Minutes Tuesday, August 21, 2018
The Spearfish Planning Commission met in regular session on Tuesday, August 21, 2018 at 3:00 pm in the council
chambers at Spearfish City Hall. Members present: Toby Bordewyk, Dan Green, Jim Hopewell, Greg Kruskamp,
Bob Meyer, Drew Skjoldal, Larry Vavruska and Barbara Zwetzig. Absent: None. Also present: City
Administrator Mike Harmon, City Planner Jayna Watson, and Assistant City Planner Desirae Mayo.
Chairman Zwetzig called the meeting to order at 3:00 p.m.
APPROVAL OF MINUTES:
Via email correspondence dated 08/06/18, Meyer requested the following corrections to his motion pertaining to
agenda item #1 from the Planning Commission meeting minutes from Tuesday, July 24, 2018: Motion was made
by Meyer and seconded by Vavruska to approve a Conditional Use Permit to allow a large scale contractor
business on the property and to approve The Findings presented in the staff report to be revised to include a
condition which will require the preservation of the natural, healthy vegetation and oak trees on the south property
line as a screening method on the property bordering Maitland Road. Motion was made by Vavruska to approve
the revised minutes of the Planning Commission meeting of Tuesday, July 24, 2018 with the aforementioned
corrections and distributed at the meeting today. The motion was seconded by Bordewyk and upon vote
taken thereon passed unanimously.
DECLARATION OF CONFLICTS OF INTEREST:
Zwetzig asked for any potential conflicts of interest to be identified. None were declared.
[Secretary’s Note: Later in the meeting, Skjoldal reported having a conflict of interest with agenda item #5, a
request for Preliminary Plat Approval for Lots 3A, 3B, 3C, 3D and 3E of Block 1, Dodds Subdivision, City of
Spearfish, and recused himself from the meeting as this item was being considered].
1. Voluntary Annexation and Concurrent Change of Zoning from County Suburban Residential District
(SRD) to City Agricultural (AG) District.
Applicant: Dennis Allender, President - The Summit at Spearfish
Location: Lot 1 of the Sanctuary Subdivision

Michael Greslin was in attendance to address any concerns on behalf of the Applicant.
City Planner Jayna Watson presented an overview of the request for voluntary annexation and concurrent
change of zoning from County Suburban Residential District (SRD) to City Agricultural (AG) District for this
two (2) acre parcel legally described as Lot 1 of the Sanctuary Subdivision. Staff recommends approval of the
annexation and concurrent change of zoning, subject to an annexation agreement that requires the
manufactured home be removed from the property by September 30, 2018.
Chairman Zwetzig opened the public hearing at 3:08 pm. There was no testimony offered. Zwetzig closed the
public hearing at 3:09 pm.
Motion was made by Vavruska and seconded by Green to recommend approval of the request for
voluntary annexation and concurrent change of zoning from County Suburban Residential District
(SRD) to Agriculture (AG) for a two (2) acre parcel legally described as Lot 1 of the Sanctuary
Subdivision and located at 412 Hillsview Road, as requested by Dennis Allender, President of The
Summit at Spearfish, contingent upon approval of the annexation agreement. Upon vote taken thereon,
the motion passed unanimously.
2. Conditional Use Permit – The Findings, Revised
Applicant: Tyrell Ehnes for Burly Builders, LLC
Location: Tract F Revised, Voorhees Addition, City of Spearfish, Lawrence County, SD
Voorhees Lane @ Maitland Road
Watson explained that additional revisions to The Findings were necessitated based on input following the
public hearing on Tuesday, July 24, 2018 and referred the commission to those specific sections. Upon further
review, an error was noted in Section 21, Item D; the words “on the south edge of the parcel” will be struck
from this section. Following discussion, motion was made by Vavruska and seconded by Bordewyk to
approve The Revised Findings with the aforementioned correction to be made in Section 21, Item D.
Upon vote taken thereon, the motion passed unanimously.
3. DRD Final Plan Approval for a Storage Building.
Applicant: Ralph Siemonsma for Scott Neuhauser
Location: Lot 3B of Block 14 of The Reserve on Higgins Creek
Southwest Corner of Russell Street and Old Belle Road
The applicant, Ralph Siemonsma, was in attendance and presented a revised color scheme for the exterior of
the storage building proposed at this site.
City Planner Jayna Watson presented a brief overview of the request for DRD Final Plan Approval to allow a
storage building on property located at the southwest corner of Russell Street and Old Belle Road in The
Reserve on Higgins Creek. Motion was made by Bordewyk and seconded by Vavruska to recommend
DRD Final Plan Approval to allow a storage building on property legally described as Lot 3B of Block
14 of The Reserve on Higgins Creek with the following stipulations: 1) no trees are permitted in the city
water main easement; 2) all building mounted exterior lighting, if provided, shall be 85% cut off and
fully shielded; and 3) a site plan with spot elevations shall be submitted to the City Engineer for review
before a building permit is issued. Upon vote taken thereon, the motion passed unanimously.
4. DRD Final Plan and Shared Parking Plan Approval for the Offices at Creekside.
Applicant: Spearfish Creekside, LLC
Location: Lot 6 of Lot 1R, Block 3, Della Vecchia Addition, City of Spearfish
City Planner Jayna Watson presented a detailed overview of the request for DRD Final Plan Approval to allow
construction of an office building on property located on Lot 6 of Lot 1R, Block 3 of Della Vecchia Addition.
A critical component of the request is the concept of shared parking as outlined in the shared parking
agreement included in the staff report. She explained the developer is agreeable to trying an innovative
approach to providing diagonal parking along Yukon Place. Back-in only angled parking is proposed along
this low traffic volume street. Staff recommends approval with stipulations.
Following discussion regarding the proposed landscaping plan, motion was made by Green and seconded by
Kruskamp to recommend DRD Final Plan Approval to allow construction of an office building on
property legally described as Lot 6 of Lot 1R, Block 3, Della Vecchia Addition subject to the execution
of a shared parking agreement. Upon vote taken thereon, the motion passed unanimously.
5. Preliminary Plat Approval
Applicant: Michael Greslin, Access Point Properties LLC
Location: Lots 3A, 3B, 3C, 3D and 3E of Block 1
Dodds Subdivision, City of Spearfish
At this time, Skjoldal recused himself from the meeting citing a conflict of interest.
City Planner Jayna Watson presented a brief overview of the request for Preliminary Plat Approval to allow
for the platting and development of five (5) lots in the Dodds Subdivision. Staff recommends approval.
Chairman Zwetzig opened the public hearing at 3:48 pm. No testimony was heard and Zwetzig closed the
public hearing at 3:49 pm.
Motion was made by Bordewyk and seconded by Vavruska to recommend Preliminary Plat Approval as
presented for Lots 3A, 3B, 3C, 3D and 3E of Block 1, Dodds Subdivision, as requested by Michael
Greslin, Access Point Properties, LLC. Upon vote taken thereon, the motion passed with Skjoldal being
recused.
Skjoldal re-entered the meeting at this time, 3:51 pm.
6. Overview of Conditional Use Permits and Process.
Applicant: City of Spearfish
Location: City-wide
Watson presented a detailed overview of matters of procedural significance pertaining to administration of
Conditional Use Permits.
CITY COUNCIL UPDATE:
Watson reported briefly on matters discussed at the city council meeting last evening.
PUBLIC COMMENT:
Public Comment section opened at approximately 4:22 pm. There were none present to offer public comment and
section was closed.
ADJOURNMENT:
There being no further business to come before the commission, Zwetzig adjourned the meeting at 4:23 pm.
