Minutes Tuesday, July 10, 2018
The Spearfish Planning Commission met in regular session on Tuesday, July 10, 2018 at 3:00 pm in the council
chambers at Spearfish City Hall. Members present: Dan Green, Jim Hopewell, Greg Kruskamp, Bob Meyer, Larry
Vavruska and Barbara Zwetzig. Absent: Toby Bordewyk and Drew Skjoldal. Also present: City Planner Jayna
Watson and Assistant City Planner Desirae Mayo.
Chairman Zwetzig called the meeting to order at 3:00 p.m.
APPROVAL OF MINUTES:
Meyer requested the minutes pertaining to agenda item three (3) on page two (2) be revised as follows: Watson
also acknowledged having received email correspondence from Meyer offering additional changes for
consideration identifying possible duplications or inconsistencies in primary uses permitted and CUP-eligible
uses in various zones. Vavruska moved to approve the minutes of the Planning Commission meeting of
Tuesday, June 19, 2018 with the correction noted by Meyer. The motion was seconded by Meyer and upon
vote taken thereon passed unanimously.
DECLARATION OF CONFLICTS OF INTEREST:
Zwetzig asked for any potential conflicts of interest to be identified. None were declared.
1. A request for a Conditional Use Permit to operate a child care center in an existing building located in a
One- & Two-Family Residential (R2) zoning district.
Applicant: St. Joseph’s Catholic Church
Location: Lots 11 & 12, Block 49, Ramsdell Addition

City Planner Jayna Watson explained the request from St. Joseph’s Catholic Church is to operate a pre-school
at this location. However, Article II, Definitions, of the Revised Ordinances for the City of Spearfish,
Appendix A – Zoning, cites the phrase “child care center” which includes this type of use. Watson referred
the commission to “The Findings” commencing on page nine (9) of the staff report and determined based on
the Conditional Use Permit evaluation criteria established by city ordinance. Each criteria item was presented
for consideration and discussion. There were no additional conditions imposed. Staff recommends approval.
Chairman Zwetzig opened the public hearing at 3:10 pm. No testimony was offered and Zwetzig closed the
public hearing at 3:10 pm.
Motion was made by Vavruska and seconded by Green to approve a Conditional Use Permit to operate
a child care center in an existing building located in a One- & Two-Family Residential (R2) zoning
district on property legally described as Lots 11 & 12, Block 49, Ramsdell Addition, located at 115 W
Lincoln as proposed by the applicant, St. Joseph’s Catholic Church, and to approve The Findings
presented in the staff report. Upon vote taken thereon, the motion passed unanimously.
2. Updates to The Revised Ordinances of the City of Spearfish, Appendix A – Zoning, Article V, Section
2.D, Lot and Access Conditions.
Applicant: City of Spearfish
Location: All residential zoning districts
City Planner Jayna Watson presented a brief overview of the proposed zoning ordinance text revisions
pertaining to lot and access conditions.
Chairman Zwetzig opened the public hearing at 3:21 pm. No testimony was offered and Zwetzig the public
hearing at 3:21 pm.
Motion was made by Vavruska and seconded by Meyer to recommend approval of the proposed
updates to The Revised Ordinances of the City of Spearfish, Appendix A – Zoning, Article V, Section
2.D, pertaining to Lot and Access Conditions as presented on page 4-5 of the staff report. Upon vote
taken thereon, the motion passed unanimously.
4. Change in Zoning from Agriculture (AG) to Highway Service Commercial (C2) and a Conditional Use
Permit to allow a Large Scale Contractor business.
Applicant: Tyrell Ehnes for Burly Builders, LLC
Location: Tract F Revised, Voorhees Addition
Voorhees Lane @ Maitland Road
City Planner Jayna Watson presented a brief overview of the information contained in the staff report. Motion
was made by Meyer to set a public hearing for Tuesday, July 24, 2018 to consider a change in zoning
from Agriculture (AG) to Highway Service Commercial (C2) and a Conditional Use Permit to allow a
Large Scale Contractor business on property legally described as Tract F Revised, Voorhees Addition,
as requested by the applicant, Tyrell Ehnes for Burly Builders, LLC. The motion was seconded by
Kruskamp and, upon vote taken thereon, the motion passed unanimously.
CITY COUNCIL UPDATE:
Watson reported briefly on matters discussed at the last council meeting in addition to ongoing projects within city
jurisdiction.
ADJOURNMENT:
There being no further business to come before the commission, Zwetzig adjourned the meeting at 3:34 pm.
