3. Preliminary Plats:
A. PRELIMINARY SUBDIVISION PLAT PS14A-07, Westhaven Lakes Sections 6, 7, and
8, submitted by Brian J. Layne of Art-Ray Corporation, applicant on behalf of Lakeshore
Associates, property owner, for an amendment to the preliminary plat which created 29
residential parcels on approximately 30.9 acres. The requested amendment would eliminate
two points of access. The property affected is located to the west of the U.S. Route 58 Bypass
and to the south of Pitchkettle Road, and is further identified as Tax Map 34, Parcel 23,
Suffolk Voting Borough, zoned RL, Residential Low Density District (Conditional).
B. PRELIMINARY SUBDIVISION PLAT PS01-10, Bennetts Creek Shopping Center,
submitted by J. Stephen Ferguson, LS, of Hoggard-Eure Associates, P.C., applicant, on behalf
of Bennetts Creek Crossing, LC, property owner, to create two parcels of land for commercial
development. The affected properties are located at 3575 and 3605 Bridge Road and are
further identified as Tax Map 12 , Parcels 55*1 and 55*1*B3, Sleepy Hole Voting Borough,
zoned B-2, General Commercial Zoning District. The 2026 Comprehensive Plan designates
this area as part of the Northern Suburban/Urban Growth Area (Inner Ring Suburban).
4. Public Hearings:
A. REZONING REQUEST RZ08-09, Hampton Roads Crossing, submitted by John H.
Peterson, III, of Terry/Peterson Residential Thirty, L.L.C., property owner, to add a new
duplex category for the Residential Village and to amend the proffered Design Guidelines for
the Hampton Roads Crossing Mixed Use Development. The affected property is located on the
east side of Price’s Fork Boulevard and is north of University Boulevard. The property is
further identified as Tax Map 13G, Parcel R, Nansemond Voting Borough, zoned MUD,
Mixed Use Development Overlay District. The 2026 Comprehensive Plan designates this area
as part of the Northern Suburban/Urban Growth Area (Mixed Use Core).
B. CONDITIONAL USE PERMIT REQUEST C16-09, Folk City Tattoo, submitted by

Nathan B. Hudson, of Folk City Tattoo, applicant, on behalf of William C. Overman, III,
property owner, to permit the operation of a tattoo parlor and body piercing salon, in
accordance with Sections 31-306, 31-406, and 31-721 of the Unified Development Ordinance.
The affected property is located at 3235 Bridge Road (Unit 9) and is further identified as Tax
Map 12, Parcel 12M, Sleepy Hole Voting Borough, zoned B-2, General Commercial Zoning
District.
C. CONDITIONAL USE PERMIT REQUEST C17-09, East End Baptist Church, submitted
by Michael E. Perry, of MSA, P.C., applicant, on behalf of East End Baptist Church
(Trustees), property owner, to permit a large religious assembly and a daycare center in
accordance with Sections 31-306 and 31-406 of the Unified Development Ordinance. The
affected property is located at 1056 Portsmouth Boulevard and is further identified as Tax
Map 35, Parcel 88, Nansemond Voting Borough, zoned B-2, General Commercial Zoning
District.
D. CONDITIONAL USE PERMIT REQUEST C19-09, submitted by Whitney G. Saunders,
Esq., of Saunders & Ojeda, P.C., on behalf of the YMCA of South Hampton Roads, applicant,
on behalf of Hampton Roads Youth Center, Inc., property owner, to permit a child day care
center, in accordance with Sections 31-306 and 31-406 of the Unified Development
Ordinance. The affected properties are located at 277 and 275 Kenyon Road and are further
identified as Tax Map 33, Parcels 14 and 14C, Holy Neck Voting Borough, zoned O-I, Office-
Institutional Zoning District.
