REGULAR MEETING OF THE
Spearfish Planning Commission
TUESDAY, NOVEMBER 15, 2016 - 3:00 PM
The Spearfish Planning Commission met in regular session on Tuesday, November 15, 2016 at 3:00 p.m. in the
council chambers of Spearfish City Hall. Members present: Dan Green, Ken Halsey, Greg Kruskamp, Bob Meyer
and Barbara Zwetzig. Members absent: Toby Bordewyk and Larry Vavruska. Also present: City Planner Jayna
Watson and City Attorney Eric Davis.
Vice Chairman Kruskamp called the meeting to order at 3:00 p.m. Kruskamp reminded all in attendance to speak
into the microphone when making public comment so an accurate transcription of the minutes can be
accomplished.
APPROVAL OF MINUTES:
Meyer moved to approve the minutes of the Planning Commission meeting of October 18, 2016 as
presented. The motion was seconded by Halsey and passed unanimously.
DECLARATION OF CONFLICTS OF INTEREST:
Kruskamp asked for any potential conflicts of interest to be identified. None were declared.
1. INITIATE AN AMENDMENT TO THE DEVELOPMENT REVIEW DISTRICT (DRD) ZONING ORDINANCE
TEXT REGARDING CONCEPT PLANS.

City Planner Jayna Watson reminded the commission of recent discussions regarding implementation of a
“Flexible Use District” zoning ordinance to replace the existing Development Review District (DRD) zoning
text. Although work on the proposed Flexible Use District ordinance will resume soon, during two recent
cases involving requests for a change in zoning, legitimate questions of parcel to parcel compatibility were
being raised yet city ordinance did not require the applicant to address those issues at the time of rezoning.
Staff feels this issue should be addressed now because the timeframe to finalize and approve the Flexible
Use District ordinance text is uncertain.
Watson referred the commission to the staff report which identified key process changes being proposed and
the related effect on existing DRD-zoned properties. She also reviewed and described in detail a number of
submittals required at the time of rezoning to DRD, all of which would be incorporated into a development
agreement to ensure enforcement.
Meyer is of the opinion there are additional changes to the DRD ordinance text that should be considered. He
recalled discussions from earlier this year regarding the need to create a “laundry list” to include the various
types of outdoor storage allowed and further stipulating “that outside storage is not allowed unless specifically
described and approved in a development agreement”. Meyer shared insight on the concepts of compatibility
and described some of the processes heard at the recent SD Planners Association Conference in Sioux Falls.

Halsey noted that future applicants will be burdened with additional architectural and engineering expenses
associated with completing of some of the submittal documents staff is proposing at the time of rezoning to
DRD.
Zwetzig spoke in support of the additional level of detail the proposed revisions would expect.
Motion was made by Meyer and seconded by Green to recommend staff initiate revisions to the DRD
zoning ordinance text. If the City Council concurs with this recommendation, the Planning Commission will
have the opportunity to review the proposed revisions prior to the City Council. Upon vote taken thereon,
the motion carried unanimously.
2. CITY COUNCIL UPDATE:
Watson briefly described a new “General Administrative Report” prepared by the city administrator with
contributions by all departments and distributed weekly via email to the Mayor and City Council in an effort to
provide information on issues and matters affecting the City and report the progress of City activities.
Watson briefly talked about the recent adoption of Resolution 2016-30 – Miscellaneous Fees which in part
includes rate increases at the Restricted Use Site (RUS).
The City Council is also considering an Ordinance 1245 pertaining to alcohol in public places.
The public hearing and Second Reading of Ordinance #1256 – a change in zoning from Agriculture (AG) to
DRD for Top Shelf Addition (McGuigan Ranch 4) is scheduled for Monday, November 21, 2016.
3. ADJOURNMENT:
There being no further business to come before the commission, Kruskamp adjourned the meeting at 3:38
p.m.
