REZONING REQUEST RZ09-12 (Conditional), Kroger’s Marketplace, submitted by Tim Colwell, Kroger’s Limited Partnership I, on behalf of John Peterson III, of the Terry Peterson Companies, applicant and property owner, to amend proffered conditions associated with the Hampton Roads Crossing Mixed Use Development to delete Condition Number 3 of the Hampton Roads Crossing Design Guidelines, which references Section 31-715, Large Shopping Center and Big Box Retail of the Unified Development Ordinance and to establish new design criteria for Big Box Retail uses. The request also amends Section A, General Building Signage Criteria, as defined in the Hampton Road Crossing Design Guidelines and replaces it with reference to the B- 2, General Commercial Sign Requirements as defined in Section 31-714, Sign Regulations of the Unified Development Ordinance. The affected properties are located along College Drive and University Boulevard within the Hampton Roads Crossing Mixed Use District and are further identified as Tax Map 13G, Parcels C and C*1A. Nansemond Voting Borough, zoned MUD, Mixed Use Development Overlay District. The 2026 Comprehensive Plan designates this area as part of the Northern Suburban/ Urban Development Growth Area (Mixed Use Core). B. CONDITIONAL USE PERMIT REQUEST C23-12, Kroger’s Marketplace, submitted by Tim Colwell, Kroger’s Limited Partnership I, on behalf of John Peterson III, of the Terry Peterson Companies, applicant and property owner, to permit the construction of a Drive-through use in accordance with Sections 31-306 of the Unified Development Ordinance and the approved Design Guidelines for the Hampton Roads Crossing Mixed Use Development. The affected property is located at College Drive and University Boulevard and is further identified as a portion of Zoning Map 13G, Parcel C, Nansemond Voting Borough, zoned MUD, Mixed Use Development Overlay District. 4.
