The City Council convened in Regular Session on Tuesday, May 7, 2013 at 7:00 p.m. in the
Council Chambers on the fourth floor of City Hall, 200 North Second Street, with President of
the Council Laurie Feldman, presiding, The Honorable Mayor Sally A. Faith and the Members
of the Council present as follows: Dave Beckering, Tom Besselman, Rod Herrmann, Bridget
Ohmes, Mary Ann Ohms, Jerry Reese, Ron Stivison, Michael Weller and Mary West. Absent:
None. City Clerk Laura L. Whitehead was present and performed the duties of that office.

The meeting was opened with the Invocation, those present standing in a moment of silence,
followed by the Pledge of Allegiance to the Flag.
April 2, 2013 Election Results
Canvass of Election Returns of the General Municipal Election Held April 2, 2013 and
Declaration of the Election Results
A motion was made by BRIDGET OHMES to receive and approve the certification of the
election results of the General Municipal Election held on April 2, 2013. ROD HERRMANN
seconded the motion. A roll call vote was taken, with the following results: “Aye”: Besselman,
Feldman, Herrmann, Ohmes, Ohms, Reese, Stivison, Weller, West and Beckering. ”Nay”:
None. Absent: None. Motion passed.

Administration of Oath of Office
City Clerk Laura L. Whitehead administered the Oaths of Office to the following
Councilmembers:
Jerry Reese – Ward 6, with term ending April, 2016
Dave Beckering – Ward 7 with term ending, April 2016
Rod Herrmann – Ward 8 with term ending, April 2016
Bridget Ohmes – Ward 9 with term ending, April 2016

Election of President and Vice President of the City Council
Ballots were distributed for the election of President of the City Council. The ballots were
counted, with the following results: Dave Beckering – 10 votes. The City Clerk announced that
Dave Beckering was elected President of the Council.
Ballots were distributed for the election of Vice President of the City Council. The ballots were
counted with the following results: Bridget Ohmes – 9 votes. Tom Besselman – 1 vote. The City
Clerk announced that Bridget Ohmes was elected Vice President of the City Council.

Council President Dave Beckering thanked retiring Council President Laurie Feldman for her
dedication and hard work during the past year.
PUBLIC HEARINGS
The President of the Council Dave Beckering announced that the following Public Hearings
would now be held. At the conclusion of the hearings, the Regular Session continued with the
order of business:
A. Case No. Z-01-13. An application to amend the previously approved
Development Plan and Development Ordinance for the Waterworks Planned
Development within the PD-RF Planned Development-Riverfront District.
Specifically, to amend the ordinance and plan to include alcohol distilling
within an existing restaurant for the property at 1200 South Main Street. The
subject property is 0.23 acres and is located in Ward 2 (Council Bill 11034)
B. Case No. CU-16-13. (Wade Civey). An application for a Conditional Use
Permit from §400.760(C) for a new nonconforming use permit within the R-1E
Single-Family Residential District, specifically to approve a change from a

An Ordinance Authorizing an Agreement with the St. Charles Lions Club for the
Sponsorship of the Operation of the Farmers Market During the Summer of 2013

MARY ANN OHMS made a motion to amend Council Bill 11026 to reflect the operation of the
Market is being held at the Foundry Art Centre in 2013 as indicated in Proposed Substitute Bill
No. 1. JERRY REESE seconded the motion. Discussion was held relative to the Farmers
Market being held at the Band Box Cleaners parking lot from May 18th through June 1st and
being held at the Foundry Art Centre’s parking lot beginning on June 8th. After further
discussion it was determined Proposed Substitute Bill No. 1 should be withdrawn, to approve
Council Bill 11026 as originally introduced which reflects the operation of the Market will take
place at the Band Box Cleaners parking lot, and to introduce a new council bill on May 21, 2013
in order to address the two locations where the Market will operate in 2013. MARY ANN
OHMS withdrew her motion and the Proposed Substitute Bill No. 1 from consideration.

ANNOUNCEMENTS FROM COUNCILMEMBERS/MISCELLANEOUS
Council President Dave Beckering announced he is currently reviewing the council liaison lists
and requested the full council to provide their individual requests as to which
board/commission/committee they wish to serve on this next term.
Councilmember Jerry Reese thanked the Senior Citizen Advisory Board for their support during
the recent Prescription Drug Take Back Event; and announced 7-800 lbs. of prescription drugs
were collected.
Councilmember Jerry Reese announced St. Charles City Police Officer Susan Shields was the
recipient of the Optimist Club’s Outstanding Officer of the Year Award.
Councilmember Ron Stivison announced he received a Thank You from a property owner along
Hwy 370 for all the efforts the City provided during the recent flooding. Councilmember
Stivison wanted to Thank all the city staff members; couldn’t have been done without them!
Councilmember Ron Stivison announced the City-County Host Memorial Day Commemoration
will be held on Monday, May 27th at 1:00 p.m. at the St. Charles Veterans Memorial on Bishop’s
Landing.
Council Vice President Bridget Ohmes thanked Councilmember Laurie Feldman for all her
support and efforts as the Council’s past President.
APPROVAL OF CLOSED MINUTES
A motion was made by LAURIE FELDMAN to approve the following Closed Session Minutes:
A. Closed Session of April 9, 2013, relative to legal actions, causes of action, or
litigation (RSMo 610.021.1) and preparation, including any discussions or work
product, on behalf of the Council or its representatives for negotiations with
employee groups (RSMo 610.021.9), at 6:30 p.m.
BRIDGET OHMES seconded the motion. A roll call vote was taken with the following results:
“Aye”: Besselman, Feldman, Herrmann, Ohmes, Ohms, Reese, Stivison, West, Weller and
Beckering. “Nay”: None. Absent: None. Motion passed.
Council President Dave Beckering announced the following Closed Session Minutes well be
held and placed on the May 21, 2013, Regular Council Meeting agenda for approval.
B. Closed Session of April 16, 2013, relative to legal actions, causes of action, or
litigation (RSMo 610.021.1) and leasing, purchase or sale of real estate where
public knowledge of the transaction might adversely affect the legal
consideration therefor (RSMo 610.021.2) at 6:30 p.m.
