CITY OF STERLING HEIGHTS ORDINANCE BOARD OF APPEALS JULY 9, 2012 LOCATION: City Council Chambers, 40555 Utica Road, Sterling Heights, Michigan Chairman Pitrone called the meeting to order at 7:00 pm PRESENT: John Pitrone, Chairman, Kenneth Cooper, Vice-Chairman, Joseph DiGaetano, Secretary, Robert Ervin, Jennifer Hartson, Horst Hrinciuc, Code Enforcement Officer, Paul Geiger, Code Enforcement Coordinator, Michael Viazanko, Building Official ABSENT: None RECORDING SECRETARY: Kimberly Stulz APPROVAL OF AGENDA Motion by Commissioner Cooper, supported by Commissioner Hartson to approve the agenda as presented. CORRESPONDENCES Mr. Viazanko indicated that he had eleven correspondences for tonight. Hearing on nuisance abatement at this location for overgrown shrubs/ornamental tree, weeds in landscaped beds and cracks/cuts of cement, brick borders and gutters in disrepair, improperly stored garbage cans, outdoor storage and debris – wagon, wheelbarrow, wood, chairs and other miscellaneous items. Paul Geiger, Code Enforcement Coordinator, stated a couple of violation notices were sent. As of today, there is no change. The following violation still exists: overgrown shrubs/ornamental tree, weeds in landscaped beds and cracks/cuts of cement, brick borders and gutters in disrepair, improperly stored garbage cans, outdoor storage and debris – wagon, wheelbarrow, wood, chairs and other miscellaneous items. Pictures were shown at this time. Ms. Leszkowitz stated that this is a rental property and she has a letter from the landscape company that the work will be completed in 10 days. Commissioner Cooper asked if it would be done in 10 days. She said, yes. Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public nuisance exists on the property commonly known 35749 Shell Drive and to direct the Code Official to abate the violations identified in the attached staff report after July 19, 2012. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Hearing on nuisance abatement at this location for overgrown grass and bushes, weeds in landscaped beds, crack/cuts and perimeters, tree stump in need of removal, improperly stored garbage cans, outdoor storage & debris – wood, plastic, riding lawn mowers, metal, bikes, wheelbarrow and many more miscellaneous items stored outside. Paul Geiger, Code Enforcement Coordinator, stated a couple of violation notices were sent. As of today, there is no change. A self-closing and self-latching gate needs to be installed. The following violations still exist: overgrown grass and bushes, weeds in landscaped beds, crack/cuts and perimeters, roof shingles in disrepair, broken overhead garage door, stagnant water in uncovered pool, unsecured shed, loose trash around property. Pictures were shown at this time. Mr. Padovini, a neighbor, said his major concern is the pool and the mosquitoes. Chairman Pitrone asked if the pool is just covered or treated and covered. Mr. Geiger let him know that it is treated and covered. Motion by Commissioner Cooper, supported by Commissioner Ervin to declare that a public nuisance exists on the property commonly known 36883 Maas Drive and to direct the Code Official to abate the violations identified in the attached staff report immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Hearing on nuisance abatement at this location for overgrown grass & bushes, weeds in parking lot, perimeters and landscaped beds, dead vines (around air conditioner), parking lot in need of repairs (pot holes), exterior façade in need of power washing, windows in need of paint, access door in need of repair/paint or replacement, debris – roofing shingles, grass clippings, loose trash throughout, dead limbs and other miscellaneous items. Paul Geiger, Code Enforcement Coordinator, stated a couple of violation notices were sent. As of today, there is no change. The following violations still exist: overgrown grass & bushes, weeds in parking lot, perimeters and landscaped beds, dead vines (around air conditioner), parking lot in need of repairs (pot holes), exterior façade in need of power washing, windows in need of paint, access door in need of repair/paint or replacement, debris – roofing shingles, grass clippings, loose trash throughout, dead limbs and other miscellaneous items. Pictures were shown at this time. Mr. Morad just purchased the property. He said that he has started to clean it up but asked for 60 days. Commissioner Cooper believed most of the items could be resolved before then. Mr. Morad agreed that wouldn’t be a problem. Mr. Viazanko asked that the foreclosure sign be removed also. Mr. Morad said he would take care of it. Motion by Commissioner Cooper, supported by Commissioner Hartson to declare that a public nuisance exists on the property commonly known 4415 Metropolitan Parkway and to direct the Code Official to abate the violations identified in the attached staff report after July 23, 2012 except for the parking which is after 9/23/12. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Mr. Fuller, the owner, let the Board know that he has never been cited before in the last 26 years he owned the property. He disputes the ownership of the bushes he had to take care of. Chairman Pitrone told him that someone could help him in understanding but he needs to contact the Code Enforcement Officer during regular business hours because tonight is just to rule on the cases before them. Pictures were shown at this time. Mr. Daniels stated that they were waiting for the occupants to vacate and it does appear that they have moved. He asked to have until the end of the month. Commissioner Cooper asked if they could get it done in 2 weeks. Mr. Daniels said he was confident he could. Chairman Pitrone asked about the roof. Mr. Daniels said that they would do what they need to in order to fix it. The following violations exist: overgrown grass and bushes, weeds in landscaped beds, crack/cuts and perimeters, unsecured access door in need of paint, improperly stored garbage can and hose, debris – wood, fence section, plastic, aluminum, accumulated yard waste (leaves and grass clippings), garbage bags and other miscellaneous items. The owner called and said that they are moving out and will not be correcting any of the other violations. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, the majority of items were taken care of but there are still violations on the property. A maintenance company was actively working on the property. A frame is being built for the pool but it is illegal and the Code Officer will be telling them that they need a safety cover. The following violations still exist: overgrown grass and bushes, weeds in landscaped beds, crack/cuts and perimeters, privacy fence in disrepair, uncovered pool in disrepair with stagnant water, dead tree. Horst Hrinciuc, Code Enforcement Officer, stated a couple of violation notices were sent. As of today, there is no change but a fence permit has been applied for. The following violations still exist: overgrown grass and bushes, weeds in landscaped beds, crack/cuts and perimeters, stagnant water in pool, fence in disrepair, improper pool barrier, brick landscaped border in need of repair. Pictures were shown at this time. Mr. Dawood said he just purchased the property and asked for an additional 45 days due to his daughter’s wedding. He said he has cut some of the landscaping, drained the pool and is putting up a new fence. Chairman Pitrone asked what he is going to do with the pool. Mr. Dawood said he was going to rebuild it. Commissioner Cooper believed he could complete the work within 2 weeks. Commissioner DiGaetano agreed. Commissioner Cooper asked to see the pictures again and went through all the violations with Mr. Dawood. Discussion ensued about the amount of time requested. Chairman Pitrone also thought the work was minor and could be complete in 2 weeks. Mr. Viazanko pointed out that the roof system over the pool heater is a fire hazard and asked that it be removed.
