CITY OF STAR  COUNCIL MEETING AUGUST 4, 1998 The Star City Council met in regular session on August 4, 1998. Mayor Watson presiding. Roll call: Amsden, Winkle, O’Connor, Kirtley, Embury. Absent: Ross Moved by Kirtley and seconded by Amsden to approve the minutes of July 7, 15, and 28, 1998 as presented. Motion carried. 97-25-PDC Final Development Plan-Gene and Mary Veldhouse for a planned commercial development for a multi-use commercial building in the C-2 (Highway Commercial) zone. The property contains 0.16 acres and is located at 11145 W. State St., Star. Jeff Patlovich, Ada County Development Services Director, made presentation regarding the development plan. Moved by Kirtley and seconded by Embury to approve the development plan and findings of facts as presented. All aye: motion carried. PUBLIC HEARING: Ordinance #11-An Ordinance of the City of Star, Idaho, providing for interim land use regulations pursuant to section 67-6524, Idaho Code; making findings, adopting provisions of the Star Interim Zoning Ordinance; providing that this Ordinance shall be in effect no longer than one (1) year; and providing an effective date. Barbara Montgomery, City Clerk presented the zoning ordinance to the Council and members of the community. The City Attorney, Dave Bieter pointed out some minor corrections to the ordinance and the fact that this is an interim ordinance for one year. Mayor Watson declared it was the time and place for a public hearing on the City of Star Zoning Ordinance and Zoning District Map. Those giving public testimony were: Dennis Stegenga-opposed Gail Glasgow- opposed Heidi Carlson- concerns Pam Levitt- concerns Larry Hazeltine- concerns April Hardy-concerns Connie Martin-opposed (testimony submitted in writing) Bill Cronk: opposed Concerns of the public: Objections to agricultural and manufacturing districts within the city, objections to the inclusion of airports and gravel extraction in the city. There were questions about annexation, and land use. Comments were received about typographical corrections in the Page 1 of 4 document. Written documentation was read objecting to the residential zoning in a present commercial district, the commercial land use has not been exercised for 10 years. The public hearing closed at 8:20 p.m. After considerable discussion it was moved by Kirtley and seconded by Embury to table the issue until the next regularly scheduled meeting date. Aye: Kirtley, Winkle, O’Connor, Embury. Nay: Amsden. Motion carried. Discussion continued regarding the timetable and it was moved by Winkle and seconded by O’Connor to reconsider the previous motion. Aye: Kirtley, Winkle, O’Connor, Amsden. Nay: Embury. Motion carried. Moved by O’Connor and seconded by Embury to postpone the issue for 30 days providing there are established 2 workshops in order to present the comprehensive plan map so the zoning ordinance and comprehensive plan work together. Aye: O’Connor, Embury. Nay: Winkle, Kirtley, Amsden. Motion failed. Moved by Winkle and seconded by Amsden to approve the City of Star Zoning Ordinance and Zoning District Map on an interim basis at this time. Roll call on the motion resulted as follows: Aye: Winkle, Amsden, Kirtley. Nay: O’Connor, Embury. Motion carried. Ordinance No.10: An Ordinance of the City of Star, Idaho, relating to the regulation of cable television within the corporate limits of Star; providing for related matters; and providing an effective date. Moved by Amsden and seconded by Winkle that pursuant to Idaho Code, Section 50-902 the rule requiring an ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 10 be considered after reading once by title only. All aye: motion carried. Moved by Amsden and seconded by Winkle to adopt Ordinance No. 10 as presented. Roll call on the motion resulted as follows: Aye: Winkle, Amsden, Kirtley, O’Connor, Embury. Motion carried. Ordinance No. 12: An Ordinance of the City of Star amending Ordinance No. 5, to delete reference to the Ada County Building Regulations, Officials designated by Ada County as persons responsible for enforcement of Titles 7 and 8 of the Ada County Code, Ada County Zoning, and Sections, Maps, and Land Use Designations of Ada County Comprehensive Plan related to all lands within the City of Star; adopting the current version of the Uniform Building Code, Volumes 1,2, and 3, regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition conversion, occupancy, equipment, use height, area and maintenance of all buildings in the City of Star; providing for the issuance of permits and collection of fees therefore, providing for related matters and providing an effective date. Moved by Amsden and seconded by Kirtley that pursuant to Idaho Code, Section 50-902 the rule requiring an ordinance to be read on three different days, with one reading to be in full, be Page 2 of 4 dispensed with and that Ordinance No. 12 be considered after reading once by title only. All aye: motion carried. Moved by Winkle and seconded by Kirtley to adopt Ordinance No. 12 as presented. Roll call on the motion resulted as follows: Aye: Winkle, Amsden, Kirtley, O’Connor, Embury. Motion carried. Renewal Agreement: Renewal of Agreement No. 3298 – Agreement between the City of Star and Ada County for processing zoning and building permits. No action taken. Ordinance No. 13: The City Attorney introduced a substitute ordinance providing for interim subdivision regulations. He advised the Council that with the passage of the zoning ordinance it would be necessary to pass subdivision provisions. Since the city does not have those provisions he is proposing Ada County’s subdivision ordinance as interim subdivision regulations. This is an emergency ordinance of the City of Star, Idaho, providing for interim subdivision regulations pursuant to the provisions of Section 67-6523, Idaho Code; adopting by reference the Subdivision regulations of the Ada County Code; providing that this Ordinance shall be in effect no longer than 120 days; and providing an effective date. Moved by Amsden and seconded by Winkle that pursuant to Idaho Code, Section 50-902 the rule requiring an ordinance to be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 13 be considered after reading once by title only. All aye: motion carried. Moved by Amsden and seconded by Winkle to adopt Ordinance No. 13 as presented. Roll call on the motion resulted as follows: Aye: Winkle, Amsden, Kirtley, O’Connor, Embury. Motion carried. Attorney’s report: none City Clerk’s report: The City Clerk and Mayor will meet with ITD officials on August 12 to discuss the speed limit in the Star downtown area. The Council will receive a report at a later date. Claims Against the City: The City Clerk asked Council to approve the claims as presented with one addition. The Senior Citizen Center has provided a location to meet on 3 occasions. They normally charge $35 for the use of the room for 4 hours. This sum needs to be paid. Moved by Winkle and seconded by Kirtley to accept the claims as presented with the additional claim for the Senior Citizen Center. All aye: motion carried.
