Mayor Jensen called the council meeting to order on September 7, 2021, at 7:00 pm in City
Hall.
Present: Mayor Jensen, Administrator Jackson, Attorney Larson
Council Members: Ostrem, Phillips, Solberg, O’Connor and Sporleder
Absent: None
Also Present: Jim Elliot, Jensen Builders
Motion by Sporleder, seconded by O’Connor, to approve the agenda.

minutes.

LEGAL ITEMS
A) APPROVE EBY EXPANSION PLANT 2 SITE PLAN
Jim Elliot, Jensen Builders, was present to review the site plan on the EBY
Expansion Plant 2. Administrator Jackson reported that the Planning and Zoning
Commission recommended approval of the site plan. Mayor and Council had
general questions and discussion.
Motion by Sporleder, seconded by Solberg, to approve Eby Expansion Plant 2 Site
Plan

B) RESOLUTION NO. 21-74 – SETTING FORTH A PROPOSAL FOR THE
SALE OF CITY OWNED REAL ESTATE (TO TNL DEVELOPMENT,
LLC/EBY) AND SETTING A PUBLIC HEARING
Motion by Ostrem, seconded by Phillips, to approve Resolution No. 21-74 – Setting
Forth a Proposal for the Sale of City Owned Real Estate (to TNL Development,
LLC/Eby) and Setting a Public Hearing for September 20, 2021 at 7 p.m. in City
Hall.

C) RESOLUTION NO. 21-75 – AUTHORIZING AND APPROVING A LOAN
AGREEMENT, PROVIDING FOR THE ISSUANCE OF A GENERAL
OBLIGATION STREET SWEEPER ACQUISITION NOTE AND
PROVIDING FOR THE LEVY OF TAXES TO PAY THE SAME
Administrator Jackson reviewed the terms of the loan agreement.
Motion by O’Connor, seconded by Sporleder, to approve Resolution No. 21-75 –
Authorizing and Approving a Loan Agreement, providing for the Issuance of a
General Obligation Street Sweeper Acquisition Note and Providing for the Levy of
Taxes to Pay the Same

D) RESOLUTION NO. 21-76 – ACCEPTING PETITION FOR VOLUNTARY
ASSESSMENTS AND AMENDING RESOLUTION OF NECESSITY FOR
THE BROAD STREET RECONSTRUCTION PROJECT – PHASE II
PURSUANT TO SECTION 384.41(2)
OF THE CODE OF IOWA
Administrator Jackson reported that Mike McGuigan, 701 Elm, has requested that
the sidewalk on Maple St. adjacent to his property, be included in the project.
Motion by Ostrem, seconded by O’Connor, to approve Resolution No. 21-76 –
Accepting Petition for Voluntary Assessments and Amending Resolution of
Necessity for the Broad Street Reconstruction Project – Phase II Pursuant to Section
384.41(2) of the Code of Iowa

E) ORDINANCE NO. 316 – AMENDING THE CODE OF ORDINANCES OF

READING
Motion by Sporleder, seconded by Phillips, to approve Ordinance No. 316 –
Amending the Code of Ordinances of the City of Story City, Iowa, by Amending
Provisions Pertaining to Alcoholic Beverage Control, Second Reading

CONTROLLED-ACCESS FACILITIES, SECOND READING
Motion by Phillips, seconded by Sporleder, to approve Ordinance No. 317 –
Amending the Code of Ordinances of the City of Story City, Iowa, by Adding
Provisions Pertaining to Low-Speed Electric Bicycles and Fully Controlled-Access
Facilities, Second Reading
