RECORD OF THE COUNCIL OF THE CITY OF SAINT CHARLES, MISSOURI December 3, 2013 ______________________________________________________________________________ The City Council convened in Regular Session on Tuesday, December 3, 2013 at 7:00 p.m. in the Council Chambers on the fourth floor of City Hall, 200 North Second Street, with President of the Council Dave Beckering, presiding, The Honorable Mayor Sally A. Faith and the Members of the Council present as follows: Tom Besselman, Laurie Feldman, Rod Herrmann, Bridget Ohmes, Jerry Reese, Ron Stivison, Michael Weller and Mary West. Absent: Mary Ann Ohms. City Clerk Laura L. Whitehead was present and performed the duties of that office. File # 47942 The meeting was opened with the Invocation, those present standing in a moment of silence, followed by the Pledge of Allegiance to the Flag. A motion was made by BRIDGET OHMES to excuse the absence of Councilmember Mary Ann Ohms. JERRY REESE seconded the motion. All voted in favor, motion passed. PUBLIC HEARINGS/ADMINISTRATIVE HEARINGS The President of the Council Dave Beckering announced that the following Public Hearings would now be held. At the conclusion of the hearings, the Regular Session continued with the order of business: A. Case No. PDA-2013-1. (Lombardo Homes of St. Louis, LLC). An application to amend the previously approved Preliminary Development Plan for the commercial portion of the Talbridge PD-MU Subdivision, east of Fairgrounds Road and north of Friedens Road, within the PD-MU Planned Development-Mixed Use District. Specifically, to amend the site layout and design to replace a majority of the commercial uses currently approved for the development with forty-nine (49) lots for detached single family dwelling units. Whitehead read the written petition received at tonight’s meeting relative to Fifth Street Reconstruction and Enhancement Project and announced when this Petition was filed tonight the Petitioner’s stated it was in reference to Resolution agenda item #6A A Resolution of the City Council of the City of St. Charles, Missouri in Support of a Federal Highway Administration, Missouri Highway and Transportation Commission and County of St. Charles Road Improvement Project for the Interchange at Interstate 70 and Fifth Street. City Clerk Laura L. Whitehead announced a valid remonstrance has been filed in the City Clerk’s Office in opposition to the rezoning for the West Clay Senior Living Development – Bill for Final Passage; Council Bill 11174 An Ordinance Repealing Ordinance No. 06-65; Rezoning 3.83 Acres from R-1E Single-Family Residential District to PD-R Planned Development- Residential District; Approving a Preliminary Development Plan / Site Plan; and Approving a Development Agreement. Fifth Street, spoke in opposition to agenda item Resolution #6A A Resolution of the City Council of the City of St. Charles, Missouri in Support of a Federal Highway Administration, Missouri Highway and Transportation Commission and County of St. Charles Road Improvement Project for the Interchange at Interstate 70 and Fifth Street. And the proposed median included in the Fifth Street Reconstruction and Enhancement Project. Director of Administration Michael Spurgeon stated agenda item Resolution #6A is not related to the Fifth Street Reconstruction and Enhancement Project. Director Spurgeon and Council President Beckering stated Resolution #6A is requesting the Council’s support of the St. Charles County’s Project related to the improvements at the Fifth Street Interchange which will improve the traffic flow at the Fifth Street Interchange and will enhance access and utilization of Fairgrounds Road. Brian Vogel, 414 Thomas Avenue, spoke in opposition to the Fifth Street Reconstruction and Enhancement Project. Theresa Dillow, 313 Sandra Avenue, spoke in opposition to the Fifth Street Reconstruction and Enhancement Project. Council President Beckering requested Administration to seek potential solutions relative to the Fifth Street Reconstruction and Enhancement Project. Mayor Faith responded to Council President Beckering by stating alternatives to the Projection have been determined and will be presented within the next 30-45 days. Brad Goss, 120 S. Commercial Unit Inspections. Mr. Schneider thanked Director of Community Development Bruce Evans for reaching out to the St. Charles County Association of Realtors for input and feedback on proposed Council Bill 11174. Mr. Schneider also requested the Council to consider the following items to be included in Council Bill 11174: 1). Perform commercial inspections within 24 hours; 2). Allow building owners and tenants to schedule inspections and pay for them online; and 3). Offer time-specific inspections. Mary Ann Zerr, 2905 Olde Gloucester Drive, spoke in opposition to Council Bill 11174 An Ordinance Repealing Ordinance No. 06-65; Rezoning 3.83 Acres from R-1E Single-Family Residential District to PD-R Planned Development-Residential District; Approving a Preliminary Development Plan / Site Plan; and Approving a Development Agreement and voiced concerns relative to safety in the area; two police reports filed this past week – one regarding a burglary and one involving the theft of car licenses. RESOULTIONS A Resolution of the City Council of the City of St. Charles, Missouri in Support of a Federal Highway Administration, Missouri Highway and Transportation Commission and County of St. Charles Road Improvement Project for the Interchange at Interstate 70 and Fifth Street (Sponsors: Dave Beckering and Laurie Feldman) Councilmember Laurie Feldman stated this project involves the County and State. This project will include a retrofit of the Fifth Street Interchange to a Diverging Diamond Roundabout Interchange. Councilmember Feldman also stated this project will provide opportunity to move traffic and to be business friendly. Council President Dave Beckering stated the project will also add a service road on the North along with an exit on Fairgrounds Road. This project will only enhance Fifth Street. Council President Beckering also stated this is not a City funded project. Mr. Crum wrote he was locked out of his home and he contacted the Police Department for help. Officer Stanczak responded to the call and was able to help him gain entry into his home.
