RECORD OF THE COUNCIL OF THE CITY OF SAINT CHARLES, MISSOURI March 4, 2014 ______________________________________________________________________________ The City Council convened in Regular Session on Tuesday, March 4, 2014 at 7:00 p.m. in the Council Chambers on the fourth floor of City Hall, 200 North Second Street, with President of the Council Dave Beckering, presiding, The Honorable Mayor Sally A. Faith and the Members of the Council present as follows: Tom Besselman, Laurie Feldman, Rod Herrmann, Bridget Ohmes, Mary Ann Ohms, Jerry Reese, Ron Stivison, Michael Weller and Mary West. Absent: None. City Clerk Laura L. Whitehead was present and performed the duties of that office. File # 48108 The meeting was opened with the Invocation, those present standing in a moment of silence, followed by the Pledge of Allegiance to the Flag. PUBLIC HEARINGS/ADMINISTRATIVE HEARINGS The President of the Council Dave Beckering announced that the following Public Hearings/Administrative Hearings would now be held. At the conclusion of the hearings, the Regular Session continued with the order of business: A. Public Hearings 1. Case No. CU-2014-1. (St. Charles Tower). An application for a Conditional Use Permit from §400.150(D)(1)(n) to build a cellular tower within the R-1C Single-Family Residential District, specifically to construct a new 100 foot tall telecommunication tower on the campus of St. Elizabeth Ann Seton at 2 Seton Court. The subject property is 11.02 acres and is located in Ward 6 (RCA Attached) 2. Case No. CU-2014-4. (James Boyd). An application for a Conditional Use Permit from §400.290(C)(15) to open a secondhand sales use within the FHCD Frenchtown Historic Commercial District, specifically to sell used furniture, jewelry and other home goods at 900 North Second Street. The subject property is 0.20 acres and is located in Ward 1 (RCA Attached) 3. Case No. CU-2014-5. (Sam’s Club – Matt Caputo). An application for a Conditional Use Permit from §400.480(E)(4) for Outdoor Display of Merchandise within the C-2 General Business District, specifically to display plants and other seasonal items outdoors at 2855 Veterans Memorial Parkway (Sam’s Club). The subject property is 12.57 acres and is located in Ward 6 (RCA Attached) 4. Case No. CU-2014-6. (Jayne Norris) An application for a Conditional Use Permit from §400.480(D)(1) for a Temporary Retail Sales Use within the CBD Central Business District, specifically to operate an outdoor food stand at 517 North Fifth Street. This request is to continue operating the previously approved stand for an extended period of time on a year-round basis. Case No. CU-2014-7. (Robert Dodd) An application for a Conditional Use Permit from §400.390(C) of the City of St. Charles Code of Ordinances and Article 3.1 of the St. Charles Gateways Smartcode for a Drive-Thru Restaurant within the T4-NMX Neighborhood Mixed Use Overlay District, specifically to convert an existing retail building into a drive-thru restaurant (Smoothie King) at 920 South Fifth Street. The subject property is 0.46 acres and is located in Ward 2 (RCA Attached) 6. Case No. PDA-2014-1. (SSM Health Care St. Louis – Don Wojtkowski, PE) An application to amend the previously approved Development Plan for Tract B within the Time Centre PD-C Planned Development- Commercial District. The amendment will revise the development plan and provide for a new development agreement to reflect a new medical office building and parking garage at 711 Veterans Memorial Parkway (currently occupied by The Columns Banquet Center). The property is 3.16 acres and is located in Ward 3 (Council Bill 11260) 7. Case No. TA-2014-2. (City of St. Charles) An application to amend Chapter 400: Zoning Code of the Code of Ordinances of the City of St. Charles, Missouri by amending §400.480 Temporary Retail Sales and Outdoor Display of Merchandise, Specifically to Add a Section to Regulate Special Events on Private Property (Council Bill 11258) B. Administrative Hearing: 1. Appeal of a Decision of the Historic Landmarks Preservation and Architectural Review Board to Deny the Application for the Issuance of a Certificate of Appropriateness to Replace the Wood Railing with a Metal Railing on the Front Balcony of a Building Located at 132 North Main Street. Case No. C/A 2014-02(EC) (RCA Attached) REPORT OF THE MAYOR/AWARDS/PROCLAMATIONS/PRESENTATIONS Presentation by St. Charles City School District Superintendent Jeff Marion Relative to the St. Charles R-VI School District Bond Issue (Proposition S) and Tax Levy Issue (Proposition L). The Propositions will be on the April 8, 2014 Election Ballot Councilmember Jerry Reese introduced Dr. Jeff Marion, Superintendent of the St. Charles City School District. Dr. Marion provided a brief description relative to Proposition S and Proposition L which be on the April 8, 2014 Election Ballot. Dr. Marion reminded everyone to get out and vote on April 8th and the importance of keeping our schools strong. Council President Beckering thanked Dr. Marion for his leadership and communication. Written and/or Verbal Messages from the Mayor There were not written and/or verbal messages from the Mayor. RECORD OF THE COUNCIL OF THE CITY OF SAINT CHARLES, MISSOURI March 4, 2014 ______________________________________________________________________________ PUBLIC COMMENT Bill T. Davis, 1946 Sibley, St. Charles, Missouri, voiced concerns relative to the code violation issued at property address 2209 Droste Road. Mr. Davis also voiced concerns relative to the clearing of trees and rocks eroding behind warehouses. Appeal of a Decision of the Historic Landmarks Preservation and Architectural Review Board to Deny the Application for the Issuance of a Certificate of Appropriateness to Replace the Wood Railing with a Metal Railing on the Front Balcony of a Building Located at 132 North Main Street. Case No. C/A 2014-02(EC) City Attorney Michael Valenti announced he incorrectly stated that the HLPARB decision was overturned on the Bethmann matter. The vote taken was five “yes” votes and five “no” votes. There was no majority voting to affirm the denial of the issuance of the Certificate and there was no majority vote to overturn or reverse the decision of the HLPARB. Mr. Valenti announced a second vote should be taken by the City Council to reconsider the appeal. It was determined since Mr. Bethmann had already left the meeting and would not be present for the second vote to reconsider the appeal, the second vote will be placed on the agenda for the next Regular City Council Meeting. A motion was made by LAURIE FELDMAN to refer the second vote to reconsider the appeal on the Bethmann matter to the next Regular Council Meeting agenda. And, Administration is to contact Mr. Bethmann to advise him a second vote to reconsider his appeal of the decision of the HLPARB to deny the Certificate of Appropriateness to replace the wood railing of the balcony of the building at 132 North Main Street with metal tubular railing will be on the next Regular Council Meeting agenda. JERRY REESE seconded the motion. All voted in favor, motion passed. File #48139 RECORD OF THE COUNCIL OF THE CITY OF SAINT CHARLES, MISSOURI March 4, 2014 ______________________________________________________________________________ Decision Relative to Relocation of City Council Meetings during the Period of the City Hall Parking Garage Reconstruction Project Council President Beckering announced the full Council needs to decide if the city council meetings should be relocated during the period of the City Hall Parking Garage Reconstruction Project (Project). Council President Beckering and Councilmember Reese recommended the city council meetings be held at City Hall during the period of the Project. A motion was made by JERRY REESE to hold the city council meetings at City Hall during the period of the Project. TOM BESSELMAN seconded the motion. A roll call vote was taken, with the following results: “Aye:” Besselman, Feldman, Herrmann, Ohmes, Ohms, Reese, Stivison, Weller, West and Beckering. “Nay”: None. Absent: None. Motion passed. It was the consensus of the Council, if parking becomes an issue during the city council meetings during the period of the Project, Council will have to reconsider this issue. File #48140 Director Spurgeon provided a brief update on the parking spaces which are available on Second & Monroe Streets and stated he believes parking will be available during the evenings of the city council meetings. File #48115 ANNOUNCEMENTS FROM COUNCILMEMBERS/MISCELLANEOUS Update from Council Liaisons on Boards/Commission/Committees Councilmember Jerry Reese announced the Senior Citizen Advisory Commission will be meeting on March 19th at the Police Department and following the Commission Meeting a brief presentation will be given by the Police Department regarding the P2C (Police to Citizen) module/program. Councilmember Reese invited the full Council to attend. RECORD OF THE COUNCIL OF THE CITY OF SAINT CHARLES, MISSOURI March 4, 2014 ______________________________________________________________________________ Councilmember Laurie Feldman announced the Citizens with Disabilities Advisory Board is in the process of updating the Resource Guide. Councilmember Feldman stated the update will include information pertaining to the youth, seniors and anyone with challenges. The update will be more user friendly and will be posted on the city’s website.
