CITY OF STAR
COUNCIL MEETING MINUTES
AUGUST 20, 2001
A regular meeting of the Star City Council was called to order on August 20, 2001 at
7:00 pm at the Star Fire Department, Mayor Gussie O’Connor presiding.
ROLL CALL: Glasgow, Stegenga, Dias, Benedict; all were present
AMEND AGENDA: Stegenga moved to amend the agenda to add 3a - COMPASS
presentation, Glasgow seconded the motion. All aye: motion carried.
APPROVAL OF MINUTES: Dias moved to approve the minutes of August 7, 2001 as
presented, Glasgow seconded the motion. All aye: motion carried.
A. COMPASS Presentation – Stegenga accepted an award on behalf of the Mayor
for Storm Readiness from the Weather Service. This certificate was given to the
six incorporated cities in Ada County.
PUBLIC HEARING: Westpointe Subdivision Preliminary Plat
The Mayor opened the public hearing and asked Council if there was any conflict of
interest or exparte contact. The Council had no conflict or exparte contact. The Mayor
asked for staff report.
Berent read the staff report explaining that this parcel was zoned R1, was 29.51 acres.
Letters have not been received from ACHD or Star Sewer & Water District. This parcel
has been before Ada County as a two parcel development. Jaglowski concurred with
Berent and stated that he to had reviewed the application and found an additional six
items that should be included in the application. Jaglowski referenced his letter of July
13, 2001.
The Mayor asked the applicant to speak.
Dave Roylance, Roylance & Associates, 391 W. State Street, Eagle, Idaho – Roylance
stated that they had previously met with ACHD when the parcel was to be just two lots
and they did not have a problem with the roads then. They would again meet with
ACHD to review this new application. Roylance stated that they have made the six
corrections that the City’s Engineer requested.
Stegenga asked about ACHD and their usual request for stub streets for adjacent
properties and asked if street names had been approved. Roylance stated that the street
has not changed from the first time it was presented to ACHD and they had no problems.
The street names are currently being approved.

Stegenga and Benedict would like to see the response from ACHD before any decisions
are made.
Glasgow asked if the parcel has been annexed into the Star Sewer and Water District.
Roylance stated that it was in the process now.
Benedict asked about pathways for kids and asked that the blackberries not be torn out.
The Mayor and Stegenga also concurred on the pathways for kids. Roylance stated that
the ditch company may have a problem with the developer building a bridge but it could
be looked into. Benedict stated that he liked the fact of larger lots.
There were no written comments from the public. The Mayor asked for comment from
the public.
Brad Carlson, 960 S. Main, Star, Idaho stated that he was excited about the larger lot
development. He thanked the developer.
The Mayor closed the public hearing.
Stegenga asked about the number of lots. Berent showed Stegenga the other lots.
Glasgow moved to delay this preliminary plat until we have received response from
ACHD and the property is annexed into the Star Sewer and Water District, have a
drainage plan, landscape plan, Stegenga seconded the motion.
Discussion: Dias is in favor of the subdivision but would like to see the responses.
Moore stated that we can either postpone the matter to a date certain or table the matter.
If tabled, a motion will be required later to bring the matter off the table and place it on
the agenda.
Glasgow moved to amend his motion to table this application until we have received a
response from ACHD and Star Sewer and Water, and to see the drainage, and landscape,
path and lighting plans, Stegenga seconded the motion. All aye: motion carried.
OLD BUSINESS:
A. Findings of Fact and Conclusion of Law – Strickland: Stegenga moved to
approve the Findings of Fact and Conclusion of Law for Strickland property, Dias
seconded the motion. All aye: motion carried.
B. Star Church - The Mayor asked for Council comments. The Mayor asked the
City Attorney to speak on the subject. Moore discussed the options the City has. Cities
can only act for public purposes. The City can lease property to a private entity. The
City can’t partner with private organizations to the extent of guaranteeing any debt.

Regarding the options presented: 1- is clearly legal (an option to purchase); 2- the City
can’t issue bonds or incur debt for the benefit of a private entity; and 3) is an option to
have financing by a third party either by lease or purchase.
Glasgow moved to drop this discussion for now, Dias seconded the motion. Discussion:
Benedict would like everyone to keep this in mind. Vote: Glasgow, Stegenga, Dias –
yes, Benedict – no; motion carried.
C. Street Lights – Glasgow stated that the Transportation Committee gave the
Council street light types to review and we need to have a decision. The grant that we
will be using will end on December 31, 2001.
Benedict stated that he wants the hoods on these lights to prevent light pollution.
Stegenga moved to accept the Transportation Committee’s recommendation and wants
costs brought back to the Council and to have it included in the Subdivision Ordinance,
Dias seconded the motion. Discussion: Glasgow asked that this not be put in the
Subdivision Ordinance, but have as a separate amendment. Stegenga amended his
motion to accept the Transportation Committee’s recommendation, with costs brought
back to the Council and have the lighting as a separate standard, Dias seconded the
motion. All aye: motion carried.
D. Boyer Property – We will have estimates of repair in tomorrow. Stegenga
discussed issues of what had to be changed and what didn’t regarding bringing the house
up to code.
Benedict suggested that the Council tour the Church.
E. Senior Center – Discussion was held on what the City could do for the Senior
Center. The City is prohibited from donating monies to private businesses or
organizations. A suggestion was to hold at least one meeting at the Senior Center and to
pay rent for the use of the building.
Stegenga moved to waive all building fees for the Senior Center, Dias seconded the
motion. Discussion: Benedict asked to have Ada County called to find out how they
fund the Senior Centers. All aye: motion carried.
RESOLUTIONS & ORDINANCES:
A. Ordinance No. 60 – Budget Appropriation: It was moved by Glasgow and
seconded by Stegenga that pursuant to Idaho Code, Section 50-902 the rule requiring an
ordinance to be read on three different days, with one reading to be in full, be dispensed
with and that Ordinance No. 60 be considered after reading once by title only. All aye:
motion carried.

Glasgow moved to adopt Ordinance No. 60 an Ordinance, to be termed the Annual
Appropriation Ordinance of the City of Star, Idaho, for the fiscal year commencing
October 1, 2001, and ending on September 30, 2002, appropriating sums of money in the
aggregate amount of $401,560 to defray all necessary expenses and liabilities of the City
of Star for said fiscal year; specifying the object and purposes for which such
appropriations are made and the amount appropriated for each object and purpose;
authorizing the certification to the County Commissioners of Ada County, Idaho, the
amount of $121,876 in property taxes to be levied and assessed upon the taxable property
in the City; providing for the filing of a copy of this Ordinance with the office of the
Idaho Secretary of State as provided by Law; providing for publication; and providing an
effective date. Dias seconded the motion. Roll Call: Glasgow – yes, Stegenga – yes,
Dias – yes, Benedict – yes; motion carried.
B. Ordinance No. 61 – Strickland Annexation/Zone – Stegenga read for the first
time, by title only Ordinance No. 61. An Ordinance annexing to the City of Star certain
real property located in the unincorporated area of Ada County, Idaho, and contiguous to
the city of Star; establishing the zoning classification of a portion of the annexed property
as C-2 General Business District and the zoning classification for the remainder of the
property as MU Multiple Use District; directing that certified copies of this Ordinance be
field as provided by law; providing for related matters; and providing an effective date.
C. Ordinance No. 62 – Integrity Group Annexation/Zone (second reading) – Dias
read by title only Ordinance No. 62 an Ordinance annexing to the City of Star certain real
property located in the unincorporated area of Ada County, Idaho, and contiguous to the
City of Star; establishing the zoning classification of the annexed property as R-3
Residential District; directing that certified copies of this Ordinance be filed as provided
by law; providing for related matters; and providing an effective date.
D. Resolution No. 01-5 – General Election – Glasgow moved to adopt Resolution
No. 01-5 proclaiming a general election. Dias seconded the motion. Discussion:
Stegenga asked to have a question put on the ballot regarding asking the Citizens of Star
if they would like to see the Sewer & Water District and the City be one entity. Moore
recommended that this be done by separate resolution. All aye: motion carried.
Glasgow moved to have Moore draw up a resolution for the ballot asking the public if
they would like to see the Star Sewer & Water District and City of Star be one entity,
Stegenga seconded the motion. All aye: motion carried.
ADJOURNMENT: Dias moved to adjourn the meeting, Stegenga seconded the motion.
All aye: motion carried. Meeting was adjourned at 8:35 pm.
