MINUTES REGULAR MEETING OF THE Spearfish Planning Commission TUESDAY, DECEMBER 6, 2016 - 3:00 PM The Spearfish Planning Commission met in regular session on Tuesday, December 6, 2016 at 3:00 p.m. in the council chambers of Spearfish City Hall. Members present: Dan Green, Ken Halsey, Greg Kruskamp, Bob Meyer, Larry Vavruska and Barbara Zwetzig. Members absent: Toby Bordewyk. Also present: City Planner Jayna Watson and City Attorney Eric Davis. Vice Chairman Kruskamp called the meeting to order at 3:00 p.m. APPROVAL OF MINUTES: Meyer moved to approve the minutes of the Planning Commission meeting of November 15, 2016 as presented. The motion was seconded by Vavruska. Halsey offered further explanation of comments he made at the last meeting pertaining to the proposed Development Review District (DRD) zoning ordinance text amendment. Hearing no further discussion, upon vote being taken thereon, the motion passed unanimously. DECLARATION OF CONFLICTS OF INTEREST: Kruskamp asked for any potential conflicts of interest to be identified. None were declared. 1. SET A PUBLIC HEARING TO CONSIDER A CHANGE IN ZONING FROM AGRICULTURE (AG) TO SINGLE-FAMILY RESIDENTIAL (R-1) AND PRELIMINARY PLAT APPROVAL. Applicant: ETR, LLC (David and Spencer Rossi) Location: A portion of Tract C of the McGuigan Ranch Addition The applicants, David and Spencer Rossi representing ETR, LLC, appearing in person, were present to respond to questions if necessary. City Planner Jayna Watson summarized the information contained in the staff report. On November 21, 2016, the city council denied a rezoning request and concept plan approval for a multi-use DRD zoned project. The applicant has since redesigned the project which will be completed in phases beginning with the development of ninety (90) single family residential lots on this 45-acre parcel. The timing of rezoning for the other phase described as Block 7 is unknown and the agriculture zoning designation will remain at this time. The applicant is requesting a change in zoning from Agriculture (AG) to Single Family (R-1) and approval of a preliminary plat. Although staff review of the proposal remains underway, Watson recommended the public hearing be set for Tuesday, December 20, 2016 so the proper notifications can be accomplished. Responding to a question by Kruskamp, David Rossi stated discussions continue with Lawrence County officials to resolve various issues regarding access. Meyer initiated discussion regarding subdivision regulations pertaining to on- street parking. Brief discussion followed regarding the preliminary plat. Motion was made by Vavruska and seconded by Green to set a public hearing for Tuesday, December 20, 2016 to consider a request for a change in zoning from Agriculture (AG) to Single Family Residential (R-1) and approval of a preliminary plat. Upon vote taken thereon, the motion carried unanimously. 2. CITY COUNCIL UPDATE: At last night’s council meeting, representatives of the South Dakota Game, Fish & Parks Department presented information regarding a preliminary proposal to establish a new state park in Spearfish Canyon. The city council also voted to initiate an amendment to the DRD zoning ordinance text to clarify the review process and submittal requirements. 3.
