Spearfish Planning Commission Regular Meeting Minutes Tuesday, October 23, 2018 The Spearfish Planning Commission met in regular session on Tuesday, October 23, 2018 at 3:00 pm in the council chambers at Spearfish City Hall. Members present: Toby Bordewyk, Dan Green, Jim Hopewell, Greg Kruskamp, Bob Meyer, and Drew Skjoldal. Absent: Larry Vavruska and Barbara Zwetzig. Also present: City Planner Jayna Watson, Assistant City Planner Desirae Mayo, and City Attorney Ashley McDonald. Vice Chairman Bordewyk called the meeting to order at 3:00 p.m. APPROVAL OF MINUTES: Motion was made by Meyer to approve the minutes of the Planning Commission meeting of Tuesday, October 2, 2018 as presented. The motion was seconded by Skjoldal and upon vote taken thereon passed unanimously. DECLARATION OF CONFLICTS OF INTEREST: Bordewyk asked for any potential conflicts of interest to be identified. Meyer and Green disclosed being owners of property located in a Light/Restrictive Industrial (ILR) zoning district. 1. Updates to The Revised Ordinances of the City of Spearfish, Appendix A – Zoning, Article IV, District Regulations, Sections 8 and 9, concerning primary permitted and conditional use permitted uses in Light/Restrictive Industrial (ILR) and Heavy Industrial (IH) zoning districts. Applicant: City of Spearfish Location: Industrial zoning districts City Planner Jayna Watson explained that due to the meeting date postponement, the Planning Commission must take formal action to reset the public hearing previously scheduled for October 16, 2018. Motion was made by Meyer to reset a public hearing for Tuesday, November 6, 2018 to consider updates to The Revised Ordinances of the City of Spearfish, Appendix A – Zoning, Article IV, District Regulations, Sections 8 and 9, concerning primary permitted and conditional use permitted uses in Light/Restrictive Industrial (ILR) and Heavy Industrial (IH) zoning districts. The motion was seconded by Kruskamp and upon vote taken thereon, the motion passed unanimously. Meyer presented additional revisions in writing for consideration in Sections 8 and 9 in an effort to provide a regulatory component to potential impacts and define the term “industrial park-like setting”. Staff agreed to take these matters under advisement. 2. Development Review District (DRD) Final Plan Approval for construction of a gym. Applicant: Diversified Construction on behalf of Mike and Melissa Currier Location: Lot 3C, Block 14 of The Reserve on Higgins Creek Watson presented a brief overview of the request for DRD Final Plan Approval to allow construction of a gym and yoga studio on property located at the southwest corner of Russell Street and Old Belle  Road in The Reserve on Higgins Creek. Motion was made by Green and seconded by Meyer to recommend approval of the request to allow a gym and yoga studio on property legally described as Lot 3C of Block 14 of The Reserve on Higgins Creek as presented with the following stipulations: 1) All building-mounted exterior lighting shall be 85% cut off and fully shielded; and 2) No portion of the roof overhang or window awnings may extend into the fifteen foot (15’) City of Spearfish water main easement. Upon vote taken thereon, the motion passed unanimously. CITY COUNCIL UPDATE: Watson reported on items of interest at recent city council meetings and interesting presentations heard during the South Dakota Planners Association (SDPA) annual conference she recently attended in Huron, SD. PUBLIC COMMENT: Public Comment section opened at approximately 3:37 pm. There were none present to offer public comment and section was closed. ADJOURNMENT: There being no further business to come before the commission, Bordewyk adjourned the meeting at 3:37 pm.
