City of Spring Hill, Kansas Minutes of City Council Regular Session March 9, 2023 A Regular Session of the City Council was held in the Spring Hill Civic Center, 401 N. Madison, Council Chambers, Spring Hill, Kansas on March 9, 2023. The meeting convened at 7:00p.m. with Mayor Berkey presiding and Glenda Gerrity, City Clerk, recording. PLEDGE OF ALLEGIANCE All who joined in, recited the Pledge of Allegiance. ROLL CALL The City Clerk called the roll of the City Council. With a quorum present, the meeting commenced. Consider Approval of Insurance Company to Provide a Property, Casualty, and Liability Policy for the Period of April 1, 2023-March 31, 2024 Motion by Roth, seconded by Young, to approve the selection of EMC, Elliott Group, to provide the City’s Property, Casualty and Liability Insurance, up to $220,870.00. Motion carried 5-0-0. 7. Consider Approval of Ordinance No. 2023-07: Authorizing the Issuance and Delivery of $[5,145,000] Principal Amount of General Obligation Bonds, Series 2023A, of the City of Spring Hill, Kansas; and Providing for the Levy and Collection of an Annual Tax for the Purpose of Paying the Principal of and Interest on the Bonds as They Become Due Motion by Roth, seconded by Young, to approve Ordinance No. 2023-07 authorizing the issuance and delivery of $5,145,000 principal amount of General Obligation Bonds, Series 2023A, of the City of Spring Hill, Kansas; and providing for the levy and collection of an annual tax for the purpose of paying the principal of and interest on the bonds as they become due. Motion carried 5-0-0. 9. Consider Approval of 2022 and 2023 Inter-Fund Transfers Motion by Roth, seconded by North, to approve the 2022 and 2023 inter-fund transfers. Motion carried 5-0-0. 10. Consider Approval of the Consulting Services for 199th Street (Ridgeview to Renner) and Authorize Mayor Berkey to Execute Contract Motion by Roth, seconded by Young, to approve Brungardt Honomichl and Company, P.A. as the engineer to perform the final design and consulting services for the 199th Street, Ridgeview to Renner, and authorize Mayor Berkey to execute the contract. Motion carried 5-0-0. 11. Consider Approval of Construction Contract Bid for 2023 Street Maintenance – Base Repair and Crack Seal Project with McAnany Construction, Inc. Motion by Roth, seconded by Young, to approve the bid from McAnany Construction, Inc. in the amount of $808,298.00 and authorizing the mayor and staff to execute the construction contract after review by the City Attorney. Motion carried 5-0-0. 12. Consider Approval of Construction Contract Bid for 2023 Street Maintenance – Chip Seal Project with Vance Brothers, Inc. Motion by Roth, seconded by North, approve the bid from Vance Brothers Inc. in the amount of $498,633.95 and authorizing the mayor and staff to execute the construction contract after review by the City Attorney. Motion carried 5-0-0. DISCUSSION 2023 Water Rates & System Development Fees and 2023 Sewer Rates & System Development Fees Ms. Dunn presented the proposed rates for the water and sewer rates and system development fees. Staff requested feedback by April 6 so the fee/rate resolution can be placed on the April 13, city council agenda. ANNOUNCEMENTS and REPORTS The governing body and staff gave announcements and reports. The mayor requested a 10-minute recess before the executive session. Spring Hill City Council Regular Session Minutes March 9, 2023 Page 3 of 4 EXECUTIVE SESSION Motion by Roth, seconded by Young, to recess into Executive Session for 15 minutes to receive advice of counsel pursuant to the attorney-client privilege exception of K.S.A. 75-4319 (b) (2) of the Kansas Open Meetings Act. The open meeting will resume in the City Council Chambers at 8:50p.m. with a 10 minute intercession prior to the meeting. No formal action is anticipated following the session. Persons to be in attendance are Lane Massey, City Administrator, Spencer Low, City Attorney, Glenda Gerrity, City Clerk, and Ashley Wood, Deputy City Clerk. Motion carried 5-0-0. The meeting recessed at 8:25 p.m. with the executive session to begin at 8:35p.m. The Mayor stated, let the record reflect that the Governing Body reconvened into the open meeting at 8:50p.m., with everyone present. No votes were taken, or decisions made during the executive session. The discussion was limited to the subjects stated. The mayor requested to amend the agenda with the addition of an action item. Motion by Roth, seconded by North, to add an item to the agenda. Motion carried 5-0-0. ADDITIONAL ACTION ITEM Motion by Roth, seconded by North, to direct the City Attorney to create a legal memorandum regarding the 2023 election. Motion carried 5-0-0.
