Mr. Viazanko indicated that he is in receipt of a list of people notified by mail of tonight’s
meeting.
CORRESPONDENCES
Mr. Viazanko indicated that he had five correspondences for tonight. They are as follows: G12-

is no further cause for action.
CONSIDERATIONS
G12-0135 Williams, Christina
12486 Fleet Court. Asking Board approval to erect 6’ privacy fence in secondary front yard
setback of Clifford Street.
Christina Williams, homeowner, stated that she is replacing her current fence that the original
owner put up with no permit. Her neighbor has the identical fence and was given his variance
and permit. Kevin Temrowski, owner of Michigan Fence, was also present and stated that there
are no visual obstructions to be concerned with. Commissioner Cooper said that he drove by the
property and sees no issues with the site line, other driveways, etc. He added that he is glad to
see that Ms. Williams and her neighbor replaced the fences, as they will enhance the street.
Motion by Commissioner Cooper, Supported by Commissioner Hartson to approve case G12-
0135 at 12486 Fleet Court providing 1 – that the petitioner agrees to abide by and comply with
all applicable rules and regulations and orders of every lawful agency or governing authority
having jurisdiction, 2 – that the decision of the board will remain valid and in force only as long
as the facts and information presented to the board in public hearing are found to be correct and
that the conditions upon which the motion is based are maintained as presented to the board.
G12-0137 Juraszek, Julianna
43517 Peninsula Drive. Hearing on nuisance abatement at this location for roof in disrepair.
Paul Geiger, Code Enforcement Coordinator, stated a couple of violation notices were sent. As
of today, there is no change. The following violation still exists: roof in disrepair. Pictures were
shown at this time.
Julianna Juraszek stated that she is seeking a loan to pay for the equipment. She has a friend that
will do the repair at no charge. Ms. Juraszek said she has an application for the Home Property
Improvement Program/CDBG and has talked to Stephanie Burgess, who told her not to pull the
permit yet. Commissioner Cooper asked Ms. Juraszek why she hasn’t filled out the application
yet, noting that she contacted Stephanie Burgess in December, 2011. Ms. Juraszek said that
under the CDBG guidelines, her friend would not be able to perform the work because he wasn’t
an approved contractor for CDBG. Commissioner Cooper asked if the roof was leaking. Ms.
Juraszek said that she had it looked at and it is not leaking. Commissioner Cooper asked how
long the approval process would take and informed her that there needs to be an end date. Ms.
Juraszek said Stephanie Burgess told her that it all depends on how many people are applying
and what their situations are. Commissioner Cooper asked Mr. Viazanko if the work was abated
and performed by the city’s contractor, and then Ms. Juraszek received approval, could she be
reimbursed. Mr. Viazanko stated, no. Commissioner Cooper then asked how long an
application typically takes to get approved. Mr. Viazanko said that it would probably take about
30 days, as it’s a very thorough process. Commissioner Pittrone said that during the application
process, Ms. Juraszek’s friend wanting to do the repairs will have time to get proper approval
with CDBG. Commissioner Cooper thought that pushing the end date to July 31, 2012 is more
than fair.
Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public
nuisance exists on the property commonly known 43517 Peninsula Drive and to direct the Code
Official to abate the violations identified in the attached staff report after July 31, 2012. The
Board also authorizes and approves the imposition of a lien against the property, in the amount
of the cost of abatement incurred by the City, as permitted by the applicable city ordinance.

Official to abate the violations identified in the attached staff report immediately. The Board

12224 Cardova Court. Hearing on nuisance abatement at this location for overgrown weeds in

Paul Geiger, Code Enforcement Coordinator, stated a couple of violation notices were sent. As
of today, the shed has been painted and some of the debris has been picked up. The following
violations still exist: overgrown weeds in landscaped beds, gate lying against fence,
miscellaneous debris. Pictures were shown at this time.
Dyar Ilia stated that he purchased this home two years ago and has since been through a terrible
divorce. He no longer lives in the home but he allows his ex-wife and children to live there. Mr.
Ilia added that every time he goes to the house to take care of the violations, his ex-wife calls the
police and he is asked to leave. Mr. Ilia said that his ex-wife is not willing to correct the
violations and he does not know what to do. He has started court proceedings and they are still
pending. Commissioner Cooper asked if this was Mr. Ilia’s primary residence. Mr. Ilia said, no,
this is not his primary residence and said that he resides in Warren. Mr. Ilia added that he is
letting his ex-wife live there for free because he does not want to put his children out on the
street. Commissioner Hartson asked if Mr. Ilia could make arrangements to go to the home
when his ex-wife isn’t there, or is there a court order prohibiting Mr. Ilia from being at the home.
Mr. Ilia stated that his ex-wife does not work and that she is always at the home. Commissioner
Pitrone told Mr. Ilia to check with the court as to his rights to be at the home. Mr. Ilia said he did
that earlier and the case is still pending. Commissioner Cooper stated that although he feels sorry
for Mr. Ilia, he is unable to correct the violations so the Board will have the city’s contractor
complete the work.
Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public
nuisance exists on the property commonly known 12224 Cardova Court and to direct the Code
Official to abate the violations identified in the attached staff report immediately. The Board
also authorizes and approves the imposition of a lien against the property, in the amount of the
cost of abatement incurred by the City, as permitted by the applicable city ordinance.

38728 Arcola Drive. Hearing on nuisance abatement at this location for overgrown bushes and
trees, weeds in sidewalk and driveway cuts and landscaped beds, stagnant water in pool, no self-
closing/latching gate, improperly stored garbage cans, outside storage – ladder on front porch,
debris – chair, broken wood, plastic.
Paul Geiger, Code Enforcement Coordinator, stated a couple of violation notices were sent. As
of today, the weeds in the sidewalk and driveway cuts have been removed and the stagnant water
from the pool is gone. The following violations still exist: overgrown bushes and trees, no self-
closing/latching gate, improperly stored garbage cans, outside storage – ladder on front porch,
debris – chair, broken wood, plastic. Pictures were shown at this time.
Mr. Bozied stated that all of the violations have been corrected with the exception of the self-
closing latch for the cyclone gate. Mr. Bozied stated that he found a latch, but it wasn’t self-
closing; he added that he went to three different stores and is having a hard time finding the
correct latch. Mr. Bozied said he has had the same lock on the gate for the past 30 years and
asked for a one-week extension. Commissioner Cooper stated that the latch is a common part
and should be available at fence supply stores. Mr. Viazanko said that there is a self-closing
mechanism on the market called a gravity hinge. He advised Mr. Bozied to contact pool supply
stores as well. Mr. Bozied stated that he will do so.
Motion by Commissioner Cooper, supported by Commissioner Ervin to declare that a public
nuisance exists on the property commonly known 38728 Arcola Drive and to direct the Code
Official to abate the violations identified in the attached staff report after July 3, 2012. The
Board also authorizes and approves the imposition of a lien against the property, in the amount
of the cost of abatement incurred by the City, as permitted by the applicable city ordinance.

G12-0143 Center Management
12300 Hall Road. Hearing on nuisance abatement at this location for overgrown shrubs and trees,
light poles need to be repaired or replaced, obsolete ground sign, debris – branches, paper,
broken cement.
Paul Geiger, Code Enforcement Coordinator, stated a couple of violation notices were sent. As
of today, most of the debris has been removed. The following violations still exist: overgrown
shrubs and trees, light poles need to be repaired or replaced, obsolete ground sign, miscellaneous
debris. Pictures were shown at this time.
Ken Swanik, representative from Center Management, stated that they intend on painting all of
the poles. A crew was at the site last week cutting back much of the overgrowth. They plan on
spraying the remaining weeds this week. Mr. Swanik said that he believes the broken cement
belongs to the property to the west of this lot. Mr. Swanik added that the debris comes from the
patrons going to Dooley’s Tavern, but said he will keep up with the clean up. Mr. Swanik said
that he would like the ground sign to remain so they can utilize it for advertising to try and sell
the property. Commissioner Ervin asked what the point is of keeping the rusted poles up, as they
seem like a liability. Mr. Ervin suggested that the poles be removed and the electricity capped
off. Mr. Swanik stated that the electricity to the site has already been cut off. Commissioner
Pitrone stated that painting the poles would technically put them in conformance, but only for a
short while. Commissioner Cooper asked Mr. Viazanko if the demolition permit included
removal of the poles, concrete curbing and parking lot removal, etc. Mr. Viazanko said he did
not know but would look into it. Commissioner Cooper stated that he believes the demolition is
only 80% complete and once it’s finished properly, it will better attract potential buyers. He
doesn’t think abating this property as listed would accomplish anything. Mr. Viazanko agreed
that it might be more beneficial to take the poles out and cap them at the base. He added that the
obsolete sign doesn’t hold the street integrity that it used to and should be removed or updated.
Commissioner Cooper said that he would be in favor of tabling this item until July to force a
complete demolition. Mr. Swanik stated that his company completed the demolition as the city
asked six years ago. He would like to maintain the lot to the city’s satisfaction and said that
tearing out the entire parking lot would be very costly.
Motion by Commissioner Cooper, supported by Commissioner Ervin to postpone case G12-
0143, 12300 Hall Road, to the next regularly scheduled meeting to allow Mr. Viazanko time to
decide if removing the entire parking lot and curbing is required.

14369 Alpena Drive. Hearing on nuisance abatement at this location for weeds in driveway cuts,
trim and side door in need of paint, outside storage – stack of bricks, pile of roof shingles,
wheelbarrows, hoses, aluminum, small appliance.
Paul Geiger, Code Enforcement Coordinator, stated a couple of violation notices were sent. As
of today, most of the weeds have been pulled or sprayed and the small appliance has been
removed. The following violations still exist: trim and side door in need of paint, outside storage
– stack of bricks, pile of roof shingles, wheelbarrows, hoses, aluminum. Pictures were shown at
this time.
Guiseppe Stanzione, brother of owner Salvatore Stanzione, stated that most of the outdoor
storage has been removed and the weeds have all been cleared away as well. Mr. Stanzione
added that the house was recently power washed to prepare it for painting.

nuisance exists on the property commonly known 14369 Alpena Drive and to direct the Code
Official to abate the violations identified in the attached staff report after July 9, 2012. The
Board also authorizes and approves the imposition of a lien against the property, in the amount
of the cost of abatement incurred by the City, as permitted by the applicable city ordinance.

garbage cans, overgrown shrub, debris – cardboard box, cinder blocks on basketball net.
Paul Geiger, Code Enforcement Coordinator, stated a couple of violation notices were sent. As
of today, the cinder blocks on the basketball net and weeds around the net have been removed
and the weeds from along the perimeter have been removed. The following violations still exist:
weeds in landscaped beds and driveway cuts, garage door in disrepair, improperly stored garbage
cans, overgrown shrub, debris – cardboard box. Pictures were shown at this time.
Mr. Maroof stated that this is a rental property and he was not aware of the violations. He said
that a tree was taken down today and will be removed and the garage door will be replaced later
in the week.

nuisance exists on the property commonly known 3646 Tracy Drive and to direct the Code
Official to abate the violations identified in the attached staff report after July 9, 2012. The

Memo received from Code Enforcement Officer, Alan Gross, stating that the nuisance has been
abated and there is no further cause for action.

4637 Norway Drive. Hearing on nuisance abatement at this location for lawn in disrepair, needs
to have sod or seeding.
Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of
today, there is no change. The following violations still exist: lawn in disrepair, needs to have
sod or seeding. Pictures were shown at this time.
Mr. Elliott said that he does not have the funds at this time to put in a lawn. He added that he is
currently having a sprinkler system installed and will work on securing funds for the grass.
Commissioner Cooper suggested that once the sprinklers have been installed, Mr. Elliott remove
the clay, level the dirt and put seed down. This will put the property in compliance.
Commissioner Pitrone added that Mr. Elliott might want to bring in some topsoil. Ms. Elliott
asked what actions the city will take if the grass hasn’t grown sufficiently by a certain date. Mr.
Viazanko replied that as long as progress is being made, the Board is willing to work with them.

nuisance exists on the property commonly known 4637 Norway Drive and to direct the Code
Official to abate the violations identified in the attached staff report after July 23, 2012. The

Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of
today, the boat and trailer have been moved and the outdoor storage of lawn equipment has been
taken care of. The following violations still exist: missing siding, missing gutters and
downspouts, overgrown shrubs, nuisance growth, wooden structure in disrepair, door frame
needs to be painted, improper storage of garbage cans, wheelbarrow full of debris, crawl space is

4252 Connie Drive. Hearing on nuisance abatement at this location for tall grass, weeds
throughout yard, weeds in pavement cuts and landscaped beds, area where pool was has not been
restored, shed is insecure and in need of paint, outdoor storage – pool supplies, debris – car
battery, logs, piping, wood.
Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of
today, there is no change. The following violations still exist: overgrown bushes, weeds in
landscaped beds, crack/cuts and perimeters, debris – plastic. In addition, a permit was never
issued for the shed and there is a rotted fence along the east side of the property that needs to be

Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of
today, all of the violations have been corrected with the exception of the garage door being in
disrepair. In addition, a section of the roof is currently tarped and is in disrepair. Pictures were
shown at this time.
Mr. Hrinciuc stated that he spoke with someone at the site who stated that the garage door would
be replaced soon. If not, Mr. Hrinciuc requested that it be boarded and painted. Commissioner
Cooper asked if the entire roof is tarped or just the front section. Mr. Hrinciuc stated that only
the front section is tarped.
