STAFF REPORTS Staff Report - Proposed Sign Ordinance Text Amendment Utilizing a PowerPoint presentation, Planning and Community Development Director David Hainley provided a summary of the background information as printed in the official agenda. Referring to the presentation, Mayor Johnson called for clarification about the feasibility of displaying a rentalheal estate sign and a political sign in a front yard at the same time. Planning and Community Development Director Hainley advised that scenario would be permitted. 2 City Council Regular Meeting December 2,2020 Referring to the presentation, Mayor Johnson asked about the permissibility and the legality of displaying multiple political signs in a front yard at the same time. Planning and Community Development Hainley reported that scenario would not be permitted under the current sign ordinance. City Attorney Holland added that she would need to research that matter to address the legality of that matter. Utilizing a PowerPoint presentation, Planning and Community Development Director Hainley resumed the summary of the background information as printed in the official agenda. Referring to the presentation, Council Member Goldberg sought information about the dissemination of the proposed sign ordinance amendments to the public. Planning and Community Development Director Hainley stated that the information was presented at the Planning Commission meeting, and a public hearing was held in order to receive citizen comments. Referring to the presentation, Council Member Goldberg opined about the process of advising the public hearing at the Planning Commission regarding the proposed sign ordinance amendments. Planning and Community Development Director Hainley reported that the public hearing was advertised in accordance with the State Code. He added that there were presentations on this matter made at previous City Council work sessions, and staff has also been in communication with representatives from the building industry, who provided recommendations. Members of City Council opined about the proposed sign ordinance amendments. Referring to the presentation, Mayor Johnson sought clarification about the definition a roof sign on a waterfront site. Planning and Community Development Director Hainley advised that an example of that type of sign would be for a marina that does not have street frontage. Mayor Johnson queried about any permitting requirements for real estate signs and their posts. Planning and Community Development Director Hainley said that there are no permitting requirements for real estate signs. Mayor Johnson inquired about the permissibility of feather flag signs. Planning and Community Development Director Hainley indicated that the City permits feather flag signs but does not permit the inflatable, dancing human-shaped balloons. Refening to the presentation, Mayor Johnson asked for clarification about the definition of a culturally significant property as it relates to the proposed sign ordinance amendments. Planning and Community Development Director Hainley explained that an example of a culturally significant property would be Glebe Episcopal Church. Referring to the presentation, Mayor Johnson solicited an explanation about the process that would be used to determine a culturally significant property as it relates to the proposed sign ordinance amendments. Planning and Community Development Director Hainley replied that staff is would need to determine the criteria that would be used to make that determination. -) City Council Regular Meeting December 2,2020 Referring to the presentation, Council Member Duman asked if the proposed sign ordinance amendments would be in concert with the Historical Overlay District regulations. Planning and Community Development Director Hainley replied in the affirmative. Council Member Duman opined about the requirement for a special event permit for temporary signage. Planning and Community Development Director Hainley said that not all temporary signage will require a special event permit. Council Member Duman queried about the regulations for feather flags and United States of America flags. Planning and Community Development Director Hainley explained that the requirements for feather flags would be addressed in the City's sign ordinance, and the requirements for United States of America flags are regulated by the United States Flag Code. Referring to the presentation, Mayor Johnson asked whether the proposed 40% requirement for window signs would apply outside of the central business district. Planning and Community Development Director Hainley explained that the Central Business District would allow larger signs, which is different from other areas. Members of City Council opined about the proposed sign ordinance amendments. Referring to the presentation, Council Member Fawcett inquired about the time line for the public hearing at the December 16,2020, City Council meeting. Interim City Manager Moor stated that based on the matters raised during tonight's meeting, the public hearing will be delayed in order to provide staff with an opportunity to address all concems. Staff Report - School Facilities Needs Assessment and Attendance Zone Plan Update Interim City Manager Moor introduced Duane Harver, Chief Executive Officer, RRMM Architects, the City's school facilities consultant, who utilizing a PowerPoint presentation, offered information about the above referenced item. Referring to the presentation, Council Member Duman called for clarification about the projected number of students over the next decade. Mr. Harver explained that based on the current data, it is projected that the student population will increase by 600 student over the next decade. Referring to the presentation, Mayor Johnson opined about the inclusion of the pending approved housing units in the assessment. Mr. Harver stated that the assessment addresses the number of students that will come from certain types of housing based on existing and projected growth and the overall demographics. Referring to the proposed motion, Council Member Duman called for an explanation of the application process. City Attomey Holland stated that the application will be available on the City's webpage for submittal via email or United States Postal Service to the Office of the City Clerk. She added that the applications will be available starting on December 4,2020. Referring to the proposed motion, Vice Mayor Bennett sought clarification about the City Code as it relates to application timeline for a vacancy on City Council. City Attorney Holland said that the City Code does not speak to when individuals interested in being considering for a vacancy in City Council can apply. She added that the City Code only addressed that the filling seat within 60 days of the vacancy occurring, and the selection must take place by the City Council that is seated in January 2021. Interim City Manager Moor reviewed the City's sewer extension petition process. Council Member Fawcett announced visited the Driver Village holiday event and the Sleepy Hole Park for the City's Holiday Lights Display. Council Member Fawcett congratulated those individuals who were recognized at the Suffolk Fire and Rescue Commencement and Badge Pinning Ceremony and Christine Stemen, Paralegal Administrator, Office of the City Attorney, on her receipt of the Virginia Lawyers Weekly 2020 Unsung Legal Hearos Award. Council Member Fawcett announced that he attended a recent food drive hosted by Council Member- elect LeOtis Williams. Council Member Goldberg opined about an increase crime in the downtown area.
