Minutes Tuesday, October 2, 2018
The Spearfish Planning Commission met in regular session on Tuesday, October 2, 2018 at 3:00 pm in the council
chambers at Spearfish City Hall. Members present: Toby Bordewyk, Dan Green, Jim Hopewell, Bob Meyer, Drew
Skjoldal, Larry Vavruska and Barbara Zwetzig. Absent: Greg Kruskamp. Also present: City Planner Jayna
Watson, Assistant City Planner Desirae Mayo, and City Attorney Ashley McDonald.
Chairman Zwetzig called the meeting to order at 3:00 p.m.
APPROVAL OF MINUTES:
Motion was made by Skjoldal to approve the minutes of the Planning Commission meeting of Tuesday,
September 18, 2018 as presented. The motion was seconded by Green and upon vote taken thereon passed
unanimously.
DECLARATION OF CONFLICTS OF INTEREST:
Zwetzig asked for any potential conflicts of interest to be identified. Bordewyk disclosed having a conflict of
interest with agenda item number one (1) being the owner of adjacent property. He requested and was granted
permission to remove himself from dais at this time intending to offer testimony during the public hearing.
1. Change in Zoning from Agriculture (AG) and Single Family Residential (R1) to Multi-Family
Residential (R3) for Phase I, Construction of a Senior Living Facility and Phase II Single and Two
Family Residential
Applicant: ETR, LLC, David and Spencer Rossi
Location: A 19.5 acre parcel in the northwest portion of Tract C-1 of McGuigan Ranch Addition
[Vavruska entered the meeting at this time, 3:02 p.m.] Spencer Rossi, presented an overview of the request for
a change of zoning from Agriculture (AG) and Single Family Residential (R1) to Multi-Family Residential
(R3) on a 19.5 acre parcel located in Top Shelf Subdivision of McGuigan Ranch Addition on which they
propose to construct an assisted living facility (Phase I) consisting of independent living, assisted living and
memory care. Phase 2 will include single family homes and duplexes that will be constructed at a later time.
A development agreement will be executed to address issues of building height, Phase 2 land uses and density,
tree planting and landscaping of the berm and outdoor lighting.
Watson summarized the information presented in the staff report. Three letters of support have been received;
one in opposition and staff recommends approval.
Chairman Zwetzig opened the public hearing at 3:28 pm.
Testimony in opposition to the change of zoning was heard from Brenda Mosset, Christy Rogers, Teri
Kinghorn; Deana Bordewyk; and, Toby Bordewyk. Offering testimony in support of the project were Bob
Hellevang; Robin Meyerink; and, Dwight Gubbrud.
Zwetzig closed the public hearing at 4:07 pm.
Following discussion regarding the development agreement, motion was made by Meyer to recommend
approval of the change in zoning from Agriculture (AG) and Single Family Residential (R1) to Multi-
Family Residential (R3) for Phase I, construction of a senior living facility and Phase II, single family
homes and duplexes as presented by the applicants, ETR, LLC, David and Spencer Rossi, on a 19.5 acre
parcel in the northwest portion of Tract C-1 of McGuigan Ranch Addition, with additional conditions
added to the development agreement: Phase I shall be restricted to an assisted living facility/senior
housing; a more detailed description of landscape buffer requirements shall be provided; and, building
construction shall conform with criteria specified in the covenants for Top Shelf Subdivision. The
motion was seconded by Skjoldal and upon vote taken thereon, passed with Bordewyk abstaining due to
his declared conflict.
2. Updates to The Revised Ordinances of the City of Spearfish, Appendix A – Zoning, Article IV, District
Regulations, Sections 8 and 9, concerning primary permitted and conditional use permitted uses in
Light/Restrictive Industrial and Heavy Industrial zoning districts.

Location: Industrial zoning districts
Watson explained that the notice of public hearing was not properly published. Motion was made by Green
to reset a public hearing for Tuesday, October 16, 2018 to consider updates to The Revised Ordinances
of the City of Spearfish, Appendix A – Zoning, Article IV, District Regulations, Sections 8 and 9,
concerning primary permitted and conditional use permitted uses in Light/Restrictive Industrial and
Heavy Industrial zoning districts. The motion was seconded by Vavruska and upon vote taken thereon,
the motion passed unanimously.
CITY COUNCIL UPDATE:
Watson reported on items of interest at city council meeting last night.
PUBLIC COMMENT:
Public Comment section opened at approximately 4:30 pm. There were none present to offer public comment and
section was closed.
ADJOURNMENT:
There being no further business to come before the commission, Zwetzig adjourned the meeting at 4:30 pm.
