FREEDOM OF INFORMATION ACT CERTIFICATION City Clerk Dawley presented a resolution certifying the Closed Meeting of May 3, 2017, pursuant to Section 2.2-3712 of the Code of Virginia (1950), as amended. Council Member Fawcett, on a motion seconded by Council Member Duman, moved to approve the resolution, as presented, by the following vote: AYES: Mayor L. Fire Chief Scott and Fire Marshal Charles Chapin offered remarks. Johnson, Milteer and Ward 8 NAYS: None 0 2 City Council Regular Meeting May 3, 2017 PUBLIC HEARINGS Public Hearing – A public hearing to receive public comment on the Proposed Operating and Capital Budget for Fiscal Year 2017-2018 and related Ordinances Utilizing a PowerPoint presentation, Finance Director Tealan Hansen supplied a summary of the background information as printed in the official agenda. Mary Jo Chandler, no address given, opined about water and sewer rates. Sidney Neighbours, 57 Riverview Avenue, President, Suffolk Education Association, spoke in support of additional funding for Suffolk Public Schools. Sylvester Askins, 942 Chumley Road, Portsmouth, Virginia, representing the Endependence Center, spoke in support of funding for his agency. Ellen Saunders, 617 West Riverview Drive, representing the Western Tidewater Free Clinic, spoke in support of funding for her agency. Cena Lewis, 114 Nansemond Parkway, Apartment 901J, representing self, spoke in support of funding for the Endependence Center. Jerry Cantrell, no address given, opined about traffic on Route 13, education, and water quality. Reggie Carter, no address given, Service Director, Boys and Girls Clubs of Southeast Virginia, requested funding for his agency. LaMarr Coles, no address given, representing Boys and Girls Clubs Southeast Virginia-Suffolk Unit, requested funding for his agency. Natalie Rotzler, 108 Lakeview Road, Franklin, spoke in support of additional funding for Suffolk Public Schools. Angelo Stone, 2109 Arizona Avenue, President, Suffolk Bus Drivers Association, spoke in support of additional funding for Suffolk Public Schools. City Clerk Dawley advised that the 30 minute period for the public hearing has expired. She explained that should City Council wish to suspend its Rules of Order and Procedure and extend the public hearing until all persons are heard, a motion would be required. Council Member Fawcett, on a motion seconded by Vice Mayor Bennett, moved to suspend the City Council Rules of Order and Procedure and extend the public hearing until all persons are heard, by the following vote: AYES: Mayor L. Johnson, Vice Mayor Bennett, and Council Members Duman, Fawcett, Goldberg, T. Johnson, Milteer and Ward 8 NAYS: None 0 3 City Council Regular Meeting May 3, 2017 Aaron Burgess, 201 Kilby Avenue, representing self, spoke in support of additional funding for Suffolk Public Schoools. Hearing no additional speakers, the public hearing was closed. Council Member Fawcett, on a motion seconded by Council Member Duman, moved to direct City Manager Roberts to amend the proposed ordinance to provide an additional $1,000,000 for Suffolk Public Schools. Mayor Johnson asked if the motion could be amended to add language to direct City Manager Roberts to amend the proposed ordinance to provide an additional $1,000,000 for Suffolk Public Schools without a real estate tax increase. Both Council Member Fawcett and Council Member Duman concurred with this request and amended the motion accordingly. Members of City Council opined about the proposed motion. Council Member Fawcett, on an amended motion seconded by Council Member Duman, moved to direct City Manager Roberts to amend the proposed ordinance to provide an additional $1,000,000 for Suffolk Public Schools without a real estate tax increase, by the following vote: AYES: Mayor L. Johnson, Vice Mayor Bennett, and Council Members Duman, Fawcett, Goldberg, Milteer, and Ward 7 NAYS: Council Member T. Johnson 1 Public Hearing – A public hearing to receive public comment on the proposed Fiscal Year 2017-2018 Annual Action Plan for the City of Suffolk Community Development Block Grant Program and the Western Tidewater Home Consortium Home Investment Partnership Grant Program Utilizing a PowerPoint presentation, Deputy City Manager D. Scott Mills gave a report of the background information as printed in the official agenda. Hearing no speakers, the public hearing was closed. There was no action necessary tonight regarding this item. ORDINANCES Ordinance – An ordinance to amend the approved proffered conditions pertaining to the Residential Design Standards for a portion of the Hillpoint Planned Development, Zoning Map 26F(2), Parcels M*1A, M*1D, and M*1E; RR13A-86 and RR21A-94 Utilizing a PowerPoint presentation, Planning and Community Development Director David Hainley submitted a synopsis of the background information as printed in the official agenda. Council Member Fawcett moved to approve the proposed ordinance as presented. The motion failed to receive a second. Council Member Duman asked if the proposed changes were consistent with the changes that were made in 1997. Planning and Community Development Director Hainley replied in the affirmative. 4 City Council Regular Meeting May 3, 2017 Council Member Fawcett, on a motion seconded by Council Member Duman, moved to approve the ordinance. Mayor Johnson called for clarification of any potential impact on the density of the parcel as it relates to the proposed ordinance. Planning and Community Development Director Hainley explained that the proposed ordinance would have no impact on the density of the parcel. Council Member Fawcett, on a motion seconded by Council Member Duman, moved to approve the ordinance, as presented, by the following vote: AYES: Mayor L. Council Member Fawcett thanked the City’s public safety departments for their service. Council Member Fawcett advised he attended the Sentara BelleHarbour groundbreaking and the Boys and Girls Clubs of Southeast Virginia bike giveaway. Council Member Milteer opined about the proposed Operating Budget for Fiscal Year 2017-2018. Council Member Milteer announced he attended the Nansemond Suffolk Branch of the NAACP Freedom Fund banquet. Council Member Johnson opined about the summer burn ban. Council Member Johnson congratulated City Attorney Holland on her election to the Board of the Local Government Attorneys of Virginia. Council Member Johnson congratulated Council Member Duman on his receipt of the Boy Scouts of America Colonial Trail District’s Hometown Hero Award. Council Member Ward announced he attended the following: the fifth anniversary of the Center of Veterinary Expertise; Sentara BelleHarbour groundbreaking and a Parents Teachers Association meeting at Northern Shores Elementary School. Vice Mayor Bennett announced he attended the Nansemond Suffolk Branch of the NAACP Freedom Fund banquet. Vice Mayor Bennett reported the following constituent concerns: debris in need of removal at 1015 Truman Road; roadway repairs needed in the 1000-12200 blocks of Truman Road; shrubs in need of trimming at Diggs Circle and Sixth Street and streetlights in need of repair on Prospect Road. Vice Mayor Bennett advised he attended the Eastern District Parents Teachers Association Council meeting. Vice Mayor Bennett thanked City Manager Roberts and Finance Director Hansen for their presentations. Mayor Johnson congratulated City Attorney Holland on her election to the Board of the Local Government Attorneys of Virginia. Mayor Johnson congratulated Council Member Duman on his receipt of the Boy Scouts of America Colonial Trail District’s Hometown Hero Award.
