RECORD OF THE COUNCIL OF THE CITY OF SAINT CHARLES, MISSOURI May 16, 2017 ______________________________________________________________________________ The City Council convened in a Regular City Council Meeting on Tuesday, May 16, 2017, at 7:00 p.m. in the Council Chambers on the fourth floor of City Hall, 200 North Second Street, with President of the Council John Hanneke, presiding, The Honorable Mayor Sally A. Faith and the Members of the Council present as follows: Tom Besselman, Dave Beckering, Bart Haberstroh, Rod Herrmann, Bridget Ohmes, Mary Ann Ohms, Vince Ratchford, Jerry Reese and Mary West. Absent: None. City Clerk Laura L. Whitehead was present and performed the duties of that office. File #48664 The meeting was opened with the Invocation, those present standing in a moment of silence, followed by the Pledge of Allegiance to the Flag. ADMINISTRATIVE HEARING The President of the Council John Hanneke announced that the following Administrative Hearing would now be held: Appeal of Case No. C/A-2017-20. Certificate of Appropriateness for 132 North Main Street At the conclusion of the hearing, the Regular Session continued with the order of business. REPORT OF THE MAYOR/AWARDS/PROCLAMATIONS/PRESENTATIONS Presentation of the Preservation Awards (Community Development) Landmarks Board Chairperson Steve Martin thanked the City Council and Mayor Sally Faith for allowing the St. Charles Landmarks Board the time to acknowledge the winners of the 2017 Historic Preservation Awards. The program recognizes the valuable contributions, hard work and financial commitment of property owners and individuals who have played an active role in preserving the City’s historic resources. The awards are presented each May during National Historic Preservation month and are for projects completed within the previous calendar year. Five project categories are eligible for the awards: residential, commercial, publicly-owned, sensitive new in-fill, and personal achievement. Chairman Martin and the Honorable Mayor Sally Faith presented the Landmarks Board Preservation Awards to the following:  David Willis, 1327 North Third Street  Robert Pecoraro, Lindenwood University, 308 North Kingshighway  Robert & Marsha Adams, 1106 North Fourth Street  Len House, 1200 North Second Street  Matt & Audrey Gorski, 115 McDonough Street  Chris Berry, Lifetime Personal Achievement in Preservation  RECORD OF THE COUNCIL OF THE CITY OF SAINT CHARLES, MISSOURI May 16, 2017 ______________________________________________________________________________ Chairman Martin ended the presentation by thanking the recipients for their contributions to preserving St. Charles’ historic resources. These projects help revitalize the City and attract new visitors and economic activity. Mr. Martin again congratulated this year’s recipients on their great work and thanked the City Councilmembers and Mayor Faith for allowing the Board the time to acknowledge the award winners and for all they do to continue to preserve and protect the City’s unique historic character. Update on Various Road Projects (Engineering) Director of Engineering Jerry Hurlbert provided a brief update on the following projects: Annual Asphalt Maintenance Repairs, Annual Crack Seal Repairs, Zumbehl/Friedens Road, Routes 370/94 Trail, Randolph Street Water Main, First Capitol and Truman Road. Councilmember Jerry Reese requested Director Hurlbert investigate the traffic signal at Dierbergs and Bob Evans. It appears the traffic signal may need to be re-set. Councilmember Tom Besselman voiced concerns relative to Council Bill 12195; more specifically, the landscaping maintenance agreement between the City and SSM has not been executed to date. Director of Administration Larry Dobrosky reported the agreement has been delivered to SSM’s legal team; however, it’s been a slow process. Mr. Dobrosky further reported SSM has verbally agreed to the terms of the landscaping agreement to both Mayor Faith and himself. Discussion ensued. Councilmember Mary Ann Ohms reported she is sponsor on Council Bill 12195 and recommends City Council continues going forward with the First Capitol Enhancement Project. Budget Amendment No. 5 (Council Bill 12208) The Honorable Mayor Sally Faith reported the 250th Anniversary of the establishment of the City of Saint Charles is being held in 2019. Artist Gary Lucy has been asked to create an oil painting interpreting the 1795 War Galley which had made its way from New Orleans to the banks of the future City of Saint Charles, which will be a very positive contribution to the journals of history. The cost of the painting is $50,000. The City of Saint Charles will be paid back for these funds by sponsors. In the meantime, the City needs a pencil drawing of the art work to show the businesses in order to obtain their sponsorships. The painting will be completed in 2018 and the celebration will be held in 2019. An email regarding this matter will be sent to the full City Council. Written and/or Verbal Messages from the Mayor The Honorable Mayor Sally Faith announced Police Chief Randy McKinley started an Officer of the Month recognition event. Mayor Faith asked Chief McKinley to come forward and provide a brief report the new recognition event. Chief McKinley reported all divisions within the Police Department are asked to nominate an officer. The recipient of Officer of the Month for April 2017 was Officer Ross Riggins.  RECORD OF THE COUNCIL OF THE CITY OF SAINT CHARLES, MISSOURI May 16, 2017 ______________________________________________________________________________ The Honorable Mayor Sally Faith read several letters she received thanking city staff members for their exemplary customer service. PUBLIC COMMENT Tracy Meyer, 808 Ruth Drive, St. Charles, Missouri, voiced concerns regarding traffic issues on Ruth Drive. Ms. Ruth requested the City look into a traffic study regarding excess speeding. Ms. Ruth further reported the City is proposing a “no parking” restriction on one side of Ruth Drive. The City has sent out letter to residents on Ruth Drive; however, only the residents on one side of the street received a letter. Ms. Meyer requested the City re-consider this parking restriction. Council President John Hanneke suggested Administration this issue addressed with the Street Committee. Approval of Liquor License Application for Elizabeth Kinney, d/b/a Cork & Rind located at 555 First Capitol Drive Councilmember Tom Besselman requested Director of Community Development Bruce Evans come forward and provide a brief overview of the liquor license application approval process and liquor license ordinance. Director Evans reported there are three type of liquor license categories in which one can apply for. There is an application for a bar, tavern and/or night club which also requires a conditional use permit, an application for a restaurant which requires 50% or more of the restaurant’s sales is generated from the sale of food, and an application to sell package liquor not for consumption on the premises. Director Evans further reported staff is encountering more frequently that the applications do not meet any of the three categories mentioned. The applicants are applying to sell liquor by the package but also want approval to sell by the drink. Councilmember Besselman spoke in opposition to sell by the drink without any regulations or conditions as currently required by ordinance. Director Evans suggested the liquor license ordinance be reviewed. Councilmember Jerry Reese reported the Farmers Market is open this Saturday from 7am-Noon and is located at the Foundry Art Centre’s parking lot.
