CITY OF STERLING HEIGHTS ORDINANCE BOARD OF APPEALS FEBRUARY 11, 2013 LOCATION: City Council Chambers, 40555 Utica Road, Sterling Heights, Michigan Chairman Pitrone called the meeting to order at 7:00 pm PRESENT: John Pitrone, Chairman, Kenneth Cooper, Vice-Chairman, Joseph DiGaetano, Secretary, Robert Ervin, Jennifer Hartson, Horst Hrinciuc, Code Enforcement Officer, Denice Gerstenberg, City Development Manager ABSENT: None RECORDING SECRETARY: Kimberly Stulz APPROVAL OF AGENDA Motion by Commissioner Cooper, supported by Commissioner Ervin to approve agenda as presented. Yes: All. Absent: None. Motion carried. ACCEPTANCE OF THOSE NOTIFIED BY MAIL Mr. Gerstenberg indicated that she is in receipt of a list of people notified by mail of tonight’s meeting. CORRESPONDENCES Ms. Gerstenberg indicated that she had correspondences for tonight. They are as follows: G13- 0028, G13-0029, G13-0030, G13-0031, G13-0035, and G13-0037; the nuisances have been abated and there is no further cause for action. CONSIDERATIONS G13-0027 Matti, Kawkab 39186 Faith Drive. Hearing on nuisance abatement at this location for missing attic vent. Code Enforcement Officer, Horst Hrinciuc, stated a couple of violations notices were sent. As of today, all the violation still exists. Pictures were shown at this time. Moved by Cooper, supported by Hartson, to declare that a public nuisance exists on the property commonly known as 39186 Faith Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G13-0028 Babisz, Michael & Gloria 3229 Barton Drive. Hearing on nuisance abatement at this location for storage of building materials (side of house and driveway), improperly stored garbage & garbage cans, debris – cardboard box. Memo received from Neighborhood Liaison Specialist, Robert Sergott, stating that the nuisance has been abated and there is no further cause for action. G13-0029 Valenza, Joseph & Judith 12457 Lyford Drive. Hearing on nuisance abatement at this location for junk vehicle in driveway and rear yard, outdoor storage (small furnace/heating devices) in rear yard. Memo received from Code Enforcement Officer, Patrick Willis, stating that the nuisance has been abated and there is no further cause for action. G13-0030 Saif, Sermad K. 11110 Plumbrook Road. Hearing on nuisance abatement at this location for loose trash and debris around property, improperly stored garbage & garbage cans, missing downspout extension, unsecured sunroom, debris – lawn bag, broom and other miscellaneous items. Memo received from Code Enforcement Officer, Patrick Willis, stating that the nuisance has been abated and there is no further cause for action. G13-0031 Ameen, Wani M. 13037 Whitfield Drive. Hearing on nuisance abatement at this location for covered porch (awning) with no permit, debris – concrete, loose trash, wood and other miscellaneous items. Memo received from Code Enforcement Officer, Patrick Willis, stating that the nuisance has been abated and there is no further cause for action. G13-0032 Bank of New York Mellon 39899 Spitz Drive. Hearing on nuisance abatement at this location for outdoor display - Christmas lights, fence in disrepair, outdoor storage and debris – ladders, old trampoline, plastic toys, log pile, empty flower pot, broken wooden furniture and other miscellaneous items. Code Enforcement Officer, Horst Hrinciuc, stated a couple of violations notices were sent. As of today, all the violations still exist. The rear patio overhang and ornamental fence needs painting but can’t be done until spring. He asked that the privacy fence be removed. It is in bad shape and has no permit on file. Pictures were shown at this time. Mr. Cooper asked that they secure the open electrical box in front near the garage. Mr. Horst said they would take care of that. Moved by Ervin, supported by Cooper, to declare that a public nuisance exists on the property commonly known as 39899 Spitz Drive and to direct the Code Official to abate the violations identified in the attached staff report including securing the electrical box which give rise to this finding immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G13-0033 Federal National Mortgage Assoc. 37116 Castleton Drive. Hearing on nuisance abatement at this location for garage overhang missing aluminum, missing house trim/siding, fence in disrepair, improperly stored garbage cans, trash and debris – old lawn furniture and table, garbage bad of debris, folding chair and other miscellaneous items. Code Enforcement Officer, Horst Hrinciuc, stated a couple of violations notices were sent. As of today, all the violations still exist. Pictures were shown at this time. Moved by Hartson, supported by Cooper, to declare that a public nuisance exists on the property commonly known as 37116 Castleton Drive and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G13-0034 Federal Home Loan Mortgage Corp. 4469 Ardmore Drive. Hearing on nuisance abatement at this location for broken front fountain, fence in disrepair, improperly stored garbage cans, missing downspout extension, disconnected downspout, missing/broken deck lattice, debris and outdoor storage – rusted swing set, bike, cinder blocks, loose trash, wood, trampoline and other miscellaneous items. Code Enforcement Officer, Horst Hrinciuc, stated a couple of violations notices were sent. As of today, all the violations still exist. Pictures were shown at this time. Mr. Cooper asked that the wood and bolt anchors be removed from the shed slab. Mr. Hrinciuc agreed to have them removed. Moved by Cooper, supported by Hartson, to declare that a public nuisance exists on the property commonly known as 4469 Ardmore Drive and to direct the Code Official to abate the violations identified in the attached staff report including removing the wood and bolts from the shed foundation which give rise to this finding immediately. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G13-0035 Talmer Bank & Trust 40735 Brentwood Drive. Hearing on nuisance abatement at this location for damaged and improper dumpster enclosure. Memo received from Code Enforcement Officer, Horst Hrinciuc, stating that the nuisance has been abated and there is no further cause for action. G13-0036 Lee, Robert & Stevens, Lori 2092 Maplecrest Road. Hearing on nuisance abatement at this location for overgrown bushes, trash and debris – garbage bags, yard waste (leaves), branches, outdoor storage of furniture and bicycles, wheel barrow, wood and other miscellaneous items. Code Enforcement Officer, Horst Hrinciuc, stated a couple of violations notices were sent. As of today, a large part of the debris has been removed. He had contact with the owner who indicated that the violations are corrected. Pictures were shown at this time. Mr. Lee stated everything was completed today. Mr. Cooper let the Board know that he was giving the Code Enforcement Officer a few days to get this resolved by the end of the week. Moved by Cooper, supported by Hartson, to declare that a public nuisance exists on the property commonly known as 2092 Maplecrest Road and to direct the Code Official to abate the violations identified in the attached staff report which give rise to this finding after February 14, 2013. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: Cooper, DiGaetano, Ervin, Hartson, Pitrone No: None. Absent: None. Motion carried. G13-0037 Antion, Caroline – 8623 Crestview Drive. Hearing on nuisance abatement at this location for shed in disrepair, improperly stored trash cans (at curb), exposed electrical wires (meter), missing fence sections and fence in disrepair (unfinished privacy fence), roof shingles in disrepair, gutter in disrepair, improperly stored hose, debris – old metal fence (with cement attached), loose brick pavers, tarp, lawnmower and other miscellaneous items. Memo received from Code Enforcement Officer, Horst Hrinciuc, stating that the nuisance has been abated and there is no further cause for action.
