REQUEST:
Kyle-Proposal Review Committee requests approval of FMG Engineering proposal for
consulting work involving a Feasibility Study for a Shared Use Community Path that will
link the Exit 8 Development area to the existing Spearfish path system at a cost not to
exceed $30,715.00. A proposal for the Green Acres Subdivision Area Feasibility Study
that would link Roughlock Lane path to the Exit 14 path at a cost not to exceed $20,233,
was also provided for consideration.
JUSTIFICATION: (attach any additional justification and/or documentation)
The proposal review committee evaluated proposals from FMG Engineering and HOR
Engineering on 6/22/18 and recommended approval of the FMG proposal for Exit 8 only.
HOR Engineering proposal costs were $46,450.00 and $24,460.00,respectively for the Exit
8 and Green Acres studies. Committee agreed that most of the Green Acres route
evaluation is pretty straight forward and plans for future grant opportunities could be
prepared in-house, with adequate notice.

REQUEST:
Kyle - Request approval for final Under/Over Change Order (1) for the Sandstone Park Rec Path Extension
Project for an increase of $2,361.26, bringing the final project cost to $66,242.01. Also requesting the Mayor
to sign the Certificate of Final Completion and Acceptance setting July 2, 2018 as the date the 2 year
warranty begins.
JUSTIFICATION: (attach any additional justification and/or documentation)
Construction is substantially complete. See attached Change Order and Certificate of
Final Completion. Original bid cost was $63,880.75, overall overage of $2,361.26 ( 3.7%
increase). Major additional costs included additional aggregate base course material
used for fill due to an overage of existing topsoil on the site.

AN ORDINANCE AMENDING APPENDIX A, ARTICLE IV OF THE REVISED
ORDINANCES OF THE CITY OF SPEARFISH
(PRIMARY PERMITTED USES AND USES ELIGIBLE FOR CONDITIONAL
USE PERMITS)
BE IT ORDAINED by the Common Council of the City of Spearfish that Appendix A, Article IV7
of the Revised Ordinances of the City of Spearfish is hereby amended-with strikethrough
indicating text to be deleted, underlined text to be added, and the remainder of the Article left
unaffected-as follows:
Appendix A. Zoning
Article IV. District Regulations.

Section 1 b. AG agricultural district.
A. General description. This district is intended to protect agricultural lands and to preserve
the natural beauty and open character of forests and other natural areas from
incompatible land uses.
B. Primary uses permitted. Property and structures in the AG agricultural district shall be
used for the following purposes:
1. Agricultural uses such as general farming, pasture, grazing, horticulture,
viticulture, truck farming, forestry, sod farming and wild crop harvesting including
roadside stands exclusively for the sale of produce, but excluding commercial
feed lots.
2. Detached site-built or modular single-family dwellings.
3. Accessory structures and uses customarily incidental to a primary use when
located on the same lot, after the primary use has been established.
4. Veterinary clinics, subject to the following requirements:
a. Confinement pens for large animals and outdoor runs for small animals shall
maintain a minimum setback of eighty (80) feet from all property lines.
b. The clinic facility shall be constructed and operated in such a manner as to
minimize the transmission of sound to neighboring properties.
c. Fenced outdoor runs and exercise areas shall be used only during normal
business hours and shall be screened to a height of eight (8) feet.
