REMOVAL OF ITEMS FROM THE CONSENT AGENDA AND ADOPTION OF THE AGENDA Mayor Johnson announced that there has been a request for an additional item for consideration – a motion to schedule a public hearing for the June 7, 2017, City Council meeting regarding authorizing the issuance and sale of General Obligation Public Improvement Bonds, Series 2017. Mayor Johnson advised that a motion was in order at this time to amend the agenda to add the aforementioned item and adopt the remainder of the agenda as presented. City Manager Roberts offered information about the proposed additional motion. Whitney Saunders, 705 West Washington Street, representing Richard Conner, property owner, spoke in support of the proposed ordinance. Michael Sanford, 1609 Jackson Road, representing self, spoke in opposition to the proposed ordinance. Dan Peterson, 2581 Jackson Road, representing self, spoke in opposition to the proposed ordinance. Whitney Saunders, 705 West Washington Street, representing Richard Conner, property owner, spoke in support of the proposed ordinance. Council Member Goldberg queried whether water lines are already in place on the parcel under consideration. Mr. Saunders replied in the affirmative. Hearing no additional speakers, the public hearing was closed. Council Member Goldberg moved to approve the ordinance as presented. The motion failed to receive a second. Referring to the presentation, Council Member Johnson asked if a new entrance would be required. Planning and Community Development Director replied in the affirmative. 3 City Council Regular Meeting May 17, 2017 Referring to the presentation, Council Member Johnson opined about the need for a left turn lane. Planning and Community Development Director explained that it would depend on the configuration of the site, and if one was needed, it would come off onto Jackson Road. Council Member Goldberg, on a motion seconded by Council Member Johnson, moved to approve the ordinance. Referring to the presentation, Council Member Duman opined about the approach used by staff to analyze the parcel under consideration. Planning and Community Development Director Hainley explained that staff analyzed the parcel under consideration under the premise of 50 homes. Referring to the presentation, Mayor Johnson queried about the acreage of the proposed development. Planning and Community Development Director Hainley said that nine acres can be developed. Council Member Goldberg, on a motion seconded by Council Member Johnson, moved to approve the ordinance, as presented, by the following vote: AYES: Mayor L. David Joyner, 8411 Main Street, Ivor, Virginia, agent, representing Lighthouse Ministries of Suffolk, applicant, spoke in support of the proposed ordinance. Hearing no additional speakers, the public hearing was closed. Referring to the presentation, Vice Mayor Bennett inquired about the parking at the parcel under consideration. Planning and Community Development Director Hainley reported that the parking is sufficient at the parcel under consideration. Referring to the presentation, Council Member Johnson called for information about the next steps should the church not come to fruition. Planning and Community Development Director Hainley stated that the parcel would return to its original permitted use. 4 City Council Regular Meeting May 17, 2017 Council Member Johnson moved to approve the ordinance, with conditions, as presented. City Attorney Holland clarified Planning and Community Development Director Hainley’s answer about the relationship of a conditional use permit to the property. City Attorney Holland said that zoning would not revert to the original designation if the property’s ownership is transferred. Council Member Johnson, on a motion seconded by Council Member Duman, moved to approve the ordinance, with conditions, as presented, by the following vote: AYES: Mayor L. Robert Barclay, 200 High Street, Suite 500, Portsmouth, Virginia, representing Brick and Mortar Brewing Company, spoke in support of the proposed ordinance as presented. Hearing no additional speakers, the public hearing was closed. Referring to the presentation, Council Member Fawcett opined about the hours of operation. Planning and Community Development Director Hainley replied that the hours of operation are not referenced in the proposed ordinance. Mr. Barclay reported that the applicant has proposed the following hours of operation: Sunday through Thursday 9:00 a.m. – 11:00 p.m. and Friday and Saturday 9:00 a.m. – 12:00 midnight. Council Member Ward moved to approve the ordinance, with conditions, as presented. The motion failed to receive a second. Referring to the presentation, Council Member Goldberg queried about the parking. Mr. Barclay explained that there would be on site angled parking in the rear, and the applicant has secured an easement from the neighboring building. Council Member Ward, on a motion seconded by Council Member Goldberg, moved to approve the ordinance, with conditions, as presented. 5 City Council Regular Meeting May 17, 2017 Council Member Duman made a substitute motion to approve the ordinance with conditions #1 through #14 as presented and added the following condition #15 - The hours of the live entertainment shall be limited to from 9:00 a.m. until 11:00 p.m. Sunday through Thursday and from 9:00 a.m. until 12:00 a.m. (midnight) Friday and Saturday. The motion failed to receive a second. Referring to the proposed condition #15, Council Member Johnson asked whether the applicant would be amenable. Mr. Barclay replied in the affirmative. Council Member Duman, on a substitute motion seconded by Council Member Johnson, moved to approve the ordinance with consideration #1 through #14 as presented and the addition of condition #15 - The hours of the live entertainment shall be limited to from 9:00 a.m. until 11:00 p.m. Sunday through Thursday and from 9:00 a.m. until 12:00 a.m. (midnight) Friday and Saturday. Referring to the presentation, Council Member Johnson queried about the food service. Mr. Barclay explained that the State Code does not permit the sale of food, but patrons may bring in food. Council Member Duman, on a substitute motion seconded by Council Member Johnson, moved to approve the ordinance with consideration #1 through #14 as presented and the addition of condition #15 - The hours of the live entertainment shall be limited to from 9:00 a.m. until 11:00 p.m. Sunday through Thursday and from 9:00 a.m. until 12:00 a.m. (midnight) Friday and Saturday, by the following vote: AYES: Mayor L. City Clerk Dawley announced that the 30 minute period of the public hearing has expired and advised City Council that should they wish to extend the public hearing until all speakers are heard, a motion would be required at this time. Council Member Johnson, on a motion seconded by Council Member Fawcett, moved to suspend the City Council’s Rules of Order and Procedure to extend the public hearing to permit all speakers to be heard, by the following vote: AYES: Mayor L. Johnson, Vice Mayor Bennett, and Council Members Duman, Fawcett, Goldberg, T. Council Member Johnson moved to approve the proposed ordinance with the following amendment to Section 31-701 (b) (18) B. – “The minimum lot size for the keeping of backyard chicken shall be 10,000 square feet and a review after one year.” The motion failed to receive a second. City Attorney Holland opined that she was not familiar with including a date for a review after one year, but she could research the matter and provide a report. Council Member Johnson, on a motion seconded by Council Member Duman, moved to approve the proposed ordinance with the following amendment to Section 31-701 (b) (18) B. – “The minimum lot size for the keeping of backyard chicken shall be 10,000 square feet and a review after one year.” 7 City Council Regular Meeting May 17, 2017 Referring to the presentation, Vice Mayor Bennett queried about the areas that would be impacted by the proposed ordinance. Planning and Community Development Hainley reviewed the maps as provided in the presentation and as printed on the background information in the official agenda. Referring to the presentation, Vice Mayor Bennett opined about the neighborhoods that would be impacted by the proposed ordinance. Planning and Community Development Hainley advised that the proposed ordinance would apply in accordance with zoning but does not address deed restrictions or homeowners associations requirements of those communities governed by the same. Council Member Johnson, on an amended motion seconded by Council Member Duman, moved for approval of the proposed ordinance as presented. Council Member Fawcett, a motion seconded by Council Member Goldberg, moved to call for the question. The motion was then withdrawn. Deputy City Manager Mills stated that the Suffolk Redevelopment and Housing Authority has a process to allocate the funds. Mayor Johnson asked for an update on the status of the CSX Railroad crossing repairs. Public Works Assistant Director Louis Hansen supplied information regarding the ongoing maintenance and capital improvements on railroad crossings.
