Minutes Tuesday, June 19, 2018
The Spearfish Planning Commission met in regular session on Tuesday, June 19, 2018 at 3:00 p.m. in the council
chambers at Spearfish City Hall. Members present: Toby Bordewyk, Dan Green, Jim Hopewell, Greg Kruskamp
Bob Meyer, Drew Skjoldal, Larry Vavruska and Barbara Zwetzig. Absent: None. Also present: City Planner
Jayna Watson and Assistant City Planner Desirae Mayo.
Chairman Zwetzig called the meeting to order at 3:00 p.m.
APPROVAL OF MINUTES:
Vavruska moved to approve the minutes of the Planning Commission meeting of Tuesday, June 5, 2018 as
presented. The motion was seconded by Skjoldal and upon vote taken thereon passed unanimously.
DECLARATION OF CONFLICTS OF INTEREST:
Zwetzig asked for any potential conflicts of interest to be identified. None were declared.
JULY MEETING DATE CHANGES:
Having heard several conflicts regarding attendance at the regularly scheduled Planning Commission meetings for
July, the meetings were changed to Tuesday, July 10 and Tuesday, July 24, 2018.
1. A request for a Conditional Use Permit to allow a second dwelling unit on property located in a Single
Family Residential (R1) zoning district.
Applicant: Arnold & Zana Hartman
Location: Lots 30 & 31, Block 6, Golden Belt Addition

City Planner Jayna Watson referred the commission to “The Findings” commencing on page ten (10) of the
staff report and determined based on the Conditional Use Permit evaluation criteria established by city
ordinance. Each criteria item was presented for consideration and discussion. Additional conditions were
recommended regarding parking, restricting the use to single-family and requiring the property owner to
remove all cooking appliances from the existing basement apartment. Staff recommends approval.
Chairman Zwetzig opened the public hearing at 3:23 pm.
Testimony was heard in opposition to the request from neighborhood residents Richard and Ellen Plocek, 705
Harding Street; Laura Lee Campbell, 704 E Grant Street; Wayne Alderman, 703 E Grant Street; Crystal
Kryza, 705 E Grant; and Chantelle Janke, 540 N 12th Street.
Extensive discussion commenced regarding uses allowed by right; neighborhood compatibility of the proposed
three (3) car garage; and the terms “single family” and “family” as defined in city ordinance.
Hearing no further comments, Zwetzig closed the public hearing at 4:00 pm.
Motion was made by Bordewyk and seconded by Green to approve a Conditional Use Permit to allow a
second dwelling unit on property located in a Single Family Residential (R1) zoning district on property
legally described as Lots 30 & 31, Block 6, Golden Belt Addition, located at 702 E Grant Street, and to
approve The Findings presented in the staff report and including certain conditions of approval noted in
item thirteen (13) as follows: a) A minimum of four (4) off-street parking spaces shall be required and
provided based on the proposed use and demand; and, b) Each dwelling on the property shall be limited
to single-family use and the existing basement apartment shall be remodeled to remove all cooking
appliances. Upon vote taken thereon, the motion passed unanimously.
2. A request for a Conditional Use Permit to operate a child care center in an existing building located in a
One- & Two-Family Residential (R2) zoning district.
Applicant: St. Joseph’s Catholic Church
Location: Lots 11 & 12, Block 49, Ramsdell Addition
115 W Lincoln
Motion by Kruskamp to set a public hearing for Tuesday, July 10, 2018 to consider a request for a
Conditional Use Permit to operate a child care center in the existing building located at 115 W Lincoln
in a One- & Two-Family Residential (R2) zoning district. The motion was seconded by Vavruska and
upon vote taken thereon, the motion passed unanimously.
3. Updates to The Revised Ordinances of the City of Spearfish, Appendix A – Zoning, Article II,
Definitions and Article IV, District Regulations, Sections 1b, 5, 6, 7, and 7a, pertaining to Permitted and
Conditional Use Permits in Agricultural (AG), Central Commercial (C-1), Central Core Commercial
(CC), Highway Service Commercial (C2) and Office Commercial (C-3) zoning districts.

Location: AG zoning district and all commercial zoning districts
City Planner Jayna Watson presented an overview of the most recent zoning ordinance text revisions
incorporated since the last meeting. Additional corrections were noted for inclusion. Watson also
acknowledged having received email correspondence from Meyer identifying possible duplications or
inconsistencies in primary uses permitted and CUP-eligible uses in various zones. Staff will review this
correspondence and proceed accordingly.
Chairman Zwetzig opened the public hearing at 4:21 pm. No testimony was offered and Zwetzig the public
hearing at 4:21 pm.
Motion by Vavruska to recommend approval of the proposed updates to The Revised Ordinances of the
City of Spearfish, Appendix A – Zoning, Article II, Definitions and Article IV, District Regulations,
Sections 1b, 5, 6, 7, and 7a, pertaining to Permitted and Conditional Use Permits in Agricultural (AG),
Central Commercial (C-1), Central Core Commercial (CC), Highway Service Commercial (C2) and
Office Commercial (C-3) zoning districts with the additional corrections noted by Watson today. The
motion was seconded by Meyer and upon vote taken thereon, the motion passed unanimously.
4. Updates to The Revised Ordinances of the City of Spearfish, Appendix A – Zoning, Article V.,
Supplementary Regulations, Section 2, Additional Area Requirements, repealing a portion of
Paragraph D, Lot and Access Conditions.
Applicant: City of Spearfish
Location: All residential zoning districts
Motion was made by Vavruska to set a public hearing for Tuesday, July 10, 2018 to consider a zoning
ordinance text amendment to The Revised Ordinances of the City of Spearfish, Appendix A – Zoning,
Article V., Supplementary Regulations, Section 2, Additional Area Requirements, repealing a portion of
paragraph D, Lot and Access Conditions. The motion was seconded by Bordewyk and upon vote taken
thereon, the motion passed unanimously.
CITY COUNCIL UPDATE:
Watson reported briefly on matters discussed at last night’s council meeting.
ADJOURNMENT:
There being no further business to come before the commission, Zwetzig adjourned the meeting at 4:34 p.m.
