Spearfish Planning Commission Regular Meeting Minutes Tuesday, August 15, 2017 The Spearfish Planning Commission met in regular session on Tuesday, August 15, 2017 at 3:00 p.m. in the council chambers of Spearfish City Hall. Members present: Toby Bordewyk, Jim Hopewell, Greg Kruskamp, Bob Meyer, Drew Skjoldal, Larry Vavruska and Barbara Zwetzig. Members absent: Dan Green. Also present: City Planner Jayna Watson and City Attorney Eric Davis. The meeting was called to order by Chairman Bordewyk at 3:00 p.m. APPROVAL OF MINUTES: Kruskamp moved to approve the minutes of the Planning Commission meeting of Tuesday, August 1, 2017 as presented. The motion was seconded by Vavruska and passed unanimously. DECLARATION OF CONFLICTS OF INTEREST: Bordewyk asked for any potential conflicts of interest to be identified. None were declared. 1. Zoning Ordinance Text Amendment, Appendix A – Zoning, Article IV, Section 10 of the Revised Ordinances of the City of Spearfish, Development Review District (DRD). Applicant: City of Spearfish Location: All areas zoned DRD City Planner Jayna Watson provided an extensive overview of the most recent DRD zoning ordinance text revisions proposed during the planning commission workshop on August 1, 2017 and incorporated into ordinance form for review today. She also distributed a written summary of additional changes recommended for consideration by Bordewyk via email correspondence following his review of the meeting packet. Discussion ensued. Chairman Bordewyk opened the public hearing at 3:34 p.m. Joe Jorgensen offered public testimony followed by further discussion. Bordewyk closed the public hearing at 3:44 p.m. Meyer moved to recommend approval of the proposed changes to Article IV, Section 10 of the Revised Ordinances of the City of Spearfish, Appendix A – Zoning, DRD, as presented in the staff report and including the following changes recommended by Bordewyk:  Page five (5), Section E, Process Overview, item #2: Revise the last sentence of the paragraph to include “but the Final Plan will be evaluated on Concept Plan and Final Plan criteria”.  Page nine (9), item #2 Final Plan Approval Criteria: The following statement will become item (a): “Conformance with the Uses Permitted, Uses Prohibited and Minimum Requirements for Improvements and Design” [see B, C, and D on page three (3) of the staff report]”, changing index labels (b) through (e) accordingly.  On page nine (9), item #3.c will be revised to state “The notice in 4.b shall be provided by”. The motion was seconded by Hopewell and, upon vote taken thereon, passed unanimously. 2. Zoning Ordinance Text Amendment, Appendix A – Zoning, Article VI, Section 2 of the Revised Ordinances of the City of Spearfish, Variances Applicant: City of Spearfish Location: City-wide City Planner Jayna Watson presented an overview of the proposed zoning ordinance text revisions outlined in the staff report. Discussion ensued and additional changes were recommended. Chairman Bordewyk opened the public hearing at 4:19 p.m. There was no public testimony and Bordewyk closed the hearing at 4:20 p.m. Skjoldal moved to recommend approval of the proposed changes to Article VI, Section 2 of the Revised Ordinances of the City of Spearfish, Variances, as presented and to authorize staff to revise Subsection D, Evaluation Criteria, combining items 2.a and 2.b, and deleting 3.b [see pages four and five of the staff report]. The motion was seconded by Vavruska. Staff agreed to email the revised ordinance text to the planning commission for review prior to the city council. There being no further discussion, upon vote taken thereon, the motion passed unanimously. CITY COUNCIL UPDATE: Watson reported briefly on matters before the city council last night. ADJOURNMENT: There being no further business to come before the commission, Bordewyk adjourned the meeting at approximately 4:27 p.m.
