trail connecting east to the Higgins Gulch drainage in the vicinity of the intersection of
Beartooth Loop and Street B, and a trail connecting Shoshone Ave to the Pheasant Lane trail. Note that
after the Board’s meeting, Ward Development revised the plan to show these connections.
3) The Parks Recreation and Forestry Advisory Board will continue to work with Ward Development to make
key decisions concerning trails planning.
Discussion concluded by Vavruska encouraging staff to consider the ongoing maintenance costs associated with
added more acres to parks and open spaces, nature trails and paved paths. Green moved to set a public
hearing for Tuesday, May 10, 2016 to consider a request by applicant Jason Ward, Ward Development,
for a DRD Concept/Final Plan Revision for Phases 4 – 7 at The Reserve on Higgins Creek. The motion
was seconded by Vavruska and carried unanimously.
City Council Update
Watson reported that outgoing council members were recognized for their years of service and incoming council
members were seated at the meeting last evening.
The City Council decided to place ordinance 1235, an amendment to the city’s Development Review District
(DRD) zoning district text on the ballot for the general election on November 8, 2016. City Attorney Eric Davis
noted that the Finance Officer determined the estimated cost associated with a special election is approximately
$4,000.
Watson reported the council has directed staff to be judicious when it comes to decisions regarding acquisition of
new city owned vehicles specifically encouraging smaller, all-wheel drive vehicles.
