CITY OF STERLING HEIGHTS NOTICE OF PUBLIC HEARING The Ordinance Board of Appeals II held a public hearing at 3:00 p.m. on Wednesday December 17, 2014 at the Sterling Heights Municipal Center, 40555 Utica Road, Sterling Heights, MI in the Council Chambers, 586-446- 2360. At this meeting the Board (1) considered variance requests of petitioners and (2) conducted hearings on abatement of nuisances relating to the property and property owners itemized on the following agenda. AGENDA 1. Chairman Kremhelmer called the meeting to order at 3:00 pm 2. Roll Call: Bruce Kremhelmer – Chairman, Derek B. D’Angelo – Vice- Chairman, Michael Sauger – Secretary, Al L. Kollmorgen, Paul Palmeri, Denice Gerstenberg – City Development Manager, Paul Geiger - Code Enforcement Officer, Dana Vietto - Recording Secretary 3. Report from City Liaison – Denice Gerstenberg a. All petitioners were notified by first class mail about today’s meeting. Remove the following items from the consent agenda and new business as they have been cleaned up prior to the meeting – G14- 0372, G14-0373, G14-0374, G14-0375 & G14-0378. 4. Removal of Consent Items to New Business- a Moved item 6 to New Business 9a. G14-0376 Johnson, Timothy – 40027 Eagle Drive b Moved item 7 to New Business 9b. G14-0377 Paraventi, Richard – 4617 Franklin Park Drive 5. Approval of Agenda Motion by Kollmorgen, supported by D’Angelo to approve agenda. Yes: All. Motion carried. 6. Consent Agenda Moved by D’Angelo, supported by Palmeri, RESOLVED, to approve the Consent Agenda as amended: Yes: All. Motion carried. 1. To approve the minutes of the regular meeting of November 19, 2014, as presented. 7. Public Hearings 8. Old Business 9. New Business a. G14-0376 Johnson, Timothy – 40027 Eagle Drive Code Enforcement Officer, Paul Geiger, stated as of today there have been no changes. Debris on porch and driveway need to be added to the agenda statement. Pictures were shown at this time. Timothy Johnson, owner, was present. Mr. Johnson gave the Board members hand-outs. He stated that he needs more time. Mr. Kremhelmer asked Mr. Johnson how much time he needs. Mr. Johnson stated that a schedule is in the hand-outs and he needs until April 15, 2015. He does not want to just put the siding up because he still needs to repair the water damage and leaks. Mr. Johnson stated that the debris on the front porch is a piece of plastic that is covering up the brick work that was recently done by a professional masonry. Mr. Kremhelmer asked how long until the plastic can be removed. Mr. Johnson stated that he can remove the plastic today. Mr. Kollmorgen asked what the cause was. Mr. Johnson stated that he has rotted beams. It is a big job and his schedule is hectic. Mr. Johnson stated that he has time now to do the work. Mr. D’Angelo stated the detailed package Mr. Johnson gave the Board members is nice. The fact that Mr. Johnson wants four months to get the work done is different than what the Board normally allows. It is unacceptable to have the property looking like this for so long. Mr. D’Angelo told Mr. Johnson that he may want to have someone else complete the work. Mr. Palmeri asked Mr. Johnson if he had a contractor give him an estimate. Mr. Johnson stated that he has not had a contractor give him an estimate for the siding. Mr. Kremhelmer asked Mr. Johnson how long he needs to finish the siding. Mr. Johnson stated 45 days. Ordinance Board of Appeals II December 17, 2014 Regular Meeting Page 2 Moved by D’Angelo supported by Kollmorgen, RESOLVED, to declare that a public nuisance exists on the property commonly known as 40027 Eagle Drive and to direct the Code Official to abate the violations identified in the attached staff reports, which give rise to this finding after March 1, 2014. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: D’Angelo, Kollmorgen, Kremhelmer, Palmeri, Sauger No: None. Absent: None. Motion carried. b. G14-0377 Paraventi, Richard – 4617 Franklin Park Drive Code Enforcement Officer, Paul Geiger, stated as of today there have been no changes. Debris/batteries on porch need to be added to the agenda statement. Pictures were shown at this time. Richard Paraventi, owner, was present. Mr. Paraventi stated that in the backyard the only thing left is the stove which will be picked up soon. Mr. Paraventi stated that he can remove the batteries as soon as he gets home. The wood in the backyard is raised up and used for the fire pit. Mr. D’Angelo stated that batteries should not be left outside. Mr. Paraventi stated that he will take care of it. He did not see the notices. Mr. Kollmorgen asked Mr. Paraventi how long he has owned the home for. Mr. Paraventi stated he has owned the home since 1997. Mr. Kollmorgen stated that he was the owner of the property when the six or seven other abatements took place. Mr. Paraventi stated that he travels a lot and does not get the grass cut or weeds pulled as often as he should. Mr. Geiger stated that there is no storage outside allowed. Properly stored firewood is allowed. That means firewood that is cut up for a stove, not scraps of wood up on a stack. Mr. Paraventi stated that he burns pieces of plywood. Mr. Geiger stated that firewood is logs. The only thing outside should be properly stored firewood with an 8 inch open space underneath and properly stacked. Trash cans with lids. A barbeque and table and chairs for outside use. Moved by D’Angelo supported by Sauger, RESOLVED, to declare that a public nuisance exists on the property commonly known as 4617 Franklin Park Drive and to direct the Code Official to abate the violations identified in the attached staff reports, which give rise to this finding after January 6, 2015. The Board also authorizes and approves the imposition of a lien against the property, in the amount of the cost of abatement incurred by the City, as permitted by the applicable city ordinance. Yes: D’Angelo, Kollmorgen, Kremhelmer, Palmeri, Sauger No: None. Absent: None. Motion carried. 10. Public Participation 11. With respect to nuisance abatement hearings, the property owner, Code Enforcement Officer, or any other interested party may present testimony at the hearing as to whether any condition located upon the property constitutes a nuisance and whether the City should abate the nuisance. If the Board determines that the conditions constitute a nuisance, the Board may order that the City abate the nuisance with the cost of abatement to become a lien against the owner’s real property collectable in the same manner as real property taxes.
