Spearfish Planning Commission Regular Meeting Minutes Tuesday, September 4, 2018 The Spearfish Planning Commission met in regular session on Tuesday, September 4, 2018 at 3:00 pm in the council chambers at Spearfish City Hall. Members present: Toby Bordewyk, Dan Green, Jim Hopewell, Greg Kruskamp, Bob Meyer, Drew Skjoldal, Larry Vavruska and Barbara Zwetzig. Absent: None. Also present: City Planner Jayna Watson, Assistant City Planner Desirae Mayo, and City Attorney Ashley McDonald. Chairman Zwetzig called the meeting to order at 3:00 p.m. APPROVAL OF MINUTES: Motion was made by Kruskamp to approve the minutes of the Planning Commission meeting of Tuesday, August 21, 2018 as presented. The motion was seconded by Meyer and upon vote taken thereon passed unanimously. DECLARATION OF CONFLICTS OF INTEREST: Zwetzig asked for any potential conflicts of interest to be identified. Meyer disclosed partial ownership of property located in a Light/Restrictive Industrial (LRI) zoning district. 1. A Conditional Use Permit to allow a Retail Type 2 use (auto dealership) in an existing building located in a Central Commercial (C1) zoning district. Applicant: The Compass Point Location: Lots 6A2 & 6A3 of Lot 6A, SW¼NW¼, Connors Addition 710 E Colorado Boulevard Assistant City Planner Desirae Mayo presented an overview of the request for a Conditional Use Permit to allow an auto dealership to continue conducting business on property located at 710 East Colorado Boulevard and zoned Central Commercial (C1). The applicant was not aware that a conditional use permit was needed to allow the tenant to conduct this type of business at this location. Additional information will be provided at the next meeting in response to concerns noted. Motion was made by Kruskamp to set a public hearing for Tuesday, September 18, 2018 to consider the request for a Conditional Use Permit to allow a Retail Type 2 use in an existing building located at 710 E Colorado Boulevard and in a Central Commercial (C1) zoning district. The motion was seconded by Skjoldal and upon vote taken thereon passed unanimously. 2. Updates to The Revised Ordinances of the City of Spearfish, Appendix A – Zoning, Article IV, District Regulations, Sections 8 and 9, concerning primary permitted and conditional use permitted uses in Light/Restrictive Industrial and Heavy Industrial zoning districts. Applicant: City of Spearfish Location: Industrial zoning districts Watson stated that the updates to the light/restrictive industrial and heavy industrial sections of the zoning ordinance text to include permitted use lists will complete the comprehensive update undertaken in 2016 to bring city ordinance into compliance with state statute pertaining to conditional use permits. Mayo presented a detailed overview of the proposed zoning ordinance text update. Discussion revealed additional minor revisions necessary. [Vavruska entered the meeting at this time, 3:28 pm.] Concern was noted about the lack of authority the city has to regulate or mitigate negative impacts that might result from certain heavy industrial activities. CITY COUNCIL UPDATE: No report was given at this time. PUBLIC COMMENT: Public Comment section opened at approximately 3:46 pm. There were none present to offer public comment and section was closed. ADJOURNMENT: There being no further business to come before the commission, Zwetzig adjourned the meeting at 3:46 pm.
