CITY OF STAR SPECIAL  COUNCIL MEETING September 1, 1999 The Star City Council met in regular session on September 1, 1999. Council President Amsden presiding in Mayor Watson’s absence. Roll call: Amsden, O’Connor, Winkle, Dias, Pearson, Kirtley. Moved by Winkle and seconded by Dias to approve the Minutes of August 5, August 12 and August 23, 1999 as presented. All aye: motion carried. PUBLIC HEARING: City of Star Subdivision Code Adell Heneghan, City Engineer and Planner gave the staff report. Ms. Heneghan introduced the ordinance and stressed that the ordinance is the City of Star’s and not any other governing agency. She will introduce recommendations from ACHD and Ada County and asked for the recommendations to be reviewed carefully. The subdivision ordinance is an important part of the Area of Impact agreement negotiations and asked that be considered significant in these evenings proceeding. The recommendations of ACHD and Ada County Development Services were reviewed, along with the Zoning Administrator and City Engineers comments and suggestions. The City Attorney, Dave Bieter was asked to clarify the issue of dedication and condominiums and return his recommendations to Council. Council President Amsden declared it was the time and place for a public hearing on the Subdivision Ordinance for the City of Star. The time was 7:45 p.m. Testimony: David Shackley-questions and concerns Dennis Stegenga-opposed Gail Glasgow-opposed Patricia Nilsson-comments only Concerns of the public: open space/roads: (open space not necessarily public, and concerns about 15% required open space and drainage), bike paths, lack of definitions on frontage roads, half streets etc., street light standards, dedications (is the city required to accept dedications), natural features mapping for the areas of critical concern, clustering and future roads. The Public hearing portion of the meeting was closed at 8:30 p.m. Page 1 of 2 Moved by Kirtley and seconded by Pearson to accept the changes as proposed by the City Engineer and Zoning Administrator. All aye: motion carried. Kirtley amended the motion to accept changes with the exception of changes that will be submitted by the City Attorney. Winkle seconded the motion. All aye: motion carried. Moved by Winkle and seconded by O’Connor to change the portion of the ordinance that reads street lights in the area of impact and City boundaries are dedicated to the City to all street lights within the boundaries of the City are dedicated to the city, those in the impact area are not dedicated to the City. All aye: motion carried. Moved by O’Connor to notice another public hearing on the Subdivision ordinance. Motion dies for lack of a second. Moved by O’Connor and seconded by Kirtley to re-open the public hearing to finalize the subdivision ordinance after the attorney has submitted his comments. All aye: motion carried. The City Attorney informed the Council that the judge denied the intervention the city was seeking on the airport issue. ORDINANCES: Ordinance #31-City of Star Subdivision Ordinance was tabled. Moved by Winkle and seconded by Kirtley to adjourn the meeting. The time was 9:05 p.m. All aye: motion carried.
