BOARD OF CODE APPEALS
REGULAR MEETING
September 8, 2016
SUBJECT: The minutes of the Board of Code Appeals meeting of October 13 , 2016.
The meeting was called to order by Chairman Johnson at 6:01 pm
MEMBERS PRESENT: Douglas Harvey, Laurel Johnson, Terry Measel,
Thaddeus Stanek, Thomas Szatkowski

APPROVAL OF AGENDA
Motion by Stanek, supported by Measel, to approve the agenda as presented.

CONSIDERATIONS
1. PG16-0201 – SLM Windmill LP (John Berry, CR Architecture & Design) -
Property address: 2121 Eighteen Mile Road
Requesting Board approval to classify proposed new Kroger building as an
unlimited per Section 507.3. Building to be constructed with zero setback
adjacent to the existing strip mall Section 507.5 requires 451 setback.
John Berry, Architect with CR Architecture & Design, was present. Daniel
Carper, with Kroger, was present. Mr. Berry stated that this project is a new
Kroger store that is a ground lease. They are proposing a 4 hour rated wall on
the Kroger wall on the ground lease side and a two hour wall on the retail center
with a total of 6 hours of separation. They are expanding into the other tenant
spaces and it will be a new wall. On the north face of the Kroger store they have
turned that 4 hour wall to run at an east, west manner for a distance of 60 feet
fundamentally all the way around a building.
Mr. Stanek asked Mr. Berry what will be in the existing building where the
additional two hour wall is. Mr. Berry stated that it is an existing strip center with
tenants in it now and the owner of the property is looking to fill the vacancies. Mr.
Berry explained that Kroger is expanding and taking out two or three tenants. Mr.
Measel stated that they are taking the four hour wall all the way around the rear
corner. He wanted to know why it is not being done in the front. Mr. Berry stated
that they are putting in a two hour wall all the way to the face of the Kroger
building and then from the face of the Kroger building on out is their property. Mr.
Berry stated that there is an existing canopy that extends over to the two hour
wall. Along the front façade they have a café. Mr. Measel stated that the wall is
around the corner. Mr. Berry stated that the two hour wall would protect. Mr.
Measel stated that he understands them wanting windows in the café but how
about half the windows instead. Mr. Berry stated that the windows into the café
are very important to them. Mr. Measel stated that they took great care in
protecting the back corner with the four hour wall but not with the front corner with
the two hour wall. He suggested them to eliminate the two windows and bring the
four hour wall around the corner. Mr. Carper stated that is something that would
have to be approved by their store team. He stated that that area has a drop
ceiling that is 10 feet high and it would feel like a cave without the windows. Mr.
Measel stated that if there is a 10 foot ceiling and windows on the lower lever
than the upper masonry can be four hours. Mr. Berry stated they could and they
could put a fire shutter at the windows. Mr. Measel stated that his concern is fire
coming around the corner. He stated that they could have fire curtains over the
first two windows and bury it into the 10 foot ceiling and right into the fire
suppression system. If the alarm goes off then the fire curtains come down. Mr.
Berry stated that is something they will look into.

An email was provided that they are moving forward to put fire protection on the
test track building. They will not be coming back to this Board for what was
denied or tabled at the last meeting.

2016.
