MINUTES Springville City Council Regular Meeting – SEPTEMBER 06, 2022 MINUTES OF THE REGULAR MEETING OF THE SPRINGVILLE CITY COUNCIL HELD ON TUESDAY, SEPTEMBER 06, 2022, AT 7:00 P.M. AT THE CIVIC CENTER, 110 SOUTH MAIN STREET, SPRINGVILLE, UTAH. CALL TO ORDER Mayor Packard called the meeting to order at 7:04 p.m. INVOCATION AND PLEDGE Councilmember Jensen offered the invocation, and Councilmember Sorensen led the Pledge of Allegiance. APPROVAL OF THE MEETING’S AGENDA Motion: Councilmember Sorensen moved to approve the agenda as written. Councilmember Snelson seconded the motion. Voting Yes: Councilmember Crandall, Councilmember Jensen, Councilmember Miller, Councilmember Snelson, and Councilmember Sorensen. The motion Passed unanimously 5-0 MAYORS COMMENTS Mayor Packard welcomed the Council, staff, and those in attendance. CONSENT AGENDA 1. Approval of the minutes for the August 09 and 16, 2022 work study meetings and the August 16, 2022 regular meeting. 2. Approval of a Resolution and amendment to an Interlocal Agreement with Utah County for the cities use of Filevine Attorney Case and Document Management System – John Penrod, Assistant City Administrator/City Attorney Page 1 of 4 Motion: Councilmember Miller moved to approve the consent agenda as written. Councilmember Snelson seconded the motion. Roll Call Vote: Voting Yes: Councilmember Crandall, Councilmember Jensen, Councilmember Miller, Councilmember Snelson, and Councilmember Sorensen. The motion Passed unanimously 5-0. Resolution #2022-36 passed. REGULAR AGENDA 3. Consideration of a Resolution directing Springville City staff to close the westbound lane of 100 South between 200 East and 100 East, on the north side of Hobble Creek, to vehicle traffic, and to modify it to function as a pedestrianized public space for walking, biking, and other recreation uses – Josh Yost, Community Development Director Director Yost stated staff had spoken to residents in the area about the change and they had been supportive. The esthetic of the area will be improved and more enjoyable, with consideration of a 200 East bike way. Director Yost reported shaping Springville for 2030, the Springville City General Plan, adopted in 2011, contemplated the creation of a pedestrian boulevard on 100 South on the North side of Hobble Creek between 100 East and 200 East. The purposes for the proposal as stated by the General Plan was to; improve aesthetic quality of the area, link existing trails and bikeways, provide a place for the community to gather, and provide a place for pedestrians to travel. Public Works, Parks and Recreation, and Community Development have been working together over the past year with a private sector partner Springville Rising, to implement the concept. Staff agreed that the proposed closure and conversion to a pedestrian space would accomplish the General Plan purposes. Councilmember Sorensen asked who would pay for it and maintain the area. Director Yost replied the city maintain it and has it in the budget. He asked if the city had permission to make changes to the banks of the river. Director Yost stated City Engineer Anderson had been working with the flood plain representative and explained there would not be any changes to the creek that would require approvals. Councilmember Snelson asked what department would maintain the creek and if the weeds would be taken care of. Director Yost said the Streets Department would continue to maintain the creek. Staff was currently working on concepts for the area, with benches and plantings. Some component of lighting would be done according to budget, then staff could procure plans for the area. Councilmember Sorensen asked to have neighbors south of the area and any in the area that have not been contacted to be notified as a courtesy. The motion Passed unanimously 5-0. Resolution #2022-37 passed. 4. Consideration of a Resolution authorizing PAR dollars towards an Arts Master Plan – Jack Urquhart, Management Analyst Analyst Urquhart reported the PAR Board had recommended the City Council approve up to $25,000 of PAR Tax dollars go towards the development of an Arts Master Plan. The board, staff, and City leadership were interested in gaining a vision for the City’s goals and role in promoting various forms of art in the community. The enactment of a PAR Tax beginning in 2022 and establishment of a PAR Board has provoked questions about the City’s overall vision and goals for promoting art. With the restructuring of City boards and commissions, the Springville Arts Commission was dissolved. PAR Board members now wonder whether the grants will continue. The Springville Public Arts program established a Percent for Art funding mechanism which continues to take shape. Springville Parks and Recreation held two summer concerts this year. The Springville Public Library puts on art programs and hosts musicians. And of course, since the early 1900s, the Springville Museum of Art has provided the public with art opportunities and exposure unheard of in any other Utah communities. Councilmember Crandall asked if staff was comfortable with allocating funds and making those decisions. Councilmember Sorensen likened it to the Parks Master Plan. It would help prioritize any future needs for the Arts. Councilmember Snelson said there were so many voices for the funds, we need to see what the priority is and not special interests. Attorney Penrod stated it would be a long-term plan. Motion: Councilmember Snelson moved to approve Resolution #2022-38 amending the Springville City Budget to pay up to $25,000 of PAR dollars to develop an Arts Master Plan for Springville City. Councilmember Sorensen seconded the motion. Rollcall Vote: Voting Yes Councilmember Crandall, Councilmember Jensen, Councilmember Miller, Councilmember Snelson, and Councilmember Sorensen. The motion Passed unanimously 5-0. Resolution $2022-38 passed. 5. Consideration of a Resolution amending the agreement with Red Mesa Power – Shawn Black, Power Director Director Black reported the Power Department Staff recommends the amended, restated agreement with the Red Mesa Solar project and believes it would help the City financially because the project has low cost per mega-watt hour (MWh), is supplied through a Power Purchase Agreement (PPA) which insulates from investment risk, has an advantageous load profile during the summer months, and also provides possible benefits by satisfying increasing Federal and State Renewable Portfolio Standard Requirements (RPS requirements) in the future. Entrance into the Red Mesa Power Project, would secure solar capacity of 3,000 kilowatt (KW) for the City, at a price of $37.00 per MWh for 25 years. He explained gas had increased on hedges and any renewables would help. Motion: Councilmember Snelson moved to approve Resolution #2022-39 authorizing the Amended and Restated Transaction Schedule for the Navajo Tribal Utility Authority Generation-Utah, LLC project providing entitlement of 3,000 KW of capacity in the Red Mesa Tapaha Solar project. The term of this transaction schedule is for 25 years, at the Flat price of $37.00 per MWh. This resolution will supersede the resolution approved on August 20, 2019 by the City Council. Councilmember Miller seconded the motion. Councilmember Sorensen asked if there was an opportunity to purchase more. Director Black explained there was not. Rollcall Vote: Voting Yes Councilmember Crandall, Councilmember Jensen, Councilmember Miller, Councilmember Snelson, and Councilmember Sorensen. The motion Passed unanimously 5-0.
