., City Of Star ) Council Meeting Minutes July 20, 2004 Mayor Nathan Mitchell called the regular meeting to order at 7:00 pm and all stood for the Pledge of Allegiance. Roll Call: Councilpersons Tammy McDaniel, Dustin Christopherson, Tom Erlebach and Chad Bell - all were present. Approval of Agenda: Bell moved to approve the agenda, Christopherson seconded. All aye: motion carries. Consent Agenda: Christopherson moved to approve the Consent Agenda consisting of: Approval of July 6, 2004 Regular Meeting Minutes, Findings of Fact & Conclusions of Law for Tempe Park Preliminary Plat/Variance and Roylance Comprehensive Plan Map Amendment/Rezone, McDaniel seconded. All aye: motion carried. Dr. Robert Freilich Agreement/Resolution - The Mayor reviewed the agreement. The City's portion is $20,000.00. Craig Eckles, Zoning Administer reviewed the Freilich Report. Star won't have individual voting rights with this agreement, but ifwe don't adopt the plan - there is no legal jurisdiction for it to be enforced. Money will disperse in ) two phases. There will be 20 representatives on the Steering Committee. We will have one direct representative with more input from other agencies. Alli2.roval of Resolution - Bell moved to approve Resolution 2004-05 approving an Intergovernmental Agreement for Ada Countywide Transportation and Land Use Guide Plan and Implementing Comprehensive Plan Land Use and Transportation Plan Elements and Land Development Regulations. (read the title), Christopherson seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach, Bell - all aye: motion carried. Ordinances & Resolutions: Animal Control Ordinance - choices of licensing are City Hall, IHS, veterinarian. Erlebach stated that Zack Brunnel, our new vet would be open to licensing dogs. Martha Sexton, Star Road, Star, believes vets licensing dogs is a conflict of interest. The Idaho Humane Society (IHS) officers are the only officers that can determine dangerous or potentially dogs. Chad believes licensing should be done at all three agencies also. Timeframe for barking dogs - thirty minutes. ; . Fees - The Council agreed that fees should be the same as IRS. Park Regulations Ordinance - General hours ½ hour after sunrise and ½ sunset. Section I - leave same. Parade & Public Assembly - Ordinance - Ordinance Amending Ordinance No. 92 Prohibiting Dogs in Parks - It was moved by Christopherson and seconded by Bell that pursuant to Idaho code, Section 50-902 the rule requiring an ordinance be read on three different days, with one reading to be in full, be dispensed with and that Ordinance No. 109 be considered after reading once by title only. Roll Call: McDaniel, Christopherson, Erlebach and Bell - all aye - motion carried. Christopherson moved to adopt Ordinance 109, an Ordinance of the City of Star, Idaho, amending Ordinance No. 92 an Ordinance prohibiting dogs on publicly owned, posted property within the Star City limits; providing for fines; providing for related matters; and providing for an effective date, McDaniel seconded the motion. Roll Call: McDaniel, Christopherson, Erlebach and Bell - all aye: motion carried. 2004-2005 Budget Review - Mayor Mitchell reviewed the expense worksheet, income worksheet and budget line items. It was the consensus of the Council to leave the budget as presented for public hearing. The Mayor reviewed the area of impact status. The meeting before the Ada County Commissioners is scheduled for September 29, 2004. Adjournment - Erlebach moved to adjourn the meeting, Christopherson seconded the motion. All aye: motion carried.
