NOTICE OF PUBLIC HEARING
The Ordinance Board of Appeals held a public hearing at 7:00 p.m. on Monday February 22, 2016 at
the Sterling Heights Municipal Center, 40555 Utica Road, Sterling Heights, MI in the Council Chambers,
586-446-2360. At this meeting the Board (1) considered variance requests of petitioners and (2)
conducted hearings on abatement of nuisances relating to the property and property owners itemized
on the following agenda.

a. All petitioners were notified by first class mail about tonight’s meeting. Remove the following
items from the consent agenda as they have been cleaned up prior to the meeting – G16-
0009, G16-0011 & G16-0013.

6. Consent Agenda
Moved by DiGaetano, supported by Jiles, RESOLVED, to approve the Consent Agenda as
amended:
1. To approve the minutes of the regular meeting of January 25, 2016, as presented.
2. G16-0012 U.S. Bank, National Association – 34188 Koch Avenue
RESOLVED, to declare that a public nuisance exists on the property commonly known
as 34188 Koch Avenue and to direct the Code Official to abate the violations identified
in the attached staff reports which give rise to this finding immediately. The Board also
authorizes and approves the imposition of a lien against the property, in the amount of
the cost of abatement incurred by the City, as permitted by the applicable city
ordinance.
3. G16-0014 Moffett, Thomas & Matthew – 12416 Greenway Drive
RESOLVED, to declare that a public nuisance exists on the property commonly known
as 12416 Greenway Drive and to direct the Code Official to abate the violations
identified in the attached staff reports which give rise to this finding immediately. The
Board also authorizes and approves the imposition of a lien against the property, in the
amount of the cost of abatement incurred by the City, as permitted by the applicable
city ordinance.

a. G15-0010 Ziemba, Jesse & Barbara – 39258 Bella Vista Drive
Code Enforcement Officer, Paul Geiger, stated as of today there were no changes to
the property.
Jesse Ziemba, owner, was present. Mr. Ziemba stated that his daughter lives there
and everything has been moved except the things on the porch. Agata Ziemba,
daughter, was present. Ms. Ziemba asked about certain items being allowed outside.
Mr. Geiger stated that no outdoor storage is allowed. Mr Ervin asked Ms. Ziemba how
much time she needs to clean up the property. Ms. Ziemba stated she needs a few
days.

Moved by Jiles, supported by DiGaetano, RESOLVED, to declare that a public
nuisance exists on the property commonly known as 39258 Bella Vista Drive and to
direct the Code Official to abate the violations identified in the attached staff reports
which give rise to this finding
after February 29, 2016. The Board also authorizes and approves the imposition of a
lien against the property, in the amount of the cost of abatement incurred by the City, as
permitted by the applicable city ordinance.

No: None. Absent: Pitrone. Motion carried.
b. G15-0015 Campbell, Bruce & Holly – 42264 Gainsley Drive
Code Enforcement Officer, Paul Geiger, stated as of today there were some changes to
the property.
Bruce Campbell, owner, was present. Mr. Campbell stated he is using some of the
items that are in the yard. He has a lot of garbage going out to the curb tomorrow night.
Mr. Campbell does not know what to do with the paddle boat. Mr. Ervin told Mr.
Campbell to store it in his garage. Mr. Campbell stated he does not have room in his
garage. Mr. Geiger explained all the pictures to Mr. Campbell. Mr. Geiger stated no
outdoor storage is allowed. Ms. Jiles stated that they have worked hard at cleaning the
property up. Ms. Jiles asked Mr. Campbell how long they need to finish. Mr. Campbell
stated that he needs about a week.
Moved by Jiles, supported by DiGaetano, RESOLVED, to declare that a public
nuisance exists on the property commonly known as 42264 Gainsley Drive and to
direct the Code Official to abate the violations identified in the attached staff reports
which give rise to this finding after March 7, 2016. The Board also authorizes and
approves the imposition of a lien against the property, in the amount of the cost of
abatement incurred by the City, as permitted by the applicable city ordinance.

No: None. Absent: Pitrone. Motion carried.
10. Adjournment
Motion by DiGaetano, supported by Jiles to adjourn the meeting.

All interested persons will be given an opportunity to be heard relating to the agenda items. With
respect to nuisance abatement hearings, the property owner, Code Enforcement Officer, or any other
interested party may present testimony at the hearing as to whether any condition located upon the
property constitutes a nuisance and whether the City should abate the nuisance. If the Board
determines that the conditions constitute a nuisance, the Board may order that the City abate the
nuisance with the cost of abatement to become a lien against the owner’s real property collectable in
the same manner as real property taxes. Questions re: this agenda can be directed to 586-446-2360.
The City will provide necessary reasonable auxiliary aids and services to individuals with disabilities
at the meeting upon 7 days notice to the Community Relations Office at 446-2470.
