Spearfish Planning Commission Regular Meeting Minutes Tuesday, December 4, 2018 The Spearfish Planning Commission met in regular session on Tuesday, December 4, 2018 at 3:00 p.m. in the council chambers at Spearfish City Hall. Members present: Dan Green, Jim Hopewell, Greg Kruskamp, Bob Meyer, Drew Skjoldal, Larry Vavruska and Barbara Zwetzig. Members absent: Toby Bordewyk. Also present: City Administrator Mike Harmon, City Planner Jayna Watson, Assistant City Planner Desirae Mayo, and City Attorney Ashley McDonald. Chairman Zwetzig called the meeting to order at 3:00 p.m. APPROVAL OF MINUTES: Motion was made by Kruskamp to approve the minutes of the Planning Commission meeting of Tuesday, November 20, 2018 as presented. The motion was seconded by Vavruska and upon vote taken thereon passed unanimously. DECLARATION OF CONFLICTS OF INTEREST: Zwetzig asked for any potential conflicts of interest to be identified. None were declared at this time. It was announced that Kevin Dailey is in route to city hall at this time; Chairman Zwetzig opted to move on to item #2 on today’s agenda. 2. Preliminary Plat Approval Applicant: KTM Design Solutions Location: Lots 8 - 19 of Block 12 and Lots 8 - 18 of Block 13 and Dedicated Public Right of Way of Elkhorn Ridge Addition City Planner Jayna Watson presented a brief overview of the analysis provided in the staff report. Motion was made by Vavruska and seconded by Kruskamp to set a public hearing for Tuesday, December 18, 2018 to consider the request for Preliminary Plat Approval for the Elkhorn Ridge Golf Estates Phase 4 Expansion to Brooks Loop. Upon vote taken thereon, the motion passed unanimously. 1. Concept Plan Amendment and Final Plan Approval to allow two (2) phases of construction of 8-plex residential apartment units in a Development Review District (DRD) zoning district. Applicant: Dailey Construction, LLC/Kevin Dailey Location: Lots 40 and 43 of Block 16, Tract A of The Reserve on Higgins Creek (located at the southwest corner of Reserve Street and Allegheny Street) Watson provided an overview of the extensive details in the staff report pertaining to this proposal and staff analyses pertaining to its compliance with the city’s comprehensive plan and DRD Final Plan Approval criteria. Chairman Zwetzig opened the public hearing at 3:16 pm. Testimony in opposition to the proposed multi-family construction projects was heard from Sierra Karras, Dillon Karras, and Amber Lawler. A letter from Ronald and Misty Grimsley, also opposed to the project was read and subsequently  hand delivered to the commission. Hearing no further testimony, Zwetzig closed the public hearing at 3:34 pm. Discussion commenced regarding open space and setback requirements and proposed building orientation. Motion was made by Vavruska to recommend approval of the Concept Plan amendment and Final Plan Approval to allow two (2) phases of construction of 8-plex residential apartment units on Lots 40 and 43 of Block 16 of Tract A of The Reserve on Higgins Creek as proposed by Dailey Construction LLC with the following conditions pertaining to final site development: 1) Revisions to the site plan in Phase 1 and 2 are permitted with minor adjustments in setbacks provided that any reduction in setback is less than 20% from what is shown on the site plan; and 2) In phase 2, revisions to the site plan are permitted provided that the square footage and dimension of the open space located south and east of the parking lot remains unchanged. The motion was seconded by Green and upon vote taken thereon, the motion passed unanimously. CITY COUNCIL UPDATE: Watson reported briefly on matters heard at the city council meeting last night. PUBLIC COMMENT: Public Comment section opened at approximately 4:02 p.m. There were none present to offer public comment and section was closed. ADJOURNMENT: There being no further business to come before the commission, Zwetzig adjourned the meeting at 4:02 p.m.
