RECORD OF THE COUNCIL OF THE CITY OF SAINT CHARLES, MISSOURI February 6, 2018 ______________________________________________________________________________ The City Council convened in a Regular City Council Meeting on Tuesday, February 6, 2018, at 7:00 p.m. in the Council Chambers on the fourth floor of City Hall, 200 North Second Street, with President of the Council John Hanneke, presiding, and Members of the Council present as follows: Tom Besselman, Bart Haberstroh, Rod Herrmann, Bridget Ohmes Mary Ann Ohms, Vince Ratchford, Jerry Reese and Mary West. Absent: Mayor Sally A. Faith and Councilmember Dave Beckering. City Clerk Laura L. Whitehead was present and performed the duties of that office. File # 48782 The meeting was opened with the Invocation, those present standing in a moment of silence, followed by the Pledge of Allegiance to the Flag. A motion was made by ROD HERRMANN to excuse the absence of Councilmember Dave Beckering. BRIDGET OHMES seconded the motion. All voted in favor, motion passed. PUBLIC HEARING The President of the Council John Hanneke announced that the Public Hearing would now be held. At the conclusion of the hearing, the Regular Session continued with the order of business: A. Case No. Z-2017-25. (Lombardo Homes of St. Louis, LLC) An application to rezone approximately 109.90 acres of land located north of West Clay Street approximately 500 feet east of its intersection with Point West Boulevard from St. Charles County R1E Single Family Residential District, R1E/FF Single Family Residential District within the Floodway Fringe District, and R1E/FF/FW Single- Family Residential District within the FW Floodway District and FF Floodway Fringe District to City of St. Charles R-1E Single Family Residential District upon annexation. The subject property will be located in Ward 6 upon annexation. This application also includes a rezoning of 21.248 acres from City of St. Charles I-1 Light Industrial District to City of St. Charles R-1E Single Family Residential District. The subject property is located in Ward 6. The proposed R-1E District for a total of 131.15 acres will set the maximum residential density for a subsequent rezoning request. (Council Bill 12455 & Council Bill 12456) B. Case No. Z-2017-26. (Lombardo Homes of St. Louis, LLC) An application to rezone approximately 131.15 acres of land located north of West Clay Street approximately 500 feet east of its intersection with Point West Boulevard from R- 1E Single Family Residential District to PD-R Planned Development Residential District. In conjunction with the rezoning, a preliminary development plan and development agreement will be considered. The preliminary development plan proposes detached single-family residential lots, a pool house, and common open space. The subject property will be located in Ward 6 upon annexation. Case No. CU-2017-45.(David Berthold) An application for a Conditional Use Permit from §400.220(C)(1)(e) for a Motor Vehicle Service and Repair use within the C-2 General Business District located north of Barthel Avenue approximately 250 feet west of its intersection with North Third Street, known as 308 Barthel Avenue. The property will be located within Ward 8 upon annexation. (Council Bill 12461) F. Case No. Z-2018-02. (Mark Walsh) An application to rezone approximately 1.5 acres of land known as 1634 Muegge Road from St. Charles County R1E Single Family Residential District to City of St. Charles R-1C Single Family Residential District upon annexation. The subject property will be located in Ward 4 upon annexation. (Council Bill 12459) *G. Case No. CU-2018-01. (Extenet Systems, Inc.) An application for a Conditional Use Permit from §400.190(D)(1)(f) for a telecommunication antenna within the O-I Office Institution District located within City right-of-way of Droste Road west of the intersection of Huntington Park. The subject property is located in Ward 10. (RCA Attached) *Application withdrawn by the Applicant on February 5, 2018. H. Case No. TA-2017-10. (Kevin Kolasch) An application to amend Chapter 400 of the Code of Ordinances by amending §400.421Guest Houses, specifically to allow Guest House uses within the EHP Extended Historic Preservation District. Presentation by Vice President and General Manager Ward Shaw Relative to an Update on the Status of the Ameristar Casino Director of Administration Larry Dobrosky introduced Vice President and General Manager Ward Shaw who provided an update on the Ameristar Casino operations. Budget Amendment No. 4 (Council Bill 12442) Director of Administration Larry Dobrosky reported Budget Amendment No. 4, Council Bill 12442, is being introduced this evening and should anyone have questions relative to the Council Bill to please contact Director of Finance Gina Jarvis. PUBLIC COMMENT Sherilyn Blair, representing Historic Frenchtown Association, 1100 North Second Street, St. Charles, Mo., spoke in opposition to Council Bill 12453 and distributed pictures of their parking concerns. Jason Orf, representing Frenchtown, 905 N. Kingshighway, St. Charles, Mo., voiced concerns regarding Council Bill 12453 and with the current parking issues on Second Street. Jeff Besselman, 903 N. Third Street, spoke in opposition to Council Bill 12453. Kelsey Robertson, 132 N. Main Street, St. Charles, Mo., requested to yield her balance of three minutes of public comment to Tony Bethmann. Stephanie Panhorst, 132 N. Main Street, St. Charles, Mo., requested to yield her balance of three minutes of public comment to Tony Bethmann. It was reported per Council Rules of Procedure each verbal petitioner shall be allowed three minutes to present comments and therefore, the petitioners requests to yield their three minutes to Mr. Bethmann is denied. Tony Bethmann, 132 N. Main, St. Charles, Mo., voiced concerns relative the Council Rules of Procedures as mentioned above and not having the opportunity to meet with City Councilmembers to discuss his concerns. Mr. Besselman further reported he would like to know what staff and administration says about this. Councilmember Mary Ann Ohms and Councilmember Mary West reported they are not in favor of holding this bill and referring it to the Street Committee. It was further reported this bill will be voted upon in two weeks and that should be sufficient time to get answers from staff. A motion was made by TOM BESSELMAN to table Council Bill 12453 and refer it to the Street Committee. Motion did not carry due to a lack of a second.
