If you desire to attend this public meeting and need special accommodations, please notify the Building and Development Office at 605-642-1335 and 24 hours prior to the meeting so that appropriate auxiliary aids and services are available.  Spearfish Planning Commission Regular Session Minutes September 3rd, 2024 at 4:00 p.m. The Spearfish Planning Commission met in regular session on Tuesday, September 3rd, 2024 in the Council Chamber of City Hall and via Zoom video conference. Greg Kruskamp called the meeting to order at 4:25 p.m. Roll call was taken with the following members present: Greg Kruskamp, Rick Tysdal, Dylan Wilde and Meghan Byrum. Also present: Kevin Koelbel, Planning Director, Jaymia Ecker, Assistant Planning Director. APPROVAL OF AGENDA Tysdal moved, Wilde seconded, and all voted to approve the agenda as presented. APPROVAL OF MINUTES: Tysdal moved, Byrum seconded, and all voted to approve the minutes of the August 20th, 2024, Planning Commission meeting. DECLARATIONS OF CONFLICTS OF INTEREST: Kruskamp called for any potential conflicts of interest to be identified. No conflicts were identified. ITEMS FOR ACTION: 1. Request: Approve a Zoning Text Amendment for the DRD Zoning Location: City-wide Applicant: City of Spearfish Action: Hold a public hearing, make a recommendation to approve the request. Koelbel summarized the staff report which recommended the removal of “advertising signs” as a prohibited use within the Development Review District (DRD) zoning district. Kruskamp opened the public hearing at 4:32 p.m. Discussion included existing sign regulations and how they apply to the DRD zoning, the intent of the prohibition, and potential outcomes of the amendment. Sign allowances for all zoning districts are based on land use, street frontage, and building area. Marty Clark provided a comment about ensuring the removal of this language will not result in excessive signage, especially billboards. Kruskamp closed the public hearing at 4:48 p.m. Tysdal moved to approve the zoning text amendment, Byrum seconded, and Kruskamp called for a vote. Byrum and Tysdal voted aye and Wilde voted nay. The motion passed. 4. Public Comment – no public comment was made 5. Items for Discussion a. Lawrence County will host upcoming open house events for the public to provide feedback on the draft Future Land Use Map and amendments to the County’s Comprehensive Plan. Details can be found on the Lawrence County website. Myers Request: Approve a final plat of Tract B and Tract D of the S1/2NW1/4 and N1/2N1/2SW1/4 of section 11, T6N, R3E, BHM Action: Approve the Final Plat Location: Approximately ¾ of a mile north of the intersection of St. Onge Road and Interstate 90 on the east side of St. Onge Road; Within the Extraterritorial Jurisdiction Proposal Summary: The proposed plat will create two tracts, Tract D being 75.68 acres and Tract B being 41 acres, from an aliquot part of section 11, T6N, R3E. Page 1 Spearfish Planning Commission Staff Report Meeting Date: September 17th, 2024 General Comments: The proposed plat is a minor plat located outside of city limits within the 3- mile platting jurisdiction. The property is currently zoned A-1 - General Agriculture District (Lawrence County zoning district) with no existing structures. A sketch plat was approved at the February 6th, 2024 Planning Commission Meeting. Stipulations associated with the sketch plat approval including the dedication of public right of way for St. Onge Road and access location have been met. Staff Review Zoning: The subject property is zoned A-1 General Agriculture District. Resulting lots exceed the 40-acre minimum lot size required by this zoning district. Utilities: The plat dedicates a 30’ access and utility easement along the southern boundary of Tract D for the benefit of Tract B. A 5’ utility easement is dedicated along the interior sides of all lot lines. Access: Access to Tract D is from St. Onge Road located adjacent to the western boundary of the lot. Access to Tract B is granted through a 30’ access and utility easement from St. Onge Road through Tract D. An access and utility easement agreement will be submitted for recording with the final plat. Lawrence County has road jurisdiction over this section of St. Onge Road. Platting Process: Following approval of the final plat by the Planning Commission, the plat with go before City Council for consideration with a public hearing. Summary and Staff Recommendation: The proposed plat meets applicable zoning and subdivision requirements. Staff recommend approval of the final plat.
