STAR CITY COUNCIL REGULAR MEETING MINUTES City Hall - 10769 W State Street, Star, Idaho Tuesday, May 18, 2021 7:00 PM Agenda Item 1) CALL TO ORDER-Mayor Chadwick opened the meeting at 7:00pm and welcomed those in attendance. Agenda Item 2) INVOCATION -TJ Warren with the Interfaith Group led the invocation. Agenda Item 3) ROLL CALL - Present were Mayor Trevor Chadwick, Council President David Hershey; Council Members; Michael Keyes via Zoom, and Jennifer Salmonsen. Kevin Nielsen was absent from Roll Call but did arrive at 7:48 pm for the Executive Session. Staff present were City Attorney Chris Yorgason, Public Information Officer Dana Partridge, City Planner Shawn Nickel, and Assistant City Planner Ryan Field. Agenda Item 4) PUBLIC INPUT - Mayor Chadwick opened the Public Input portion of the meeting and advised those on the list to state their name, address and speak clearly into the microphone when they speak. Albert Dauven, 22020 Blessinger Road, Star, ID Mr. Dauven says that Blessinger Road is not adequately built for Hunter Homes and according to Chris at CHD4 the road is 26 feet wide and is not to CHD4 standards. He asked that the City check with CHD4 to have the road done correctly. He is voicing his opinion based on the advice of an attorney who said he should. The turnaround may have been adequate in 2007 but is not today. Mayor Chadwick advised Mr. Dauven that the road will have to be built to CHD4 standards before a building permit can be issued. Greg Lively, 10232 W. Shumard Dr, Star, ID Mr. Lively started to talk about a development that is scheduled for a future Council meeting and Mayor Chadwick advised that he could not talk about this development until the public hearing date and encouraged Mr. Lively to attend the public hearing. Mr. Lively then asked if he could talk about development in general and was advised that he could. Mr. Lively then spoke that he just moved to Star about 5 ½ months prior from California and that there is an increase in traffic. He thinks developments can build with less density, that the roads are already crowded and will become more so and implores the Council to make the best decisions. Mayor Chadwick again encouraged Mr. Lively to speak at the public hearing, gave him a card and said that he would be willing to speak with him personally ifhe wanted. Agenda Item 5) AWARDS Matt Vraspir, Chairman of the Park, Arts & Beautification Committee presented the 2nd quarter Service Award to Pat Gore. Gore has been a long time City resident and volunteer with the Star Lion's Club. She is moving out of the City but promised to be come back and visit often. Agenda Item 6) COMMITTEE REPORTS: Transportation & Pathways Committee - John Tenson provided the update and stated that they have added 2 new members to the committee, Steve Green, a retired transportation engineer and Richard Girard who has 20 plus years in the transportation industry and last served as the Director of Golden Gate Highway District. Mr. Simpson and Council Member Salmonsen are taking the lead on cataloging the various pathways in developments and along the various waterways as a first step in the masterplan for pathways. They submitted 4 grant requests to COMPASS. 1) Floating Feather to the Star Middle School Pathway design. 2) Star River Walk addition and paving from highway 16 to Star Road. 3) The Star downtown parking study. 4) Highway 44 sidewalk inventory and study. The preliminary review of the grant applications was held on May 12th. Mayor Chadwick attended and answered questions from COMPASS. COMPASS will meet again on the May 26th. Parks, Art & Beautification Committee - Matt Vraspir provided the update. The committee is ready to begin installation of the lifesaving stations in June. They have 25 HOAs that have agreed to have the committee install them within the subdivisions. They will also place these on the River Walk and eventually along the ponds at Heron River. Mayor Chadwick said that Justin May, owner of Firehouse Subs, helped to raise $6k for these stations in donations from local businesses and thanked him for his efforts. The Star Senior Center was revitalized recently which was a spur of the minute project. The committee received donations from the community. The group cleaned up the yard and planted some flowers which turned out great. The next committee meeting will be May 24th, and they will begin putting a master parks plan together with help from Council Member Salmonsen. Thanks to the Mayor and Council for the approval of the mural to be done at the Star Senior Center. Vraspir asked about a completion date. The Mayor said that some questions need to be answered and then the project can begin. Pack it in-Pack it Out- the committee is going to put some signage up on the parks to help remind people that if they brought it in with them, it should leave with them. The hope is that trash bins will not overflow and cause trash to blow around. Just Serve - Vraspir met with them and will be using their help in the installation of the life preserver rings. The group wants to be involved more in the community. On May 241\ the committee will begin working on their float for the Hometown Celebration. Council Member Michael Keyes has provided them a lead on a tractor to pull the float. Hometown Celebration - Partridge met today with tee shirt vendors for bids. They will have the tractor on them that everyone seems to like from a couple of years ago. They will do some pre-sale and then also sell shirts at the event. The Mayor's youth council will be handling the presale of the shirts. Donations of $40k in corporate donations were raised for the Hometown Celebration. All permits have been submitted to ITO and ACHD for a Special Event Permit on a public highway. The Committee is also working with Central District Health for the food vendor approvals. June 11 is the first concert of the summer at the River House. The band is called "Shot Glass." June 25 is the first movie night at the River House. The movie has not yet been selected. The committee is working on obtaining a projector for these events. Historical Committee - Council President David Hershey provided a brief update. The committee held their first meeting since the last update. They have another one scheduled this week. They have selected two Co- Chairman, Chip Sitton and Nate Day. The committee will be establishing how to collect items and how they might be preserved or displayed. Council President Hershey talked about how important the volunteer service is to the community and pointed to all the updates that were just given and the great work that is going on around the community. Star has a big heart. Mayor's Youth Council-No Update. Agenda Item 7) CONSENT AGENDA: {ACTION ITEM} • Council Member Keyes moved to approve the Consent Agenda items; Approval of Claims Provided. Approval of Minutes Completed. Findings of Fact for River Park Subdivision Annexation, Development Agreement and Preliminary Plat (AZ-21-01/DA-21-02/PP-21-04). Loran Estates Subdivision Annexation, Development Agreement, Short Plat and Private Street (AZ21-02/DA-21-03/SP21-0l/PR- 21-03) Greyloch Cabinetry Conditional Use Permit Modification for Height Exception (CUP-20-04- MOD). Final Plat for Sunfield Estates Subdivision (FP-21-02). Removing item I, Paint Point Subdivision Short Plat and Private Street (SP-21-02/PR-20-06) from the agenda and Moving item V. Wildrye Subdivision Preliminary Plat and Development Agreement Modification /PP-21-02/DA-21-0J-MOD) to Agenda Item 8b. Council Member Salmonsen seconded the motion. Voice vote indicated all members present signifying aye. Motion carried. Agenda Item 8) DISCUSSION/ ACTION ITEMS: SA) City of Star Resolution 2021-02. A Resolution Authorizing The City Treasurer To Pay Certain Vendors Prior To Submitting The Bills To The Council. Mayor Chadwick explained that this resolution was to help the City to pay bills more regular to avoid late fees and interest on regular bills. Anything that is out of the ordinary would still come to the Council for approval and he fully supports adopting this resolution. • Council President Hershey moved to approve City of Star Resolution 2021-02. Council Member Salmonsen seconded the motion. Council Member Salmonsen asked about the fees on debit cards. City Attorney Chris Yorgason advised that the bills will still come before the Council and they can ask questions, however the bills will have already been paid. Voice vote indicated all members present signifying aye. Motion carried. 88) Wildrye Subdivision Preliminary Plat & Development Agreement Modification (PP-21-02/DA-21-02- MOD) City Planning Director and Zoning Administrator Shawn Nickel presented the modified language that is being added to the Development Agreement. On page 11 of the Findings of Facts, Statement of Compliance; Bullet 1 should read. o "The public is permitted to use the proposed pathways within the new development. This will be a condition in the development agreement and part of the CC&R's." Bullet 2 should read. o "If the City includes the Middleton Canal in the upcoming City Pathway System, the applicant shall grant a public easement to accommodate a IO-foot wide, paved and ADA compliant public pathway along the canal. This will be a condition in the development agreement and part of the CC&R's." Bullet 3 should read. o "The applicant shall work with the City Staff and the developer of Craftsman Estates to come up with solutions to the issue of removal of the 2-foot buffer area between the two subdivisions. The applicant and/or City Staff shall update the neighbors on the proposed solutions and provide the Council a summary of those communications." • Councilman Keyes moved to approve the Findings of Fact for Wildrye Subdivision. Council President Hershey seconded the motion. Voice vote indicated all members present signifying aye. Motion carried. Agenda Item 9) REPORTS Agenda Item 9A) Elected Official Reports Council Member Keyes reported he received communication from the Middleton Mill Irrigation District that they are planning on a shorted irrigation season due to low snowpack. CDH4 is nearing the process to submit the impact fees to the Council and this has been added to the June 15th Council agenda. Council Member Keyes also asked to have a discussion of HB389 added to a future Council agenda. Mayor Chadwick commented that it has been added to the June 1st agenda already. She was fitted for gear already and after having all the gear on for 15 minutes, she earned a whole new level of respect for our fire fighters. She will report her experience at the next Council meeting. Both Mayor Chadwick and Council President Hershey have been through this training and told Councilwoman Salmonsen that she will have a great time, an experience she will never forget. Council President Hershey reported that he and Mayor Chadwick were able to participate in the Emergency Vehicle Operators course held at POST. He more fully understands how stressful it is on the police in just getting to the scene of a call, let alone the call itself. He provided updates earlier in the meeting. Mayor Chadwick reported that Deputy Moorehouse is a Master Trainer for the Sherriffs Department, and the City of Star is lucky to have him in Star. The bids will be opened on May 27th and the goal is that 'w%� �M,.t�g�)h�rtly after. .. • �-':. :��..,-4• Agenda Item 9B) Staff Reports Police Chief Jake Vogt reported that over 200 kids are signed up for the fishing rodeo already and encouraged youth to come out and enjoy the fun. Signups are not required but useful to help provide enough supplies for everyone. It will start at IO am and run to approximately 1:00 pm. IDF&G will be stocking more fish to help ensure that the catch rate is high. There will also be a casting contest as well. IDF&G waived the licensing requirements and ACSO was given an education permit for this activity. The event will just take place in the west pond. Assistant Planner Ryan Field provided an update on the South of the River plan. Logan Simpson has delivered the product that will be on the June 1st meeting to present to the Council for adoption. Public notice has been posted properly and we will follow the same process for June 15th and adoption of the architectural overlay component. Logan Simpson will have someone present in person on June 1st . Ryan will work with Dana and get these items on the website. Agenda Item 10) EXECUTIVE SESSION 74-206 (f): • Council President Hershey made a motion for the Council to enter executive session under Idaho 74- 206(f), to communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated; Council Member Keyes seconded the motion. Roll Call vote of all members present signified aye. Motion carried. Council entered executive session at 7:48 pm.
